The Board of Appeals held a public hearing on September 12, 1989 upon the
application of Karen Cirrone requesting a Special Permit from the require-
ments of Section 4, Paragraph 4.121(6b) of the Zoning Bylaw so as to per-
mit keeping one horse on a two(2) acre parcel of land on the premises located
at 7 Liberty Street. The following members were present and voting: Frank
Serio, Jr., Chairman, William Sullivan, Vice-chairman, Augustine Nickerson,
Clerk, Walter Soule, Raymond Vivenzio.
The hearing was advertised in the North Andover Citizen on August 24, 1989
and August 31, 1989 and all abutters were notified by regular mail.
Upon a motion made by Mr. Nickerson and seconded by Mr. Vivenzio, the Board
voted, unanimously, to DENY the Special Permit as requested because the petitioner
does not have the required three (3) acres required to keep a horse, and the
Board finds that there is no hardship under Section 10.4 of the Bylaw. The
petition, while designated -as a request for a Special Permit, seeks a variance
from the three (3) acre requirement. In addition, in keeping with prior
decisions of the Board,'it is noted that variance requests from the three (3)
acre for the keeping of horses have been consistently denied, inclusing those
from owners of much larger parcels.

As a result of a complaint, an inspection of your property on
January 12, 1990 indicated that you are in violation of the North
Andover Zoning Board of Appeals Decision on Petition #75-89 which
"DENIED" the Special Permit to keep a horse under Section 10.4 of
the By -Law. Attached is a copy of same.
The construction of the horse shed and fence without a Building
