Board of Appeals kORTk °L �O *o � SACHUS v oti TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS May 13, 1981' George and Brenda Clark 862 Salem Street Premises Affected: 674 Turnpike Street Petition No. 10 - '81 Mr. Daniel Long, Town Clerk Town Office Building North Andover, Mass. 01845 Dear Mr. Long: The Board of Appeals held a public hearing on Monday. evening, May 11', 1.981 upon the application of George and Brenda Clark. The hearing was duly advertised in the North Andover Citizen on April 23 and 30, 1981 and all abutters :were notified by regular mail. The following Board members were present and voting: Frank Serio, Jr., Chairman; Alfred E. Frizelle, Esq., Vice - Chairman; William J.' Sullivan;: Augustine W. Nickerson; -and Raymond A. Vivenzio, Esq. The petitioner seeks a variance of Section 7, Paragraph 7.3 of the Zoning By -Law for the purpose of maintaining an existing structure, which has less than the required set back, on the premises located at 674 Turnpike Street. The petitioner's counsel, Harold Morley, introduced evidence regarding this unique petition. The land in question is registered land. The Land Court approved a petition for a portion of the land, which created a five foot parcel which could be construed as a lot.. Upon a motion made by Mr. Frizelle and seconded by Mr. Vivenzio, the Board voted unanimously to grant the variance as requested. tl George and Brenda Clark Petition No. 10 - '81 Page 2 The Board finds that the unique size and shape of the parcel and the location of the existing dwelling created a hardship within the definitions of the provision of Section 10.4 of.the By -Law. The Board further finds that the granting of the variance will not derogate or nullify the intent and purpose of the By -:Law, nor will it substantially be a detriment to - the neighborhood. The Board also finds that each of the conditions as set forth in Section 10.4 have been satisfied. The Land Court created a new lot in petitioners chain of title and a question now arises as to whether'an existing building needs a variance under the circumstances. These forms shall be furnished by the clerk upon request. Any communication purporting to be an application shall'be treated as mere notice of intention to seek relief until such time as it is made on the official application form. All information called for by the form shall be furnished by the applicant in the manner therein prescribed. Every application shall be submitted with a list of "Parties in Interest" which liste shall include the petitioner, abutters, owners of land directly opposite on any public or private street or way, and abutters to the abutters within three hundred feet of the property line of the petitioner as they appear on the most recent applicable tax list, notwithstanding that the land of any such owner is located in another city or town, the Planning Board of the,city or town, and the Planning Board of every abutting city or A own.
