RE: Great Pond Estates - (DEP #242-365 & NACC #3).
Dear Ms. Elias:
I am in receipt of correspondence from you dated August 5, 1996 which pertains to the
above referenced project. You state that "work will be starting within the week on
construction of the road for Great Pond Estates." Enclosed please find an Enforcement
Order mandating a cease and desist of all project related activities. The North Andover
Conservation Commission (NACC) has not authorized work as approved under NACC
#3 or DEP #242-365. The following pre -construction issues remain outstanding and it
is of the utmost importance that these specific conditions be resolved prior to any
construction activities on-site (please refer to both Order of Conditions):
NACC #3:
This'permit is scheduled to expire on September 10, 1996. Section
VIII(B)(p.15) of the North Andover Wetland Regulations requires that a
written request for an extension must be filed at least thirty (30) days prior to
the expiration date of the permit. Not more than two (2) Extension Permits
may be granted for a particular Order of Conditions. Furthermore, no
request for an extension will be granted unless the wetland is either re -
flagged, or the original approved flagging is re-established in the field. The
NACC may require a new filing, or the re -opening of the public hearing, if
the wetland delineation has changed from the original submittal. Upon
receipt of a $50.00 fee and re-establishment of the wetland flags I will
schedule you for the August 21, 1996 NACC meeting. This matter needs to
be resolved immediately;
• CONDITION #9: This Department is not in receipt of any recording
information. Please note that all Order of Condition(s), Extension Permits
and Modifications must be recorded at the Registry of Deeds;

• CONDITION #10: This condition refers to placement of a 2' x 3' sign
referencing NACC #3 and DEP #242-365;
• CONDITION #14: There are some discrepancies with regards to on-site
wetland resource areas. Please read this condition carefully and respond
accordingly;
• CONDITION #17: Please read this condition carefully;
• CONDITION #22: Please note that the above referenced Order of Conditions
permits construction of the roadway, utilities and drainage structures off.
Work associated with single family home construction is not authorized at
this time;
• CONDITION #24: Please note that the correspondence forwarded to this
Department does not satisfy this condition. An additional site visit and/or
office meeting is warranted;
• CONDITION #25: Please submit a construction schedule/ sequence to this
Department immediately;
• CONDITION #26: This condition is self explanatory, however, it is
important that the contractor read it carefully;
• CONDITION #27: Please inspect the property and verify that all wetland
flags are visible in the field. This shall be resolved prior to meeting in the
field so that they can be expected at such time;
• CONDITION #28: Do not install erosion control of any kind until a meeting
is scheduled with this Department;
• CONDITION #29: Self explanatory;
• CONDITION #32: Self explanatory;
• CONDITION #37: This condition refers to groundwater sampling. Please
read it carefully;
• CONDITION #43: Please bring a check in the sum of $15,000 to the
Conservation Department immediately and prior to work of any kind. This
bond is for surety of project compliance and will be released upon
completion of all work;

Please note that these above mentioned conditions are only a summary of those
described within the Order of Conditions. As the applicant, you are responsible for
complying with all of the permit conditions as drafted and approved by the NACC.
DEP #242-365:
• This permit is also scheduled to expire on September 10, 1996. Please
respond accordingly;
• CONDITION #14: The applicant is responsible for notifying the Department
of Environmental Protection, in writing, 48 hours before any activity
commences on the project site;
• CONDITION #17: It shall be the responsibility of the owners of the
property...to inform all contractors and subcontractors of the applicable
conditions and provisions of this Order;
• CONDITION #19: Please provide proof of recording information to the
Department as well as the NACC;
The enclosed Enforcement Order is not meant as a deterrent but rather as a "tool" for
assuring compliance and mitigating future problems with the project. Simply comply
with the pre -construction conditions mentioned above and the cease and desist order
will be lifted and the project will commence.
Your anticipated cooperation is appreciated and I look forward to working with you as
the project proceeds. Please do not hesitate to contact me should you have any

The Department of Public Health, in response to the request contained in
your letter dated June 16, 1969, has caused examinations to be made by one of
its engineers of the site proposed for sewage disposal for the above referenced.
private residence, to be'located at 722 Great Pond Road. This site is located ``
on the watershed of Lake Cochichewick, and, the proposed sewage disposal system
will be located approximately 280 feet from the edge of the lake.
A site examination showed that the soil in the area proposed for sewage
disposal consists of approximately 18 inches of topsoil underlain by stoney
tiil.to depths in excess of eight feet. Percolation rate in,this material is
of the order of five minutes per inch. No ground water was encountered at
depths of eight feet below existing.grade.
The Division of Environmental Health is of the opinion that the soil in
this area is suitable for the subsurface disposal of sewage, and that the dis-
tance from the edge of the lake is sufficient to provide protection of the
waters of Lake Cochichewick. Adequate area is available for expansion of,this
system when necessary.
The plan submitted with the above referenced letter -.is not drawn in suf-
ficient -detail to permit approval by this Division. However; based on the
site examination, your Board may properly issue'a permit to begin construction
of this home, provided that detailed plans for the prop bsed.sewage disposal
systemare submitted to this Department for its approval prior to construction
of this system.

Please forgive the lateness of this reply, but your plans and letter
became lost in the confusion of moving to a new office building within
the hospital complex.
This office is in receipt of a plan by Joseph J. Barbagallo, R.S.,
showing a site plan and details of a sewage disposal system to serve the
above named residence. You have previously been advised in a communica-
tion dated July 2, 1969 relative to the suitability of soil in the area
for the disposal of sewage from this home. The plan submitted indicates
that sewage will be disposed of by means of a 1,000 gallon septic tank,
distribution box, and 1200 square feet of leaching area. The bottom of the
proposed leaching bed will be placed at elevation 95.75 feet, -approximately
92 feet above the level of Lake Cochituate. A similar expansion area is
provided adjacent to the planned initial field, which is to be located over
100 feet from the high water line of the lake.

,'Kindly accept this letter as a follow-up to Mrs. Elias' letter of March 19, 1996. As
you `may` know, Mrs. Elias' husband is deceased and while her land holdings may be
significant, she currently lives on a fixed income. It would` be -a tremendous financial
strain and a waste of resources for Mrs. Elias to be required to install all the necessary
equipment and piping only to have it replaced in less than a year with a state of the art
system.
My office, over the last several years, has worked closely with Mrs. Elias in
obtaining approval of the subdivision. We have finally obtained all such approvals, which
include a road, sewer and lift station. The approvals contain a deadline and therefore, we
must begin work in the spring or summer in order to comply. The Town would be assured
that if it were to grant the six month extension the time limits would be strictly adhered
