District, for relief of lot area and front setback, and for a Special Permit from the requirements of Section 9,

residence on the site, and for relief of uses allowed within the non-disturbance buffer zone of the Watershed

Upon a motion made by Scott Karpinski, and seconded by Raymond Vivenzio, the Board voted to GRANT a
Variance as requested for relief of lot area of 43,558 sq. ft. and relief of front setback of 17.5 sq. ft. as shown on
the plan of land dated 9/22/98, by Hancock Survey Associates, Inc. 235 Newbury St. Danvers, MA 01923, by Craig
A. Vancura, Professional Land Surveyor, and to GRANT a Special Permit as requested for removal of an existing
non-conforming structure of 2038 sq. ft. and barn of 1767 sq, ft. and to build a new single family residence on the
site of 2190 sq. ft. and with a garage of 651 sq. ft. and for relief of section 4.136, paragraph 3 c ii (3)(4) (6)to allow
construction of a new structure within the non-disturbance buffer zone of the Watershed Protection District Bylaw.
Voting in favor: William J. Sullivan, Walter F. Soule, Raymond Vivenzio, Scott Karpinski and George Earley.
The petitioner has satisfied the provision of Section 10, paragraph 10.4 of the Zoning Bylaw and that the granting of
these variances will not adversely affect the neighborhood or derogate from the intent and purpose of the Zoning

Re: 69 South Bradford Street—Watershed Special Permit/Variance Request

I have reviewed the watershed special permit application for 69 South Bradford Street and have
the following comments:
1. In order to construct the home as shown on the proposed plan the applicant would need a
variance from Section 4.136(c)(iii)(3) of the watershed protection district bylaw which
prohibits the construction of any new permanent structure within the non-disturbance zone
(100' from the edge of the wetland resource area). See attached copy of the bylaw.
2. The applicant could avoid a watershed protection bylaw variance if the proposed home was
constructed within the existing footprint of the home as set forth in Section 4.136(b)(ii)(4).
The proposed home could also be expanded by up to twenty-five(25%)percent as long as
that expansion did not further encroach upon the non-disturbance zone as set forth in Section
4.136(b)(ii)(6). The applicant would still need a watershed special permit.
3. The lot does not meet the minimum acreage requirements as it contains only one acre. As the
owner of this lot also owns the two adjacent lots. It would be appropriate to require a two-
acre lot,as this land is located within the Lake Cochichewick Watershed Protection District.
The Planning Board will be holding the first public hearing on this application on October 2&
and would appreciate an update on the variance request prior to that meeting. Thank you for your
help on this matter,

----� ii. Uses Allowed by Special Permit: The following uses shall be allowed within
the Non-Disturbance Buffer Zone only by Special Permit issued pursuant to
Section 4 of this Watershed Protection District Bylaw:
(1) Any activities which cause a change in topography or grade.
(2) Vegetation removal or cutting, other than in connection with
a cultural uses or maintenance of a landscape area.
(3) Construction of a new permanent structure only after a variance has
been granted by the Zoning Board of Appeals.
(4) Replacement of any permanent structure.
(5) Any surface or sub-surface discharge, including but not limited to,
stormwater runoff, drainage of any roadway that is maintained by the
Division of Public Works or any private association; outlets of all
drainage swales; outlets of all detention ponds.
(6) Construction of any accessory structure or expansion of any existing
structure by less than twenty five(25) percent of the gross floor area of
the existing structure. (1994/1ST1V1)
Prohibited Uses: The following uses are specifically prohibited within the Non-
Disturbance Buffer Zone:
(1) All of the Prohibited Uses listed in Section 3(c)(1ii) of this Watershed
Protection District Bylaw are prohibited in the Non-Discharge Zone.
(2) Construction of any septic system.
(3) Construction of any new permanent structure, or expansion of an
existing structure by twenty-five (25) percent or more of the gross
floor area of the existing structure.
(4) The use, or method of application of any lawn care or garden product
(fertilizer, pesticide, herbicide) that may contribute to the degradation
of the public water supply.
(5) The use of lawn care or garden products that are not organic or slow-
release nitrogen.

Narrative
The following drainage analysis is presented to demonstrate
treatment of runoff associated with the proposed reconstruction of a
single family dwelling off South Bradford Street, in North Andover, Ma. The
proposed site conditions are analyzed to determine peak rate and
volumes of runoff associated with the 1 00ear 24 hour ur storm. The analysis
is performed using "Hydrocad", a computer program for generating peak
rates of runoff and hydrographs, based on the TR-55 and TR-20 methods
developed by the United States Soil Conservation Service. A drywell
system is then designed and sized to treat and infiltrate the runoff
associated with the proposed site development. The method of runoff
mitigation proposed is based on the BMP's (i.e. Best Management
Practices) developed and recommended by the Massachusetts
Department of Environmental Protection.
It is proposed to redevelop the site with a single family residential
dwelling and associated driveway. The. dwelling will be located on the
upland along the eastern property line, and serviced by municipal water
and sewer. The runoff and volume is proposed to be treated and
infiltrated by the installation of a shallow drywells which will capture runoff
from the impervious roof surfaces and allow it to infiltrate into the ground.
This method will provide both mitigation and treatment of runoff. Runoff
from the proposed site is calculated as 0.4 cfs for the 100 year, 24 hour
storm. The volume associated with this event is 0.03 acre-feet.
In conclusion, the proposed redevelopment of the site will not will
not cause a significant degradation of the quality or quantity of water in
or entering Lake Cochichewick. The on-site drywell system will serve to
infiltrate the runoff generated from the roof surafces as well as provide
treatment.
Calculate infiltration rate from the proposed drywells:
Use percolation rate of 15 minutes per inch (conservative)
Area available for infiltration is approximately 500 s.f.
Perc rate: 15 min/in = 180 min/c.f. = 10,800 sec/ft.
500 s.f. area/(10,800 sec/ft) = 0.05cfs out of basin

Re: 69 South Bradford Street—Watershed Special Permit/Variance Request
I have reviewed the watershed special permit application for 69 South Bradford Street and have
the following comments:
I. In order to construct the home as shown on the proposed plan the applicant would need a
variance from Section 4.136(c)(iii)(3) of the watershed protection district bylaw which
prohibits the construction of any new permanent structure within the non-disturbance zone
(100' from the edge of the wetland resource area). See attached copy of the bylaw.
2. The applicant could avoid a watershed protection bylaw variance if the proposed home was
constructed within the existing footprint of the home as set faith in Section 4.136(b)(ii)(4).
The proposed home could also be expanded by up to twenty-five(25%)percent as long as
that expansion did not farther encroach upon the non-disturbance zone as set forth in Section
4.136(b)(ii)(6). The applicant would still need a watershed special permit.
3. The lot does not meet the minimum acreage requirements as it contains only one acre. As the
owner of this Iot also owns the two adjacent lots. It would be appropriate to require a two-
acre lot, as this land is located within the Lake Cochichewick Watershed Protection District.
The Planning Board will be holding the first public hearing on this application on October 20`h
and would appreciate an update on the variance request prior to that meeting. Thank you for your
help on this matter.

the Non-Disturbance Buffer Zone only by Special Permit issued pursuant to
Section 4 of this Watershed Protection District Bylaw:
{1) Any activities which cause a change in topography or grade.
(2) Vegetation removal or cutting, other than in connection with
agricultural uses or maintenance of a landscape area.
(3) Construction of a new permanent structure only after a variance has
been granted by the Zoning Board of Appeals.

Notice is hereby given that the Board of Appeals will hold a public hearing at the
Senior Center, 120R Main St., North Andover, MA on Tuesday the 13th day of
October 1998, at 7:30 PM to all parties interested in the appeal of Ronald & Joanne
Cuscia, 770 South Bradford St, North Andover, MA., for premises located at 69
South Bradford St., requesting a Variance from the requirements of Section 7,
paragraph 7.1 & 7.3, of Table 2, for relief of lot area and front setback, and for a
Special Permit from the requirements of Section 9, paragraph 9.1, 9.2, 9.3 for removal
of an existing non-conforming structure and building of anew single family residence

The following drainage analysis is presented to demonstrate
treatment of runoff associated with the proposed reconstruction of a
single family dwelling off South Bradford Street, in North Andover, Ma. The
proposed site conditions are analyzed to determinep eak rate and
volumes of runoff associated with the 100 year, 24 hour storm. The analysis
is performed using "Hydrocad", a computer program for generating peak
rates of runoff and hydrographs, based on the TR-55 and TR-20 methods
developed by the United States Soil Conservation Service. A drywell
system is then designed and sized to treat and infiltrate the runoff
associated with the proposed site development. The method of runoff
mitigation proposed is based on the BMP's (i,e. Best Management
Practices) developed and recommended by the Massachusetts
Department of Environmental Protection.
It is proposed to redevelop the site with a single family residential
dwelling and associated driveway. The dwelling will be located on the
upland along the eastern property line, and serviced by municipal water
and sewer. The runoff and volume is proposed to be treated and
infiltrated by the installation of a shallow drywells which will capture runoff
from the impervious roof surfaces and allow it to infiltrate into the ground.
This method will provide both mitigation and treatment of runoff. Runoff
from the proposed site is calculated as 0.4 cfs for the 100 year, 24 hour
storm. The volume associated with this event is 0.03 acre-feet.
In conclusion, the proposed redevelopment of the site will not will
not cause a significant degradation of the quality or quantity of water in
or entering Lake Cochichewick. The on-site drywell system will serve to
infiltrate the runoff generated from the roof surafces as well as provide
treatment.
Calculate infiltration rate from the proposed drywells:
Use percolation rate of 15 minutes per inch (conservative)
Area available for infiltration is approximately 500 s.f.
Perc rate: 15 min/in = 180 min/c.f. = 10,800 sec/ft.
500 s.f. area/(10,800 sec/ft) = 0.05cfs out of basin

Notice is hereby given that the Board of Appeals will hold a public hearing at the
Senior Center, 120R Main St., North Andover, MA on Tuesday the 13th day of
October 1998, at 7:30 PM to all parties interested in the appeal of Ronald & Joanne
