Petition #97-86 Mr . Daniel Long , Town Clerk Town Office Building North Andover , MA 01845 Dear Mr . Long : The Board of Appeals held a public hearing on June 10 , 1986 upon the application of Robert Dombrowski requesting a special permit from the requirements of Section 4 . 122 , Paragraph ( 14 ) of the Zoning ByLaw so as to permit converting an existing two-family house into a three-family by utilizing the third floor area which includes two existing bedrooms . The following members were present and voting : Mr . Frank Serio , Jr . , Chairman , Mr . Alfred Frizelle , Vice-chairman , Mr . Walter Soule , Mr . Raymond Vivenzio and Anna O ' Connor . The hearing was advertised in the North Andover Citizen on . May 22 and May 29 , 1986 and all abutters were notified by regular mail Motion made by Mr . Frizelle and seconded by Mr . Soule to DENY this special permit as requested as it does not conform to Provision 10 . 31 of the ByLaws . The parking of so many cars is a great pro- blem , especially in the winter months . Snow plow must back out after plowing because of lack of turning space . The Board feels that denying this Special Permit will not create a hardship on the petitioner . The vote was unanimous to deny this petition . Section 10 . 31 of the Zoning ByLaw reads as follows : 1 . The Special Permit Granting Authority shall not approve any such application for a Special Permit unless it finds that in its judgement all the following conditions are met : a ) The specific site is an appropriate location for such a use , structure or condition ; b ) The use as developed . will not adversely affect the neighborhood ; 4l. Page 2 - R . Dombrowski c ) There will be no nuisance or serious hazard to vehicles or pedestrians ; d ) Adequate and appropriate facilities will be provided for the proper operation of the proposed use ; e ) The Special Permit Granting Authority shall not grant any Special Permit unless they make a specific finding that the use is in harmony with the General purpose and intent of this ByLaw . SUMMING UP As you read this report you will notice that we have commented on a number of "problems", or what we call deficiencies, found in the property; some of our comments, as well, pertain to possible im- provements that can be made that will make the home more livable and less expensive to operate. We emphasize that it is important to have some sense of perspective about the conditions noted, for wliile some problems may involve a large expense or be very time-consuming,others may be relatively simple or inexpensive to remedy.Also,some items will need to be attended to right away for health or sai'ety's sake or to forestall larger costs later on;others,obviously, can be dealt with at some point in the future. Somi� items, such as the installation of wall insulation, may be considered optional, but the failure to do tlwin will lead to higher than desirable costs in the long run. We offer the caution that, as you probably realize, no home is perfect and older homes, in particular. will often have some obvious deficiencies. Normally the age and condition of the property is largely re- flected in the asking price.The purpose of the inspection, we repeat, is to fully disclose all of the hiddeii defects in the property which will lead to unanticipated expenses. If these defects are found and are large, the buyer can then reevaluate whether the price of the property reflects these conditions or whether some adjustment should be made.Finally we state the obvious:the decision on whether or not to purchase a home is seldom made on the basis of the inspection findings alone; the style, location, special features, and the price are normally the major considerations involved. We have summarized below any major deficiencies which, in the opinion of the inspector, will cost over $500 to repair. These are broken down into two categories: one for items which should be delle immediately or within the first year; a second for items which should, or will need to be done within the next four years. Another caution: the $500 cut-off is somewhat arbitrary as some repairs, particularly reconstruction projects, are very difficult to estimate. If the buyer wants estimates where we cannot provide them, we recommend that they have a contractor (or other qualified professional) lnok at the problem and give them estimates. Also, some deficiencies noted here may be relatively inexpensive or at least much less expensive if the work is done by the homeowner.
