The work shall conform to what was outlined in a letter dated April 26, 2000 (attached) by Adam Scott, P.E. Prior to construction, the Department of Public Works shall install erosion control around the outlet pipe consisting of trenched silt fence and double staked haybales and a pre -construction inspection shall be performed by the Conservation Department prior to any work. The DPW shall have on site at all times a qualified wetland biologist to act as the Environmental Monitor (EM) during the entire re -construction of the headwall, removal of debris and stabilization measures. The EM shall terminate the work at his/her discretion should there be any threat to the resource area and contact Richelle Martin, Conservation Administrator immediately at 688-9530. B. Massachusetts General Laws Chapter 131, Section 40 provides: "Whoever violates any provision of this section (a) shall be punished by a fine of not more than twenty-five thousand dollars or by imprisonment for not more than two years, or both, such fine and imprisonment; or (b) shall be subject to a civil penalty not to exceed twenty-five thousand dollars for each violation". Each day or portion thereof of continuing violation shall constitute a separate offense. D. In order to construct the sewer, we had to obtain a temporary construction easement from the Owner. In return for granting the easement, the Owner asked that the area around the drainage outlet be improved. The area around the drain has become filled with brush and rubbish and is a public eyesore. First we propose to repoint the crumbling headwall, which is necessary to stabilize the area for the long term. Then we propose to remove the brush and rubbish above the outlet. Finally, we propose to restore and stabilize the slope using biodegradable erosion control blankets. Since this work is within the buffer zone, we request an amendment to the emergency work order. We met with your Conservation Agent, Brian Lagrasse to discuss the improvements to the drainage area. Based on his recommendations, we have limited our proposed work to only the area directly above the drainage outlet. I have enclosed eight (8) copies of documents to support this amendment to the Order of Conditions. The documents include: 1) Construction Plan — Showing the limit and scope of proposed work. 2) A description of the proposed erosion control fabric. 3) A photograph of the area. It has uniform color and consistent thickness, and the fibers are evenly dis- tributed over the entire blanket.
