The principal points upon which I base my application are as follows:

Petitioner seeks_to subdivide proper_�into two lots follower which one lot will require a
variance from frontage, area and setback requirements. Petitioner desires to subdivide the
proper y fors use_by._a family member. -Property is located close to the border of a general
business zone. The relief sought will not_derogate from the intent of the zoning by-laws nor
will it adversely affect the neighborhood. A portion of Petitioner's property was taken by the*

Every application for action by the Board shall be madeon a form approved
by the Board . These forms shall be furnished by the Clerk upon request .
Any communication. purporting to be an application. shall be treated as mere
notice of intention to seek relief until such time as it is made on the
official application form. All information called for by the form shall
be furnished 'by the applicant in the manner therein prescribed .
Every application shall be submitted with a list of "Parties In Interest"
which list shall. include the petitioner , abutters , owners of land directly
opposite on any public or private street or way, and abutters to the
abutters within three hundred feet ( 300 ' ) of the property line of the
petitioner as they appear on the most recent applicable tax list,
notwithstanding that the land of any such owner is located in another city
or town, the Planning Board of the city or town, and the Planning Board of
every abutting city or town .
*Cvery application shall be submitted with an application raharge cost in
the amount of LS25 . 00. In addition, the petitioner shall be responsible '
for any and all costs involved in bringing the petition before the Board .
Such costs shall include mailing and publication, but are not, necessarily
limited to these .
Every application shall be submitted with a plan of land approved by the
Board . No petition will be brought before the Board unless said plan has

Dear Mr. Long :
The Board of Appeals held a public hearing on October 14 , 1986 upon the
application of William & Kathleen Masterson requesting variance from the
requirements of Section 7 , Paragraph 7. 1 , 7 . 2 , 7 . 3 and Table 2 of the
Zoning Bylaws so as to permit a sub-division of property and relief from
frontage , area and setback requirements on one lot . The following
members were present and voting: Alfred Frizelle , Vice-chairman , Augustine
Nickerson , Clerk , William Sullivan , Walter Soule and Raymond Vivenzio .
The hearing was advertised in the North Andover Citizen on September 25
and October 2 , 1986 and all abutters were notified by regular mail .
Upon a motion made by Mr . Soule and seconded by Mr. Nickerson , the Board
voted unanimously to GRANT the variances requested, subject to the follow-
ing conditions :
1 . That lot line between Lot A and Lot B run directly to
street which would add frontage to Lot B and lessen
frontage on Lot . A.
2 . Plans be amended within 15 days after the date of filing -this
decision with the Town Clerk and be presented to the Board
reflecting the changes and any other adjustments made in
accordance with this decision .
The Board finds that due to the shape of the lots in question that a sub-
stantial hardship exists and that. granting the variances will not adversly
affect the neighborhood or the induration of the intent .and purposes of
the Zoning Bylaws .

Nickerson , Clerk , William Sullivan , Walter Soule and Raymond Vivenzio .
The hearing was advertised in the North Andover Citizen on September 25
and October 2 ; 1986 and all abutters were notified by regular mail: .

Upon a motion made. by Mr . Soule and seconded by Mr. Nickerson , the Board
voted unanimously to GRANT the- variances requested, subject to the follow-
ing conditions : .
1 . That lot line between Lot A and Lot B run directly to
street which would add frontage to Lot B and lessen
frontage on Lot A.
2 . Plans be amended within 15 days after the date of filing, -this
decision with the Town Clerk and be presented to the Board
reflecting the changes and any other adjustments made in
accordance with this decision..
The Board finds that due to the shape of the lots in question that a sub- .
stantial hardship exists and that. granting the variances will not adversly
affect the neighborhood or the 'induration of the intent and purposes of
the Zoning Bylaws .
