I am writing to remind you that some of the lots in the Evergreen Estates subdivision require
additional septic testing prior to Building Permit issuance per the decision of the Planning
Board. I have had several applicants come into my office seeking a building permit who were
unaware of these conditions.
The leaching bed must be excavated on lots 4, 5, 19, and 20 before a building permit can be
issued. If the leaching bed has not been excavated, the applicant may choose to place a note on
the deed for the lot stating that the septic system must be installed, inspected and approved by the
Board of Health in accordance with all state and local regulations before construction of the
primary building is begun. This includes the pouring of foundation walls. A certified copy of the
recorded deed must be submitted to the Planning Department and Board of Health.

RE: Request for Reimbursable Septic Design Cages
We are writing to you to express, our dissatisfaction: regarding North Andover health
administrator services and are requesting to be-reimbursed'in the amount of $3,885 for
additional charges incurred due to the administration's improper actions.
History:
In February 1997, I spoke to Sandra Starr regarding -an approved septic system design for Lot 18
in Evergreen Estates Development. She informed me that the "Form U"; i.e; approval for the
septic system would not be granted until either the, bottom of bed inspection is done or as an
alternative the septic system must be installed prior. to building, construction. (See attachment A
- Lett&f om Sandra Starr).
Sandra Starr made the first bottom of bed inspection in March 1997 and determined that.a piece
of ledge located on one shoulder of the bed must first be removed in order for her to approve the
septic as per design dated 1/16/97. The rock was immediately removed as per her request at a
cost $1,217.50. (See attachment B - 7T&C Construction Co., -Invoice). Sandra later revisited the
site and subsequently approved the bottom of bed of the designed septic system in April 1997.
(See attachment C - Form U Verification Form). During this month, Lot 18 was purchased by
Donald & Marlene Wilkes from DECM Essex Inc. subject to conditions outlined in the purchase
and sale agreement; i.e. buildable lot with approved septic system design.
Throughout the next several months the septic system installer made numerous attempts to
complete the septic system installation pending Sandra's approval. Finally in August 1997,
Sandra revisited the site and determined that the original septic system design was inadequate.
Note this design was already approved by Ms. Starr. It was explained to me by my installer that
Ms. Starr wanted the bed to be pivoted and moved away from the ledge that has been previously
excavated.
After numerous discussions between Phil Christiansen and Sandra Starr, a second septic system
design was produced. Phil Christiansen informed me that the redesign was ready and a COD.
payment in the amount of $360.00 must be paid before the prints could be picked up. (See
Attachment D - Bill for Redesign). Because of the septic system installation delays, the bill was

paid and the plans were picked up. After resubmitting the plan to Sandra Star, she later
determined that the second design did not meet her requirements and a complete redesign of the
system was in order.
These actions started to cause both financial and emotional hardship on myself and wife. My
wife made several visits to the doctor for illness and stress caused by the Ms. Starr's actions.
About this time I meet with you and Al Couliard in the North Andover Community Center
building to discuss problems with septic system installations and Ms. Starr's performance.
Additional discussions resulted between Phil Christiansen/Dan O'Connor and Sandra Starr
regarding a third design of the septic system. By this time the house was 90% complete and still
Ms. Starr was not satisfied with any of the designs that she supposedly helped produce.
Finally a third design was presented by Christiansen & Sergi dated 9/26/97. Christiansen
submitted another bill in the amount of $1,107.50 (See Atfachment E). These_plans were
immediately resubmitted to Sandra. Starr by myself. At first she said that the plans weren't what
she .wanted. If it wasn't for the sympathy and help- of one your- assistant's (unnamed.), -the third
plan -wouldn't never have been reviewed by Ms.. Starr in a=timely manner. The -next day I

received a call from Ms. Starr stating she approved these new set of plans. The first approved
septic system design by Sandra Starr consisted of two trenches and was simple to install. The
third design consisted of eight pre -cast concrete chambers and added an additional $1,200 to the
overall cost of the septic system. (See Attachment F - Septic Charges)
In summary we could never image the emotional stress and pain with the dealings of a public
town official, Sandra Starr. Not only did my wife and I endure -pain and suffering, the house
completion was delayed by 2 months, and a financial hardship in the amount of $1,885 was
incurred because of Ms. Starr's actions and abuse of power. These charges are outlined as
follows: -
$1,217.50 - Remove ledge per Ms. Starr
$360.00 - Second septic redesign
$1,107.50 - Third septic redesign
$1,200.00 - Additional septic installation costs; pre -cast chambers
We feel that the town of North Andover should take the responsibility of Ms. Starr's actions and
reduce the financial hardship by reimbursing us the $3,885 incurred beyond the original septic
system design which Sandra Starr approved back in April 1997. Your actions will help restore
our confidence in North Andover's community services,. -

Dear Mr. Wilkes:.
As a followup to our conversation of this morning, I am sending you a �-
copy of the Planning Board decision concerning Evergreen Estates and a table
with the status of all lots in the subdivision.. As you can see from the table, Lot
18 must have the bottom of bed inspection before the "Form Ll" can be signed off
by Health, or as an alternative, the septic system must- be installed prior to any
building construction being done on the lot. As I'explaihed.to you, if the septic
system cannot be installed at this location due to_scillrock conditions, it does not
necessarily mean the lot is unbuildable, it simply means the septic system
cannot be constructed in that exact location.
I also explained to you that Mr. Couillard and I have already spoken about
having the bottom of bed excavated, but no application has as yet been made.

This memo comes in response to your memorandum of December 8, 1997 concerning the
chronology relative to Lot 18 Evergreen Estates.
February 10: Telephone -discussion with, and followup letter to Mr. Wilkes,
March 20: Application by Tim Melvin for permit to excavate the leaching area and issuance of the
permit. (Generally we do not charge for a bed bottom temporary permit and do not
accept checks for this. In this case I was told that the system would be installed shortly
after the approval of the bed bottom so the check was taken and held until the full permit
was issued.)
March 21: 1 inspected the bottom of the bed and noted a small 4' — 5' outcrop of bedrock in the
northwest corner of the excavation. Since the impact on the system appeared to be
minimal, I. approved the bed bottom. I believed that, with the small size of the outcrop,
there was sufficient room to slightly alter the lay of the trenches to avoid the area. None
of the submitted plans indicated that any other deposit of bedrock lay in the general area.
April 2: The Form U was signed.
July 28: The Disposal Works Construction Permit for the full installation was issued to Tim
Melvin.
August 18: I responded to a request from Tim Melvin to re -inspect the bottom of the bed. Since such
a long time had passed with the leaching area open and unprotected (no sand fill), Mr.
Melvin and I had agreed that the bottom should be cleaned out somewhat. Usually this
entails, perhaps, 4 — 6 inches of soil removal and scarification of the bottom soil. The
inspection showed that a great deal more than 6 inches of soil had been removed and that
the bedrock deposit in the northwest corner was significantly larger than originally
thought. The engineer was contacted and asked to develop. anew plan showing the extent
of the bedrock and shifting the leaching lines to avoid the area. I was told that an area of
bedrock had been found to the rear of the system during the original testing, possibly
limiting the area available for leaching trenches. I asked why no bedrock outcrop was
ever shown on any of the submitted plans. This is usually done.
September 3: A new plan was submitted for Board of Health review, showing an 8' by 4' outcrop of
bedrock in the far northwest corner.
September 17: I measured the outcrop of exposed bedrock and found that it measured roughly 11' by
17', thereby significantly impacting the leaching area. Spoke to Dan O'Connell of
Christiansen & Sergi about the discrepancy in actual and represented size, and he stated
that he had not been to the site to evaluate the problem and the extent of the outcrop.

September 26: Another plan, depicting a chamber leaching system, was submitted for review. After
discussions with the engineer to appeal for a trench system (no possibility in the area
available for leaching) and to work out some technical difficulties, the plan was approved
on October 1, 1997.
Once the plan was approved the system was installed, approved and given a Certificate of
compliance.
I hope this answers any questions that have arisen or that may come up in the future. If you have any
questions, please let me know.

Dear Ms. Starr.
Regarding our conservation on Friday Sept. 26, 1997, 1 had an opportunity to
review the soil conditions for the proposed septic system location at the above
referenced site.
Itis in my opinion that there is not enough naturally occurring material below and
surrounding the proposed system to be considered adequate to properly treat the
Wastewater disposal.
The material consisted of sharp angular stone and weathered rock with fractures.
The rock did not have any particles stuck to the face of the stone as if were surrounded
by natural material but gave the appearance of having been blasted and left in place. If
the blasting condition were true, there would be a direct fracture to the ground water that
the untreated wastewater could travel.
It is my opinion that there should not be a soil absorption system constructed in
the area that I had reviewed.

RE: Lot 12 Evergreen Est.
On September 15, 1997, at the request of Al Couillard, the bed
bottom on Lot# 12 Beaver Brook Road was inspected. The purpose -of the
inspection was to determine if a septic system could be installed con-
forming to the requirements of Title 5 ( ie. 4' of permeable soil
below the system ).
A part of the excavation had exposed ledge on the south side.
The septic system was redesigned from a trench system to a leach chamber
system reducing the size of the bottom area. It appears that the re-
confiquration of the soil absorption system utilizes that area in the
excavation where soil exists rather than the exposed ledge.
In addition, the Soil Profile from a Plan of Christiansen & Sergi
titled Septic System Design, Lot 1112 Evergreen Estates, dated Rev 7/22/97
shows that .the chamber system is to be installed at existing grade
with approximately 4' of sand replacing the existing A & Bw horizons.

RE: Request for Reimbursable Septic Design Charges
We are writing to you to express our dissatisfaction regarding North Andover health
administrator services and are requesting to be reimbursed in the amount of $3,885 for
additional charges incurred due to the administration's improper actions.
History:
In February 1997, I spoke to Sandra Starr regarding an approved septic system design for Lot 18
in Evergreen Estates Development. She informed me that the "Form U"; i.e; approval for the
septic system would not be granted until either the bottom of bed inspection is done or as an
alternative the septic system must be installed prior to building construction. (See attachment A
- Letter from Sandra Starr).
Sandra Starr made the first bottom of bed inspection in March 1997 and determined that a piece
of ledge located on one shoulder of the bed must first be removed in order for her to approve the
septic as per design dated 1/16/97. The rock was immediately removed as per her request at a
cost $1,217.50. (See attachment B - JT&C Construction Co., Invoice). Sandra later revisited the
site and subsequently approved the bottom of bed of the designed septic system in April 1997.
(See attachment C - Form U Verification Form). During this month, Lot 18 was purchased by
Donald & Marlene Wilkes from DECM Essex Inc. subject to conditions outlined in the purchase
and sale agreement; i.e. buildable lot with approved septic system design.
Throughout the next several months the septic system installer made numerous attempts to
complete the septic system installation pending Sandra's approval. Finally in August 1997,
Sandra revisited the site and determined that the original septic system design was inadequate.
Note this design was already approved by Ms. Starr. It was explained to me by my installer that
Ms. Starr wanted the bed to be pivoted and moved away from the ledge that has been previously
excavated.
After numerous discussions between Phil Christiansen and Sandra Starr, a second septic system
design was produced. Phil Christiansen informed me that the redesign was ready and a COD
payment in the amount of $360.00 must be paid before the prints could be picked up. (See
Attachment D - Bill for Redesign). Because of the septic system installation delays, the bill was

paid and the plans were picked up. After resubmitting the plan to Sandra Star, she later
determined that the second design did not meet her requirements and a complete redesign of the
system was in order.
These actions started to cause both financial and emotional hardship on myself and wife. My
wife made several visits to the doctor for illness and stress caused by the Ms. Starr's actions.
About this time I meet with you and Al Couliard in the North Andover Community Center
building to discuss problems with septic system installations and Ms. Starr's performance.
Additional discussions resulted between Phil Christiansen/Dan O'Connor and Sandra Starr
regarding a third design of the septic system. By this time the house was 90% complete and still
Ms. Starr was not satisfied with any of the designs that she supposedly helped produce.
Finally a third design was presented by Christiansen & Sergi dated 9/26/97. Christiansen
submitted another bill in the amount of $1,107.50 (See Attachment E). These plans were
immediately resubmitted to Sandra Starr by myself. At first she said that the plans weren't what
she wanted. If it wasn't for the sympathy and help of one your assistant's (unnamed), the third
plan wouldn't never have been reviewed by Ms. Starr in a timely manner. The next day I
received a call from Ms. Starr stating she approved these new set of plans. The first approved
septic system design by Sandra Starr consisted of two trenches and was simple to install. The
third design consisted of eight pre -cast concrete chambers and added an additional $1,200 to the
overall cost of the septic system. (See Attachment F - Septic Charges)
In summary we could never image the emotional stress and pain with the dealings of a public
town official, Sandra Starr. Not only did my wife and I endure pain and suffering, the house
completion was delayed by 2 months, and a financial hardship in the amount of $3,885 was
incurred because of Ms. Starr's actions and abuse of power. These charges are outlined as
follows:
$1,217.50 - Remove ledge per Ms. Starr
$360.00 - Second septic redesign
$1,107.50 - Third septic redesign
$1,200.00 - Additional septic installation costs; pre -cast chambers
We feel that the town of North Andover should take the responsibility of Ms. Stan's actions and
reduce the financial hardship by reimbursing us the $3,885 incurred beyond the original septic
system design which Sandra Starr approved back in April 1997. Your actions will help restore
our confidence in North Andover's community services.

As a followup to our conversation of this morning, I am sending you a
copy of the Planning Board decision concerning Evergreen Estates and a table
with the status of all lots in the subdivision. As you can see from the table, Lot
18 must have the bottom of bed inspection before the "Form Ll" can be signed off
by Health, or as an alternative, the septic system must be installed prior to any
building construction being done on the lot. As I explained to you, if the septic
system cannot be installed at this location due to soil/rock conditions, it does not
necessarily mean the lot is unbuildable, it simply means the septic system
cannot be constructed in that exact location.
I also explained to you that Mr. Couillard and I have already spoken about
having the bottom of bed excavated, but no application has as yet been made.

This letter is in reference to your letter of December 4, 1997 regarding the
development of Lot 18 and the issues of septic -system installation.-- I have
attached. a chronology of events leading to the design changes required by the
Health Department.
Three items are of particular issue: 1. Through no fault of the Health Department
the "bottom of bed" laid open and exposed from March 21 to August 18. The
developer had the opportunity to proceed during this time with the installation.
While the timeline was affected by redesign, several months delay can be
attributed to the developers lack of action. 2. As a result of the open bed the
bed required excavation again. 3. Upon the subsequent excavation, additional
ledge was found which changed the condition under which the original septic
design was developed. The -original approval for the system was based on
conditions seen at the time of the plan development. The exposure of additional
ledge changed those conditions and precipitated further design.
The obligation of the Town is to follow the regulations and protect the public
health. The failure of the Health Department to request the removal of ledge and
require a system that met Title V would have been an oversight that would have
caused greater problems to you and the Town. As a case in point, a system
designed off Berry Street is now in litigation with the Town because the property
owner claims that the Town allowed a system to be improperly constructed and
constructed on the wrong property, this system was approved prior to Ms. Starr's
working for the Town. The Town's culpability is greater when the staff fails to
enforce the regulations allowing ineffective systems to be constructed. During
Ms. Starr's tenure the Town has not had a septic system failure for any system
that she has reviewed.

You should be discussing the cost overruns with your developer. The fact that
ledge was on your site and it required removal for installation of the system is
not a factor that was caused by the Health Department. The fact that the bed lay
open from March to August is not the fault of the Health Department. A greater
percentage of lots in your area are faced with ledge. In fact, the engineer at one
point, failed to properly indicate the full_extent of the ledge which required
additional plans. An omission on the plan is not the fault of the Town. Ms. Starr
then confirmed the error by an onsite measurement. —
At our prior meeting, another lot owner was presentand was concerned with the
design issue facing his lot. As a means to mitigate—a dispute over design,. the
Health Department offered to have a staff person from.the-State Department of
Environmental Protection determine --the appropriate course of action. The
Developer opted to not request the DEP secondary review. The system -resulted
in the chamber system_design to mitigate the problems created by-severe_soil
conditions. This is the same system type that.was designed for your Ioty Itis _
clear by other excavations in the area of the -Evergreen Subdivision that ledge is
a problem.
The Town has no reason to request inordinate design.and construction. -The
primary reasons for the construction methods..is the proper construction -for _
protection of public health. The Town cannot anticipate the subsurface
conditions and, as a result of those unforeseen conditions, the plans required a
change.
In short, I apologize for the issues that you faced in developing your lot.
However, those conditions and the resulting design change_ s are not the
responsibility of the.Town.

This memo comes in response to your memorandum of December 8, 1997 concerning the
chronology relative to Lot 18 Evergreen Estates,
February 10: Telephone discussion with, and followup letter to Mr. Wilkes.
March 20: Application by Tim Melvin for permit to excavate the leaching area and issuance of the
permit. (Generally we do not charge for a bed bottom temporary permit and do not
accept checks for this. In this case I was told that the system would be installed shortly
after the approval of the bed bottom so the check was taken and held until the full permit
was issued.)
March 21: I inspected the bottom of the bed and noted a small 4' — 5' outcrop of bedrock in the
northwest corner of the excavation. Since the impact on the system appeared to be
minimal, I approved the bed bottom. I believed that, with the small size of the outcrop,
there was sufficient room to slightly alter the lay of the trenches to avoid the area. None
of the submitted plans indicated that any other deposit of bedrock lay in the general area.
April 2: The Form U was signed.
July 28: The Disposal Works Construction Permit for the full installation was issued to Tim
Melvin.
August 18: I responded to a request from Tim Melvin to re -inspect the bottom of the bed. Since such
a long time had passed with the leaching area open and unprotected (no sand fill), Mr.
Melvin and I had agreed that the bottom should be cleaned out somewhat. Usually this
entails, perhaps, 4 — 6 inches of soil removal and scarification of the bottom soil. The
inspection showed that a great deal more than 6 inches of soil had been removed and that
the bedrock deposit in the northwest corner was significantly larger than originally
thought. The engineer was contacted and asked to develop a new plan showing the extent
of the bedrock and shifting the leaching lines to avoid the area. I was told that an area of
bedrock had been found to the rear of the system during the original testing, possibly
limiting the area available for leaching trenches. I asked why no bedrock outcrop was
ever shown on any of the submitted plans. This is usually done.
September 3: A new plan was submitted for Board of Health review, showing an 8' by 4' outcrop of
bedrock in the far northwest corner.
September 17: I measured the outcrop of exposed bedrock and found that it measured roughly I F by
17', thereby significantly impacting the leaching area. Spoke to Dan O'Connell of
Christiansen & Sergi about the discrepancy in actual and represented size, and he stated
that he had not been to the site to evaluate the problem and the extent of the outcrop.

September 26: Another plan, depicting a chamber leaching system, was submitted for review. After
discussions with the engineer to appeal for a trench system (no possibility in the area
available for leaching) and to work out some technical difficulties, the plan was approved
on October 1, 1997.
Once the plan was approved the system was installed, approved and given a Certificate of
compliance.

Dear Sandy,
Section 15.253(5) of Title 5 defines two or more chambers or galleries connected
together as a chamber or gallery system. The separation distance specified in 15.2530)(c)
shall be applied to adjacent chamber or gallery systems as a unit rather than to the
individually connected chambers or galleries", The systems we have designed for lots 12
and lg of the Evergreen Estates Subdivision are chamber systems and the separation
distance should be applied from the exterior of the system and not individually between
the system components.
The proposed system on both lots 12 and 18 are chamber systems that are
comprised of many individual chambers that act together to form a single system. The
sewage is distributed evenly to all of the chambers. Only the exterior side walls of the
system are used for leaching and because of that the separation distance should only be
applied from the exterior was of the total system.

Dear Mr. Wilkes:
As a followup to our conversation of this morning, I am sending you a
copy of the Planning Board decision concerning Evergreen Estates and a table
with the status of all lots in the subdivision. As you can see from the table, Lot
18 must have the bottom of bed inspection before the "Form Ll" can be signed off
by Health, or as an alternative, the septic system must be installed prior to any
building construction being done on the lot. As I explained to you, if the septic
system cannot be installed at this location due to soil/rock conditions, it does not
necessarily mean the lot is unbuildable, it simply means the septic system
cannot be constructed in that exact location.
I also explained to you that Mr. Couillard and I have already spoken about
having the bottom of bed excavated, but no application has as yet been made.

Thank you for your January 13, 1997 comments regarding the Septic System Design for the
above referenced lot. I have the following responses to your reasons for disapproval.
1. The proposed grading has been revised to indicate less than 36 inches of cover over the
septic tank and D -Box. A note has been added to the profile specifying that the finish grade is
to be no more than 36 inches above the top of the septic tank and D -Box.
2. The required benchmark has been added to the plan.
3. The required note has been added to the profile of the septic system.
Enclosed are 3 copies of the revised Septic System Design for Lot 18. Please contact me if you
have any other comments regarding this design.
