2012 Massachusetts Electrical Code Amendments 527 CMR 12.00 § Rule 8: In accordance -with the provisions of M.G.L. c. 143, § 3L, the
permit application form to provide notice of installation of wiring shall be uniform throughout the Commonwealth, and applications shall be filed
on the prescribed form. After a permit application has been accepted by an Inspector of Wires appointed pursuant to M. G.L c. 166, § 32, an
electrical permit shall be issued to the person, firm or corporation stated on the permit application. Such entity shall be responsible for the
notification of completion of the work as required in M.G.L. c. 143, § 3L.
Permits shall -be limited as to the time of.ongoing construction activity, and may be.deemed.by the7nspector_of-Wires abandoned-and-invalidif-he—_.. _
or she has determined that the authorized work has not commenced or has not progressed during the preceding 12 -month period. Upon written
application, an extension of time for completion of work shall be permitted for reasonable cause. A permit shall be terminated upon the written
request of either the owner or the installing entity stated on the permit application.
C1 The Permit Extension Act was created by Section 173 of Chapter 240 of the Acts of 2010 and extended by Sections 74 and 75 of Chapter 238 of
the Acts of 2012. The purpose of this act is to promote job growth and long-term economic recovery and the Permit Extension Act furthers this
purpose by establishing an automatic four-year extension to certain permits and licenses concerning the use or development of real property. With
limited exceptions, the Act automatically extends, for four years beyond its otherwise applicable expiration date, any permit or approval that was
"in effect or existence" during the qualifying period beginning on August 15, 2008 and extending"through August 15, 2012.

An authorized inspection of 7 Elm Court was performed by Board of Health staff on
July 16, 2010 at which violations of 105 CMR 410.550 Chapter II of the State Sanitary
Code, Minimum Standards of Fitness for Human Habitation were found. Failure for
the tenants to respond within the allotted time period may result in a Board of Health
finding that the dwelling is unfit for human habitation.
All violations must be corrected within seven (7) days of receipt of this Order Letter.
Extensions may only be granted after review of a written request.

The occupant shall exercise reasonable care in the use of the floors, walls, doors, windows,
ceilings, roof, staircases, porches, chimneys, and other structural elements of the dwelling.

Every occupant of a dwelling unit shall keep all toilets, wash basins, sinks, showers, tubs, stoves
refrigerators and dishwashers in a clean and sanitary condition and exercise reasonable care in
the proper use an operation thereof.
1) Kitchen
a. Pantry found dirty and in disarray. Food overflowing
onto the floor of pantry. Floor dirty under shelving. Doors cannot be fixed
without area being cleaned

b. Floors unclean throughout kitchen
Tenant must clean and maintain floors in clean condition
2) Basement —
a. Basement has excessive piles of clothing and toys.
Landlord is responsible for maintaining the area free
from chronic wetness, however the tenant must be
responsible for organizing their belongings so
the contractors can effect repairs.
b. Many items wet and moldy. These items must be washed and
dried or removed from the basement.
Tenant must clean, remove and/ or organize all excessive items for basement floor.
3) Bathrooms
a. Found in unclean condition. Tub, toilet and floors unclean

a. Wet floor — mold evident, insulation in ceiling wet,
Piles of wet clothing tenant states was from past flooding during storm
Conditions confirmed by observations listed above. This is a chronic problem
- Owner must maintain basement free from chronic wetness
Water source must be investigated by an expert in basement
water problems. A report identifying the problems must be
submitted to the health office and the infiltration problem must be
addressed completely.

NOTE: Basement drain hoses end close to building. May be related to water
problems. Move farther out from foundation.

10) Tenant states the unit breakers constantly tripping due to possible electrical overload

Owner must hire a licensed electrician to ensure that the system circuits
are capable of handling the electrical needs of the tenants. Electrician must
submit findings to the Health Office or proof of corrections completed.

monoxide alarms in accordance with the MA Gen. Laws etc.

12) Also on July 20, upon concern the Health Dept
contacted NAFD regarding hot water tank issues reported by the tenant.
NAFD responded and did find the hot water heater leaking
from the top. NAFD de -energized it [electrical] by shutting off the
breaker and also shut off the cold water feed to the unit. It was
noted that the discharge for the relief is facing up towards the
ceiling and an electrical junction box.

NAFD responded and did find the hot water heater leaking
from the top. NAFD de -energized it [electrical] by shutting off the
breaker and also shut off the cold water feed to the unit. It was
noted that the discharge for the relief is facing up towards the
ceiling and an electrical junction box.

Every occupant of a dwelling unit shall keep all toilets, wash basins, sinks, showers, tubs, stoves
refrigerators and dishwashers in a clean and sanitary condition and exercise reasonable care in

July 16, 2010 at which violations of 105 CMR 410.550 Chapter II of the State Sanitary
Code, Minimum Standards of Fitness for Human Habitation were found. Failure to

7 Elm Court Service Report
On July 26, 2010, we investigated a complaint that the power was going out when the tenant used the vacuum.
What was discovered that the tenant had plugged the air conditioner into the general purpose living room
circuit rather than the dedicated air conditioner outlet. The tenant's air conditioner was not compatible with the
dedicated air conditioner outlet. We replaced the air conditioner outlet so that the air conditioner would be
powered by its separate circuit.
On July 26, 2010, we investigated a complaint that the bathroom ventilation was not working.
We discovered the first floor bath fan was not working, we ordered a new motor and blower wheel and replaced
these items on July 27.
Both the first floor and second floor bath fans exhaust at a rate of 50 CFM
The first floor bath's dimensions are 5 feet wide, 6 feet deep and 8 feet high. The cubic footage of the first floor
bath is therefore 240 cubic feet. At a rate of 50 CFM the air changes per hour is 12.5.
The second floor bath's dimensions are 5 feet wide, 10 feet deep and 8 feet high. The cubic footage of the
second floor bath is 400 cubic feet. At the exhaust rate of 50 CFM the air changes per hour is 7.5.

We responded and did find the hot water heater leaking from the top. We de -energized it [electrical] by shutting
off the breaker and also shut off the cold water feed to the unit. It was noted that the discharge for the relief is
facing up towards the ceiling and an electrical junction box. This leaves the residents, including 2 small boys,
w/o hot water. We also noticed another domestic water leak in the basement and shut off the supply to it as
well. It went to the outside spigot in the rear of the bldg..
I don't know if Sue toured the residence but it is in deplorable condition. We found piles of wet clothes,
blankets etc in the basement, the house smelled moldy and musty and there was only 1 working smoke detector
among other issues. I personally called Mr. Landers and advised his wife of the water heater issue. When I
called the Antunes to advise them that I had contacted the landlord, Mrs. Antunes stated that Mr. Landers was at
the home taking care of the water heater.

July 16, 2010 at which violations of 105 CMR 410.550 Chapter II of the State Sanitary
Code, Minimum Standards of Fitness for Human Habitation were found. Failure to
respond within the allotted time period may result in a Board of Health finding that the
dwelling is unfit for human habitation.
All violations must be corrected within seven (7) days of receipt of this Order Letter
or a detailed plan for correction must be approved by this office. If professional

- Owner must maintain basement free from chronic wetness
Water source must be investigated by an expert in basement
water problems. A report identifying the problems must be
submitted to the health office and the infiltration problem must be
addressed completely.

are capable of handling the electrical needs of the tenants. Electrician must
submit findings to the Health Office or proof of corrections completed.

from CO requirements

12) Also on July 20, upon concern the Health Dept repair complete, but old hot water
tank should be removed at some point. Not a health code issue
contacted NAFD regarding hot water tank issues reported by the tenant.
NAFD responded and did find the hot water heater leaking
from the top. NAFD de -energized it [electrical] by shutting off the
breaker and also shut off the cold water feed to the unit. It was
noted that the discharge for the relief is facing up towards the
ceiling and an electrical junction box.
Comply with Building codes as needed. Pull permits for
repair where needed
Copied Electrical Inspector regarding NAFD concerns.
Have licensed electrician address this issue as well.

am a homeowner on Water street. This is a Tuesday (trashday) on our street Water street/corner of
Elm Court. However, this amount of trash can be found at this spot any day throughout the week.
am told the town houses of Elm court do not have a dumpster, and that Vincent Landers? is the
landlord. Residents of the condo drive (NOT THE BIG WHIT BUILDING) by and throw trash from
they're cars as they leave Elm court and exit onto Water st. Trash is left uncovered, squirrels open
the bags, and garbage and debris is left scattered throughout the neighborhood. My neighbors and I
all have rats on our properties. It has also lead to a squirrel infestation. This has been going on for
at 1 least a year. I have made several complaints to the North Andover DPH and North Andover
Police Dept. Please, something has to be done to fix this unsanitary condition. Is there a way to
contact the landlord, and get a covered dumpster. Please help.
