The Board of Appeals held a regular meeting on Tuesday evening, July 13, 1999 upon the application of Chris
Jenkins, 73-75 Davis Street, North Andover, requesting a Variance from the requirements of Section 7, P7.3 for
relief of front setback, and rear setback, of Table 2,and for a Special Permit from Section 9, P9.2 to allow
construction of a deck & to allow construction of a new roof on the existing garages within the R-4 Zoning District.
The following members were present: William J. Sullivan, Robert Ford, John Pallone and Scott Karpinski.
The hearing was advertised in the Lawrence Tribune on 5125199 & 6/1/99 and all abutters were notified by regular
mail.
Upon a motion made by Robert Ford and 2"d by John Pallone, the Board voted to GRANT a dimensional Variance
from the requirements of Section 7, P7.3 to allow relief of a front setback from the house of 13.4', and dimensional
relief of a rear setback from the garages of 23.5' and to GRANT a Special Permit from the requirements of Section
9, P9.2 to allow construction of a deck 10'X31' as shown on the "Plan of Land" by: Bradford Engineering, Co., James
W. Bougioukas, R.L.S., #9529, dated 4114/99, with the following conditions:
1. The Plan of Land be revised to show parking only within the garage for six (6) cars to satisfy the bylaw for a
three family house.
2. That the garage and former bam be only a one story structure for its total dimensional length.
3. That the reconstruction of the garage be only within the current existing footprint.
4. The reconstructed garage be used exclusively for residential purposes and exclusively for residents of the
associated three family home.
5. That a Massachusetts, registered, structural engineer's report be submitted to verify the integrity of the
existing structure.
6. That if the existing structure is not suitable for rehabilitation, that the 23.5' rear lot line variance will become
void.
7. If the petitioner fails to comply with.the request to revise the "Plan" within twelve (12) days, therefore, this
decison will become "null and void".

10.4 Variances and Appeals The Zoning Board of Appeals shall have power upon appeal to grant variances from the terms
of this Zoning Bylaw where the Board finds that owing to circumstances relating to soil conditions, shape, or typography of the land
or structure and especially affecting such land or structures but not affecting generally the zoning district in general, a literal
enforcement of the provisions of this Bylaw will involve substantial hardship, financial or otherwise, to the petitioner or applicant,
and that desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially
derogating from the intent or purpose of this Bylaw.
SPECIAL PERMIT
The Board finds that the applicant has satisfied the provision of Section 9, paragraph 9.2 of the Zoning Bylaw and that such
change, extension or alteration shall not b e substantially more detrimental than the existing non -conforming structure to the
neighborhood.
Note: The granting of the Variance and/or Special Permit as requested by the applicant does not necessarily ensure
the granting of a Building Permit as the applicant must abide by all applicable local, state and federal and building
codes and regulations, prior to the issuance of a building permit as requested by the Building Commission.

To all it may concern,
Please be advised that upon review of the paperwork for the above referenced property and the
case before you, the following are concems of this department:
1) As you may be aware, if a variance or special permit is not acted upon within a one or two-
year time respectfully the variance or special permit is lapsed.
2) The proposed additional parking area for six vehicles is not required. If the garage is to be
reconstructed as a six bay garage this will satisfy six covered spaces and six additional
spaces in front of the garage will satisfy zoning requirements for a three family home. The
garage will be limited to residential use only.
3) As previously stated to Mr. Jenkins once he has gone through the legal process (ZBA) and
when he comes in for his permit I will require a structural engineers report and associated
drawings in order to issue the building permit.
4) Once a building permit has been issued and due to the prior safety issues I will require that
the garage reconstruction proceed immediately and be completed within 60 days.

Dear William:
I am writing this letter to address concerns brought up by the Zoning board at the June 15`k'
hearing:
1. The decision rendered by the zoning board from November 1996 had not yet been recorded:
This was a small administrative oversight between the previous owner and the town clerks. I
had the documents recorded at the registry June 28`h,
2. The parking as it is now is not as shown on the plans presented to the board in 1996:
I remember seeing this on the plans and mentioned it to the sellers attorney. He stated that
the location of the parking was arbitrary. The six spaces shown were a requirement to
receive approval of a special permit for use of the dwelling as a three family home. The
parking for this home has always been in the back yard and will always be there. The
neighbors that would have been affected by our locating the parking in the side yard are
grateful that the parking has remained out back where it has always been. As a courtesy to
our abutters and as requested by the zoning board in 1996, we have installed a fence along
the back of the property where the cars park.
I Concerns regarding the structural integrity of the building:
The wooden portion of the garages has been removed over the last two yetirs. As I stated, I
have been working with a structural engineer. The garages will be more than adequate to
support a new roof. If I, or my structural engineer, did not feel comfortable with the integrity
of this building, I would have negotiated it into the purchase price of the home and torn them
down myself. In addition, I have also had conversations with my abutters. They do not have
concerns with me replacing the roof on the building. I have attached a sample of a one
sentence letter that my abutters have signed, which reinforces what I have just stated
