Petition: #98-89
DECISION
The Board of Appeals held a public hearing on Tuesday evening, February 13, 1990
upon the application of Ann Gilbert, c/o Attorney J. J. Willis requesting a
variation from the requirements of Section 7, Paragraph 7.2 and Table 2 of the
Zoning Bylaw so as to permit relief from area and frontage requirements on the
premises located at 701 Forest Street. The following members were present and
voting: Frank Serio, Jr., Chairman, Augustine Nickerson, Clerk, Walter Soule,
and Raymond Vivenzio.
The hearing was advertised in the North Andover Citzien on January 25, 1990 and
February 1, 1990 and all abutters were notified by regular mail.
Upon a motion made by Mr. Vivenzio and seconded by Mr. Nickerson, the Board
voted, unanimously, to GRANT the variances as requested, subject to the follow -
ung conditions:
1. Petitioner be allowed to WITHDRAW WITHOUT PREJUDICE the
petition for variance for all of the _land except Lot A
and Lot C, listed at the Registry of Deeds as Lot A-6757
and Lot C-7809.
2. Area and frontage relief granted as requested on these
two lots.
The Board finds that the petitioner has satisfied the provisions of Section 10,
Paragraph 10.4 of the Zoning Bylaw and that the granting of this variance will
not derogate from the intent and purpose of the Zoning Bylaw nor will it
adversely affect the neighborhood.

The principal points upon which I base my application are as follows:
Applicants property was tied up in litigation in Essex County
Superior Court at the time the Zoning Change from R2 to R1 occurred. The
property was purchased and being held by the application to fund her
retirement. The applicant was unable to proceed with division of her
property as shown on enclosed plans. To require her to meet the new
Zoning Request would be confiscatory and constitute an extreme financial
hardship. Relief may be granted without substituting detriment to the
public good and are substantially derogating from the general intent and
purpose of the Zoning By -Law.
