Notice is hereby given that the Board of Appeals will hold a public hearing at the
Steven's Memorial Library, 345 Main St., North Andover, MA on Tuesday the 9th
day of June, 1998, at 7:30 PM to all parties interested in the appeal of Robert A.
Brown, (Allen Trust), 242 Andover St., Andover, MA, for premises located at
Bradford St., requesting a Variance from the requirements of Section 4.136,
Paragraph 2, of Table 1, to construct a driveway within seventy-five feet from the
wetlands, and to subdivide the land into two buildable lots with each home being
constructed within 150 feet from the wetlands.
Said premises are property with frontage on the West side of Bradford St. which is in

The Board of Appeals held a regular meeting on Tuesday evening the 14th of July, upon the
application of Robert A. Brown (Allen Trust), 242 Andover, St., Andover, MA., requesting a
Variance for premises located at Bradford St., North Andover, MA., from the requirements
of Section 4.136, Paragraph 2, of Table 1, to construct a driveway within seventy-five feet from
the wetlands, and to subdivide the land into two buildable lots with each home being
constructed within 150 feet from the wetlands, within the R-1 Zoning District.
The following members were present: William J. Sullivan, Walter F. Soule, Robert Ford, Ellen
McIntyre.
The hearing was advertised in the Lawrence Tribune on 5/26/98 & 6/2/98 and all abutters were
notified by regular mail.
Upon a motion made by Walter F. Soule and seconded by Robert Ford, the Board of Appeals
unanimously voted to allow the petitioner and/or the petitioner's representative to
withdraw the petition without prejudice. Voting in favor. William J. Sullivan, Walter F.
Soule, Robert Ford, Ellen McIntyre.

I have reviewed the variance request for two homes and a driveway within the Conservation and
Non -Disturbance Zones of the Watershed Protection District and have the following comments.
The lots have not yet been created therefore I question whether this application is appropriately
before the Board as the variances sought do not concern the size, setbacks or frontage for the
lots. At this point in time one 5.6 -acre lot exists.
The Watershed Protection District Bylaw allows the construction of a new permanent structure
within the 150' non -disturbance zone only after a variance has been granted by the Board of
Appeals. In my opinion, at most, one reasonably sized home may be able to be constructed on
this lot if it is placed as close as possible to the southern lot line. A driveway accessing this lot
could then be constructed outside of the 75' conservation zone negating the need for this
variance request.

It has been brought to my attention that a variance has been requested for two homes and a driveway withal the
Conservation and Non -Disturbance Zones of the Watershed Protection District.
I strongly feel that the variance should be denied based on the fact that the purpose of the Watershed Protection
Bylaws are to protect North Andover's sole source of drinking water, and thus should not be taken lightly.
The fact that the Town has already purchased the Mazurenko Fano, and will hopefully, obtain the Renshaw property
soon, only stresses the importance the Town's people have put on that portion of the watershed in protecting the
lake.
Thus, I would like to state that I am in total agreement with Ms. Colwell's statement. " at most. one reasonably
sized home may be able to be constricted on this lot if it is placed as close as possible to the southern lot line' "A
driveway accessing this lot could be constructed outside of the 75' Conservation Zone negating the need for this
variance request."
It is extremely important that we continue to work together in protecting the lake in every way we can. If you have

RE: Staff Recommendation — Petition: Brown Property @ Bradford Street.
This Department has performed a preliminary review of the above referenced petition which we understand is
before the Zoning Board of Appeals (ZBA) on July 14th, 1998. From what I can infer, the applicant is seeking relief
from setbacks established under the local Watershed Protection ByLaw so that an additional dot may potentially be
developed at some future date. The final decision of the Zoning Board of Appeals specific to this request is
significantly important to this Department and to the Town.
The residents of North Andover passed an initial version of the Watershed Protection ByLaw during the mid
1970's in order to assure a safe drinking water supply for generations to come. The foundation from which this
important set of rules and regulations grew from is the realization that specific setbacks and "buffer zones" are
warranted from sens4ive natural resource areas (including wetlands) and that by limiting overall site disturbance
from development we can in tum better protect Lake Cochichewick The rationale for such buffer zones is not a
new concept and much research has been done on this issue.
Vegetated buffer zones are perhaps the most effective way to control non -point runoff and are a vital link in
protecting wetlands. Upland buffer zones can protect (and enhance) the natural capacity of the wetland system to
mitigate impacts from pollution as the upland has its own pollution attenuation capacity as well. This is an
important factor to consider when assessing the cumulative impacts of residential development on surface water
quality including:
1. Temperature —Shade and cover provided by buffer zone vegetation can moderate water
temperature in small streams.
2. Sediments/Contaminants — Buffer zones filter sediments and other contaminants (e.g. pesticides,
fertilizers) from surface flow and preclude development which could lead to increased contaminant
loading.
3. Nutrients — Buffer zones reduce nutrient inputs into wetlands by filtering sediment bound nutrients
from surface flow and removing nutrients from groundwater via uptake in vegetation.
4. Maintenance of Stream Flow — Buffer zones can store water and help maintain stream base flow
during low flow periods.

With every new home comes a manicured lawn, less trees, the introduction of pool chemicals, fertilizers, pesticides,
and improperly disposed of lawn clippings loaded with phosphorovst I feel confident that, although it is a complex
and relatively new concept to some, the value of upland buffer zones is known. Buffer zones around sensitive
resource areas will prohibit the degradation of wetlands and wetland values that the literature indicates will occur,
and that we are prohibited by the regulations to allow.
Finally, ever burgeoning development in North Andover is continuing to fragment and isolate existing, protected
open space. Mazurenko Farm, which is under the care and custody of the Conservation Commission, directly
abuts the subject parcel and as a legal abutter we feel strongly that inappropriate development will degrade the
wonderful aesthetic values that this land provides. In my professional opinion, the applicant has failed to prove by
a preponderance of credible evidence that the activity proposed will not cause significant harm to any of the values
sought to be protected by the Watershed Protection Bylaw and, as such, I would respectfully request that the
Zoning Board of Appeals deny the request.

Relief is sought to construct a driveway within seventy-five feet from the

Relief is also sought to subdivide the land into two buildable lots with
each home being constructed within 150 feet from the wetlands but at
least 100 feet from the wetlands.

I am requesting relief, as stated above, because prior to the change in
setback requirements of land located within the Watershed District my
land would qualify for two lots. Therefore, I am of the opinion
that this change caused a severe hardship.

Re: Bradford Street — request for a variance
Dear Mr. Sullivan,
I have reviewed the variance request for two homes and a driveway within the Conservation and
Non -Disturbance Zones of the Watershed Protection District and have the following comments.
The lots have not yet been created therefore I question whether this application is appropriately
before the Board as the variances sought do not concern the size, setbacks or frontage for the
lots. At this point in time one 5.6 -acre lot exists.
The Watershed Protection District Bylaw allows the construction of a new permanent structure
within the 150' non -disturbance zone only after a variance has been granted by the Board of
Appeals. In my opinion, at most, one reasonably sized home may be able to be constructed on
this lot if it is placed as close as possible to the southern lot line. A driveway accessing this lot
could then be constructed outside of the 75' conservation zone negating the need for this
variance request.

It has been brought to my attention that a variance has been requested for two homes and a driveway within the
Conservation and Non -Disturbance Zones of the Watershed Protection District.
I strongly feel that the variance should be denied based on the fact that the purpose of the Watershed Protection
Bylaws are to protect North Andover's sole source of drinking water, and thus should not be taken lightly.

The fact that the Town has already, purchased the Mazurenko Faun, and will hopefully, obtain the Renshaw property
soon, only stresses the importance the Town's people have put on that portion of the watershed in protecting the
lake.
Thus, I would like to state that I am in total agreement with Ms. Colwell's statement, " at most, one reasonably
