receiving disability berrefits because the
Essex County Retirement Board has rul-
ed that drinking four to five bottles of
beer a day for 20 years, rather than
work-related stress, caused the health
problems that forced him to accept ear-
ly retirement.
Lustenberger, who last lived on
Autran Av6e., was forced to retire from
the North Andover Police Department
in June, 1984, after serving since 1960.
Lustenberger claimed that his heart con-
dition was caused by the stress of his job
and applied to the Essex County Retire-
ment Board for. accidental disability
benefits. His application to the county
board was .denied 18 months ago on
January 28, 1985.
The fact that Lustenberger is now

' Dear Mr . Long.:
The Board of Appeals held a public hearing on August 12 , 1986 upon
• ; w :; the application of Robert '& Linda Marconi and Mary A. Levis request
, ing a variance from the requirements of Section . 7 , Paragraph 3 of
the Zoning ByLaws so as to permit relief of side setback in order .for
construction of addition to present dwelling. The following members
were present and voting: Frank Serio , Jr . , Chairman , Alfred Fr,izelle ,
Vice-chariman , William Sullivan, Raymond Vivenzio and Anna O 'Connor.
The hearing was :advertised in the North Andover Citi.zen . on July 24
and July 31 , 1986 and all abutters were notified by regular mail .'
Motion made by Raymond Vivenzio and seconded by Alfred Frizelle to
GRANT the petition as requested for relief of side setback in order
to construct an addition to present dwelling. The vote was unanimous.
The Board ,feels that this will in' no may be a detriment to the,
neighborhood.

architecturally , as it will destroy the symmetry of the proposed addition .

The architectural design of the addition will be best served if it can
remain as drafted . There will be no change to the character of the neighbor-
hood. This expensive addition will increase the property values of the
neighborhood a. great deal and will not derogage from the spirit and intent
ot the By-Law.

Every application for action by the Board shall be made on a form approved
by the Board . These forms shall be furnished by the Clerk upon request .
Any communication purporting to be an application shall be treated as mere
notice of intention to seek relief until such time as it is made on the
official application form. All information called for by the form shall
be furnished by the applicant in the manner therein prescribed .
Every application shall be submitted with a list of "Parties In Interest"
which list shall include the petitioner , abutters , owners. of land directly
opposite on any public or private street or way, and abutters to the
abutters within three hundred feet ( 300 ' ) of the property line of the
petitioner as they appear on the most recent applicable tax list ,
notwithstanding that the land of any such owner is located in another city
or town, the Planning Board of the city or town, and the Planning Board of
every abutting city or town.
*Every application shall be submitted with an application charge cost in
the amount of $25 . 00. In addition, the petitioner shall be responsible
for any and all costs involved in bringing the petition before the Board .
Such costs shall include mailing and publication, but are not necessarily
limited to these .
Every application shall be submitted with a plan of land approved by the
Board. No petition will be brought before the Board unless said plan has
been submitted . Copies of the Board ' s requirements regarding plans are
