The inspection revealed a large area containing old automobile parts, used batteries, plastic bags and buildings debris. This is in violation of 105 CMR 410.602(A) "Land. The owner of any parcel of land, vacant or otherwise, shall be responsible for maintaining such parcel of land in a clean and sanitary condition and free from garbage, rubbish or other refuse. ..." In addition, according to M.G.L. Chapter 111, Section 150A "No place in any city or town shall be established or maintained or operated by any person, including any political subdivision or agency of the commonwealth, as a site for a facility, unless such place has either been assigned by the board of health...". "Facility" means ... a dumping ground for refuse; and "refuse" means all solid or liquid waste materials... . You are hereby ordered to cease and desist forthwith from dumping on the property and begin attempts to remove the accumulated refuse within 30 days from the receipt of this letter. You have the right to a hearing before the Board of Health if you feel this order should be withdrawn or modified. To obtain a hearing, you must file a written request with this office within seven (7) days of receipt of this letter. If you have any questions, please do not hesitate to call.
