1. Once the appeal period has passed,please pick up your Town Clerk-certified copy of the Zoning Board of
Appeals Decision,and your ZBA Board signed Mylar(if a Mylar was required) from the Town Clerk's Office
located at 120 Main Street,North Andover,MA. 01845 (978.688.9501)
2. Please bring the Town Clerk-certified copy of the Decision &the signed Mylar to the Essex North Registry of
Deeds,354 Merrimack Street, Suite 304 (use Entrance C)Lawrence,MA. 01843 (978.683.2745),as the
decision and the Mylar must be filed at the Registry of Deeds as soon as possible.
3. Once this is completed,please bring to The Building Department:
a) A Copy of the Town Clerk&Registry stamped Decision
b) A paper copy made from the ZBA Board-signed and Registered Mylar
c) A completed Building Permit application along with two (2) sets of Building Plans (that have been
approved by the ZBA noting any/all revisions) in order to obtain a Building Permit upon review.
Failure to file the decision and the Mylar with the Registry of Deeds will result in your inability to exercise
your Variance and/or Special Permit and/or Finding due to your inability to obtain a building permit from
the Building Department.
"Furthermore, if the rights authorized by the Variance are not exercised within one (1)year of the date of the
grant,they shall lapse, and may be re-established only after notice, and a new hearing. Furthermore, if a

Re: 70 May Street
At the public hearing of the Zoning Board of Appeals on May 9, 2017 for property at 70 May
Street, Chairman Manzi requested information regarding the affordability restrictions placed on
properties developed by Bread&Roses Housing and funded, in part, by the Affordable Housing
Trust. Attached please find a copy of the recorded deed and notice of lease for the previous
project at 66 May Street. The highlighted language shows the restriction in place which will be
in perpetuity; therefore, the restriction will run with the land and cannot be removed, regardless
of who owns the land. Because the restriction runs with the land, there is no need for the Town to
have a right of first refusal on these properties.
Chairman Manzi also requested a determination as to whether the Bread and Roses housing units
could be counted toward the Town's subsidized housinginventory. In response to that request,

Town Counsel, Suzanne Egan, has provide the attached memorandum indicating the Town can
count these units in the subsidized housing inventory.

MEMORANDUM

Property: 70 May Street—Map 18 Lot 21
Date: June 1, 2017
The applicant, Bread & Roses Housing, is requesting dimensional variances to allow the new
construction of a single-family home to replace 70 May Street—an existing, dilapidated home for
purposes of affordable housing.The details of the Applicant's variance requests were set forth in
the Variance Application as previously submitted by the Applicant to the Board.
The hearing for the Variance was opened on May 9, 2017. The Board heard testimony from the
Applicant, North Andover Affordable Housing Trust and Levis Companies in support of the
Application.There were no abutters present at the initial hearing of May 9, 2017.The matter was
continued at the conclusion of the May 9, 2017 hearing with a number of issues to be addressed
by the Applicant in response to specific inquiries of the Board pertaining to the design of the
project.
The purpose of this memo is to respond and provide background with respect to the issues raised
by the Board at the initial hearing. There were seven (7) issues specifically identified for which
the Board requested further information,six(6)of which are addressed in this memorandum and
one (1) which is addressed in a separate memorandum by Laurie Burzlaff, chair of the Affordable
Housing Trust.

1. Plan of Land showing existing placement of the home with the proposed home.
Attached please find a revised plan with clear delineation between existing and the
subject, proposed home. The existing home has a footprint of 825 square feet. The
proposed home has a total footprint dimension of 894 square feet for a net increase
of about 8% (with front porch). However, the footprint of the main house (without
the front porch) is only 768 square feet - a footprint decrease from the existing
dwelling. In addition, the left side setback improves by 2 feet with the proposed
dwelling (8 ft)from the existing (6 ft).
2. Landscaping Design. A request was made for the Applicant to provide details of the
landscaping architecture, specifically, in relation to the removal of any existing trees
during construction of the site. The Applicant has removed two trees from the
property in preparation for construction —as documented on site plan. The Applicant
will replace the tree removed in the backyard with a 1" Maple Tree. In addition, the
Applicant will plant native species on the right perimeter of the building to include a
combination of native arborvitae shrubs and native perennials such as Liatris (Liatris
Species), Purple Dome New England Aster (Aster Novae-Angliae 'Purple Dome'),
Purple Coneflower (Echincea Purpurea) with some patches of ornamental grass -Tall
Switchgrass (Panicum Virgatum).
3. Stormwater/Water Table/Water Runoff/Water Infiltration Plan. A request was made
for the Applicant to provide details of stormwater management in the revised site
plan. The stormwater management system will collect all roof water runoff from the
gutters which will tie into an underground dry well cultech chamber. Cultech chamber
specifications can be found in the attached, revised site plan.
4. Neighborhood Lot Sizes and How Subject Property Compares Attached you will find
Town of North Andover MIMAP showing lot acreage written in.red. Lots that have
multifamily dwellings are indicated by the (2)written in red.Also attached are Google
Maps and the Town's GIS Map showing a bird's eye view of the neighborhood.As you
can see,the lot size is not significantly different than those found in the neighborhood,
especially since many lots that are slightly larger in size (34 and 38 May Street, 5, 7
and 21 Belmont) all contain 2 family dwellings. Three lots (22 May Street, 8 Morton
Street and 11 Waverly Road) are smaller than 70 May Street and contain single family
dwellings.
5. Feasibility of U-Shaped Driveway. A request was made for the Applicant to reconsider
the U-shaped, on-site driveway. The site plan has been revised to incorporate on-site
parking for two vehicles at the rear of the property instead of the U-shaped driveway.

Re: Local Residence Preference Affordable Units
You have asked for assistance in responding to the Zoning Board of Appeals' (the"ZBA")
inquiry as to whether Bread and Roses' affordable housing units that have been supported by the
Affordable Housing Trust are eligible to be included on the Department of Housing and
Community Development's("DHCD")subsidized housing inventory(the"SHI")list to be
counted towards North Andover's ten percent affordable housing goals.
Previously,there has been a concern that because Bread and Roses has a local residence
preference in their tenant selection process,DHCD will not include those units on the SHI list
and therefore the units will not count toward the Town's ten percent affordable housing goal.
Bread and Roses' tenant selection program provides that each applicant gets a certain number of
points for specific criteria,such as whether they live or work in North Andover or whether their
children attend North Andover Public Schools,among other criteria. All of the applicants are
evaluated and given priority based on their points.In my opinion,the tenant selection process
meets DHCD s requirements and the units may be counted towards the Towns ten percent
affordable housing goal.

ZONING BYLAW SECTION 7.2 Street Frontage
Minimum street frontage shall be as set forth in Summary of Dimensional
Requirements(Table 2)and the lot line meeting these requirements shall constitute the
"street frontage" for the lot.In no case shall actual street frontage at the street line be
less than seventy five(75)feet; except as allowed by Section 7.2.2. Corner lots shall be
required to have the required frontage only on one street. In determining the fulfillment
of the minimum area and minimum street frontage of a lot required in any zoning
district,there shall not be included any land within the limits of a street upon which
F-1 such lot abuts, even if the fee to such street is in the owner of the lot; except that if a
corner lot at its street corner is bounded in part by a segment of curved line not more
than seventy five(75)feet in length connecting other lines bounding such lot which if
extended would intersect,the area and frontage required in such lot shall be computed
as if such potentially intersecting lines were so extended;but if a curved line more than
seventy five(75)feet in length is the whole of any one boundary line of a lot, the
minimum area and minimum frontage required shall be determined entirely within the
lines bounding such lot, including such curved line.
