Dear Mr. Nicetta:
I am writing in regards to the property at 69 So . Bradford
Street in North Andover, owned by Mr. Guy Bardascino of 55 So .
Bradford St, North Andover. This letter is a follow-up to our
telephone conversation of yesterday. The purpose of this
letter is to provide your Office with the results of my recent
site visit to the building at 69 So . Bradford Street address .
I visited the site on Thursday, March 11 with Mr. Charles
Tanzi , Architect . Mr. Tanzi was asked by the owner to provide
his services to determine the best way to rehab the building
in order to make it habitable and to meet the appropriate
Building Codes . The purpose of my visit was to determine the
type of framing and to determine what would have to be done to
provide a proper support during the demolition phase of the
project. During the visit, I inspected the exterior of the
building, the interior at all floor levels and the cellar
area . Some of the old interior finish(plaster and lath system)
was removed so as to better evaluate the structural framing .
As expected, it was vintage post and beam construction. The
major structural elements are the horizontal joists and main
beams , and the vertical posts which support the main beam
system . The studs , which were used to support the exterior
sheathing and the interior laths , are not structural in
nature . In fact, in some cases , the top of the studs do not
make contact with the underside of the beams . In order to
better evaluate the existing post and beam structure and to
determine what modifications have to be made to strengthen the
existing frame, it is necessary to strip the old lath and
plaster system . In so doing, the intent of the owner is to
have the contractor remove the lath and plaster from the
inside and the exterior surface including the asbestos
shingles , except for the exterior sheathing, which will stay
in place on the studs and will provide added stability to hQ
post and beam system during the demolition process . f�

In my opinion, the demolition can be undertaken in the proper
mariner as is customary for the rehab of an older building .
During the course of such work , it may be necessary to provide
temporary framing, as required by the contractor to ensure
proper removal of the non-structural elements . At the
conclusion of the demolition phase, Mr. Tanzi intends to make
measurements of the as-is condition and to provide the
necessary construction drawings so as to modify and to
strengthen the existing frame . I will provide any structural
engineering services as required by Mr. Tanzi in this regard.

I the undersigned applicant for the above property attest that the attached building permit for which this t
form is completed does comply with the EXEMPTION section 8.7.6 of the North Andover Growth
Management Bylaw. I also understand providing this form does not absolve me or any party to this permit
from the requirements of obtaining other permits required prior to the issuance of the Building Permit.
Further I understand that my interpretation of the EXEMPTION status is subject to review by the Building
Department and is only officially accepted when the Building Permit ig issued.
Based on section 8.7.6 of the North Andover Growth Bylaw the above lot and the work as applied for on the
above lot, in the building permit application and associated attachments, complies with one or more of the
following sections as indicated by a check mark.
This is an application for a building permit for the enlargement,restoration,or reconstruction of a dwelling in
existence as of the effective date of this by-law,provided that no additional residential unit is created.
The lot(s)were/was created prior to May 6, 1996 are exempt from the provisions of this Section 8.7 of the Zoning
Bylaw.
This application is for dwelling units for low and/or moderate income families or individuals,where all of the
conditions of 8.7.6.o are met and/or represents Dwelling units for senior residents,where accupanty of the units is
restricted to senior persons through a properly executed and recorded deed restriction running with the land. For
purposes of this Secdon"senior"shall mean persons over the age of 55.
This application is a part of a development project which voluntarily agreed to a minimum 40%permanent
reducdon in density (buildable lots),below the density, (buildable lots),permitted under zoning and feasible given the
environmental conditions of the tract,with the surplus land equal to at least ten buildable acres and permanently
designated as open space and/or farmland.The land to be preserved shall be protected from development by an
Agricultural Preservation Restriction,Conservation Restriction,dedication to the Town,or other similar mechanism
approved by the Planning Board that will ensure its protection.
This application represents a tract of land existing and not held by a Developer in common ownership with an
adjacent parcel on the effective date of this Section 8.7 shall receive a one-time exemption from the Planned Growth
Rate and Development Scheduling provisions for the purpose of constructing one single family dwelling unit on the
parcel.
This application represents a lot which is ready for building permits,(i.e.all other permits from all other boards and
commissions have been received and the project is in compliance with those permits), and the Development Schedule
does not accommodate issuing a building permit in that Year,one building permit will be issued per Year per
Development until such time as the Development Schedule accommodates issuing building permits. Applicant must
supply approved form U with this EXEMPTION.
Please provide any and all information that would assist the Building Department in making a determination'
that your application is allowed one or more of the above EXEMPTIONS.

The Board of Appeals held a regular meeting on Tuesday evening, November 10, 1998, upon the application of
Ronald &Joanne Cuscia, 770 South Bradford St., for premises at: 69 South Bradford St. North Andover, MA
requesting a Variance from the requirements of Section 7, paragraph 7.1 &7.3, of Table 2, within the R-1 Zoning
District, for relief of lot area and front setback, and for a Special Permit from the requirements of Section 9,
paragraph 9.1, 9.2, 9.3 for removal of an existing non-conforming structure and building of a new single family
residence on the site, and for relief of uses allowed within the non-disturbance buffer zone of the Watershed
Protection District Bylaw, of section 4.136, paragraph 3c.ii(3)(4)(6).
The following members were present: William J. Sullivan, Walter F. Soule, Raymond Vivenzio, Scott Karpinski,

Upon a motion made by Scott Karpinski, and seconded by Raymond Vivenzio, the Board voted to GRANT a
