The Board of Appeals held a public hearing on February 9,-1988 on the application
of James Logue, trustee of Country Corner Realty Trust requesting a variation of
Section 6, Paragraph 6.6(5D) of the Zoning ByLaws so as to permit relief in set-
back requirements for sign location on the premises located at 701 Salem Street.
The following members were present and voting: Frank Serio, Jr., Chairman,
Alfred Frizelle, Vice-chairman, Walter Soule, Anna O'Connor and Louis Rissin.
The hearing was advertised in the North Andover Citizen on January 21 and January
28, 1988 and all abutters were -notified -by regular mail.
Upon a motion made by Mr. Frizelle and seconded by Mr. Soule, the Board voted,
unanimously, to GRANT the variance as requested subject to the condition that
the petitioner present a drawing of the sign to be erected to the Board in
accordance with the Bylaw.
The Board finds that the petitioner has satisfied the provisions of Section 10,
Paragraph 10.4 of the Zoning ByLaws and the granting of this variance will not
derogate from the intent and purpose of the Zoning ByLaws nor will it adversely
affect the neighborhood.

Applicant is requesting a setback variance from ten (10') feet
to one (1') foot. Staff looked at the site and feels that the sign
setback one foot from the existing stone wall and raised 3' above grade
will not adversely effect sight visability along Salem Street from the
parking lot or Abbott Street. The proposed location will increase the
signs visability in both directions from Salem Street.
Staff requests an elevation of the sign in order to insure its
compliance with the Town's Sign Regulations.

The zoning set back of 10 feet results in the sign location being
hidden by existing off sight vegetation resulting in a public safety!
hazard. The set back also places the sign inPa location where it has:
been hit.by parking lot traffic. The relief! can be granted due'to
the uniqueness of this location without detriment to the public good,,.`
and without.substan.tially derogating from the intent and purpose -of
the by-law. The existing condition constitutes a hardship to the**'`
gree to pay for advertising in newspaper and incidental expenses*

formation called for by the form shall be. furnished by thg opplicant,
in the manner therein prescribed:
Every application shall be submitted with a list of "Parties in
Interest" which list shall include the petitioner, abutters, owners
of land directly opposite on any public or private street or way,
and abutters to the abutters within three hundred feet of the property
line of the petitioner as they appear on the most recent applicable,
tax list, notwithstanding that the land of any such owner is located
in another city or town, the Planning Board of the city or town, and ,
the Planning board of every abutting city or town,
Every application shall be submitted with an application charge cost
in the amount of $25.00. In addition, the petitioner shall be respon-
sible for any and all costs involved in bringing the petition befpre
the board. Such costs shall include mailing and publication, but
are not necessarily limited to these
