"HUD", who is overseeing the funding of this project, is also requiring this work to be done prior to the completion of the project. I would request leniency, however, on the 30 day notice you have given us to remove the rotted wooden portion of the barn. We do intend to start work on the barn soon. I have been prioritizing and doing some of the prep work before the contractors work begins. Our focus, once we start work, is to prepare the tenants side first so we can rent it out and reduce the burden of carrying the whole mortgage. Our urgency to move in is secondary. However, we are hoping to move in by March or April. We are hoping to rent out the tenants side by March, but we will see how the project progresses. We are very happy to have purchased this property. It is a nice piece of property in a nice neighborhood. When the project is complete, I am sure the house will enhance the neighborhood and the town much more than it has in the recent years. I have hired some good contractors to assist in the rehab of this property and want to work with you to its completion. We did receive your registered mail yesterday. Bob, It is not necessary to send us correspondence via registered mail. I intend to bring this house up to code and have a nice home to raise my kids in. I have already met some of my neighbors and they are very excited that someone is finally going to fix up this house. Bohne Date. 11/26/96 73-75 Davis Street Petition# : 033-96 North Andover, MA 01845 Date of Hearing:11/12/96 The Board of Appeals held a regular meeting on Tuesday evening October 8, 1996 and decision rendered on November 12, 1996 upon the application of George Bohne requesting a Special Permit of Section 4, Paragraph 1.22 (14) and Table 2 of the zoning By Law so as to permit a four (4) family dwelling in Zoning district R-4 by converting a two family dwelling. The following members were present and voting: William Sullivan, John Pallone and Joseph Faris and Ellen McIntyre. The hearing was advertised in the North Andover Citizen on 9/24 & 10/1 1996 all abutter were notified by regular mail. Upon a motion by John Pallone and seconded by Ellen McIntyre the Board of Appeals unanimously voted to GRANT the Special Permit for a legal three (3) family dwelling with the following conditions. 1) Provision for sufficient parking for 6 cars. 2) Establish stockade fencing on the left providing the neighbor screening from the car lights. 3) Providing before and after plans showing conversion from a four (4) to three (3) family dwelling. Voting members were William Sullivan, John Pallone, Joseph Faris and Ellen McIntyre. The vote was unanimous. The Board finds that the applicant has satisfied the provisions of Section 9, para. 9.2 of the Zoning Bylaw and that such change, extension or alteration shall not be substantially more detrimental than the existing non -conforming structure to the neighborhood. Note: The granting of the Variance and/or special Permit as requested by the applicant does not necessarily ensure the granting of a Building permit as the applicant must abide by all applicable local, state and federal building codes and regulations, prior to the issuance of a building permit as required by the Building commissioner. "HUD", who is overseeing the funding of this project, is also requiring this work to be done prior to the completion of the project. I would request leniency, however, on the 30 day notice you have given us to remove the rotted wooden portion of the barn. we do intend'to start work on the barn soon. I have been prioritizing and doing some of the prep work before the contractors work begins. Our focus, once we start work, is to prepare the tenants side first so we can rent it out and reduce the burden of carrying, the whole mortgage. Our urgency to move in is secondary. However, we are hoping to move in by March or April. We are hoping to rent out the tenants side by March, but we will see how the project progresses. We are very happy to have purchased this property. It is a nice piece of property in a nice neighborhood. When the project is complete, I am sure the house will enhance the neighborhood and the town much more than it has in the recent years. Bohne, Jr. Allow me to confirm our conversation of Thursday October 24, 1996 wherein I informed you that the sole asset of the aforementioned estate is a home located at 73-75 Davis Street, North Andover, MA. I also informed you that the estate had entered into a purchase and sale agreement with Mr. & Mrs. Chris Jenkins which required the seller, as a pre -condition of the sale, to obtain approval from the North Andover Zoning Board of Appeals of a legal three (3) or four (4) family use. Accordingly, the estate had plot plans drawn and on or about August 30, 1996 applied for a special permit for the purpose of having the pre-existing use approved (as you may be aware this structure had been used as a three family dwelling from 1953 to 1971 and as a four family dwelling from 1971 to sometime in 1994 unfortunately, neither George H. Bohne Sr., who passed away January 1978, nor Elizabeth Bohne sought the approval of the zoning board of appeals). On or about October 8, 1996 I appeared before the North Andover Zoning Board of Appeals to address the board's concerns relative to the estate's application for a special permit. None of the abutters who appeared at the hearing complained of the condition of the structures, although the buyer volunteered that it was his intention to repair both the main structure and the garages. In response to this information Mr. Sullivan requested an assurance that there would not be an expansion of the garage. Both the estate and Mr. Jenkins agreed to accept conditions to this effect. In addition. Mr. Jenkins stated that it was intention to D. Robert Nicetta Building Commissioner Town of North Andover October 25, 1996 Page 2 remove any safety hazard that the garage/barn posed. The purchase and sale agreement called for an October 1, 1996 closing which was extended by agreement of the parties to October 15, 1996 and again to October 31, 1996. At the suggestion of the zoning board of appeals the closing was extended again to November 12, 1996 as the zoning board had taken the matter under advisement and it was unknown whether it would render its decision prior to its November 12, 1996 meeting. On or about October 23, 1996 the administrator of the estate received a letter from your office stating that the garages required repair and ordering immediate demolition. As both the estate and the buyer had remained in close communication with the building department, your letter was received with amazement, incredulity and shock. Moreover, the estate believed that it was understood by the Town of North Andover that Mr. Jenkins would make substantial repairs both to the main building and the garage. Your representation to me that Mr. Jenkins had no intention of repairing and rebuilding the garages came as a complete surprise. Accordingly, I spoke with Mr. Jenkins who informed me that he fully intends on "removing the safety hazard" with regard to the wooden structure and rebuild the barn/garage as a one story structure. Certainly, Mr. Jenkins is concerned by a request for demolition that does not provide for an opportunity to rebuild the same. Please advise whether the Town of North Andover objects to the rebuilding of the barn/garage, and if so, on what basis it makes its objection. As the sale of the property is scheduled for November 12, 1996 when it is hoped that the Zoning Board of Appeals will issue a favorable decision, the estate requests that you reconsider your aforementioned letter. In light of your safety concerns the estate proposes cordoning off the garage and barn area. As the barn and garage survived the most recent storm, the estate does not believe that there is much risk of any hazard between today's date and November 12, 1996. Moreover, I am informed that the barn and garages are empty, thereby making a cordoning off of the area appropriate. Please be informed that the estate does not deny that the wooden portion of the barn and garage is in disrepair and requires repair. In choosing a buyer for the property the estate was careful in selecting a party who would not seek to develop the rear parcel and who would repair the existing structures given the character of the existing neighborhood. This of course is the entire purpose behind selling the property to Mr. & Mrs. D. Robert Nicetta Building Commissioner Town of North Andover October 25, 1996 Page 3 Jenkins! In our conversation of October 24, 1996 I specifically asked you whether your letter ordering removal of the barn/garage structure was related to the application of the special permit. You responded " No. This is a safety issue." I interpret your response to mean that removal of the barn/garage structure is not a condition of obtaining a special permit. In addition I asked you what if anything could the estate do short of tearing down the structure to comply with your safety concerns - such as cordoning off the structure. You responded "send me letter with your suggestions." I interpret you response to mean that you were willing to consider reasonable alternatives to the safety issue that would not require the estate to tear down the structure immediately. I asked you whether you would take any action at the present time to change or enforce the contents of your letter. You answered "No. Send me a letter." I interpret your response to mean that you neither intended to change the terms of your letter or to enforce the same until such time as you had a reasonable opportunity to view the contents of a letter you were requesting from this office. It is my understanding from our conversation of October 24, 1996 that you would be willing to reconsider your position in this matter upon receipt of a letter from this office. Please accept this letter as just such a letter. It is also my understanding that you would be willing to consider reasonable alternatives to demolition of the barn\garage structure. Lastly, it is my understanding that no penalties will be assessed against the estate, as the estate has attempted to obtain both an explanation and an extension of the time set out in your letter dated October 21, 1996. If it appears that such structure would be especially urksafe.,L,case of fire, it shall be deemed dangerous within -the :meaning hereof, and the building official may affix in a conspicuous place upon its exterior walls a notice of its dangerous condition, -which shall not be removed or defaced without authority from him., 123.2 Removal or making structure safe: Any person so notified shall be allowed until twelve o'clock noon of the day following the service of the notice in which to begin to remove such building or structure or make it safe, or to make it secure, and he shall employ sufficient_ labor speedily to make it safe or remove it or to make it secure; but if the public safety so requires and if the mayor or selectmen so order, the building official may immediately enter upon the premises with the necessary workmen and assistants and cause such unsafe structure to be made safe or demolished without delay and a proper fence put up for the protection of passersby, or to be made secure. SECTION 124.0 EMERGENCY MEASURES 124.1 +ailurelo remove or make structure safe, survey board, survey report: If an owner of such unsafe structure refuses or neglects to comply with the requirements of such notice within the specified time limit, and such structure is not made safe or taken d,.;w� as wherein, a careful survey of the premises shall be made by a board consisting; in a city, of a city engineer, the head of the fire department, as such term is defined in Section 1 of Chapter 148 of the Massachusetts General ]Laws Annotated, as amended, and one disinterested person to be appointed by the building official; and, in a town, of a surveyor, the head of , the fire department and one disinterested person to be appointed by the building official: In the absence of any of the above officers or individuals, the mayor or selectmen shall designate one or more officers or other suitable persons in place of the officers so named as members of said board. A written report of such survey shall be made, and a copy thereof served on such owner. 124.2 Removal of dangerous or abandoned structures: If such survey report as outlined in Section 124.1 declares such structure to be dangerous or to be unused, uninhabited or abandoned, and open to the weather, and if the owner continues such refusal or neglect, the building official shall cause it to be made safe or taken 700 CMR - Fifth Edition 1-25 THE MASSACHUSETTS STATE BUILDING CODE down or to be made secure; and, if the public safety so requires, said building official may at once enter the structure, the land on which it stands or, the abutting land or buildings, with such assistance as he may require, and secure the same; and may remove and evict, under the pertinent provisions of Chapter 239 of the Massachusetts General Laws Annotated as amended, or otherwise, any tenant or occupant thereof; and may erect such protection for the public by proper fence or otherwise as may be necessary, and for this purpose may close a public highway. In the case of such demolition, the said building official shall cause such lot to be levelled to conform with adjacent grades by a nonorganic fill: The_costs and charges incurred shall constitute a lien upon the land upon which the structure is located, and shall be enforced in an action of contract;=and such owner shall, for every day's continuance of such refusal or neglect after being so notified, be punished by a fine in -accordance with Section 121.4. -T'he provisions of the second paragraph of Section 3A of Chapter 139 of the Massachusetts General Laws Annotated as amended, relative to liens for such debt and the collection of claims for such debt shall apply to any debt referred to in this section, except that the said building official shall act hereunder in place of the mayor or board of selectmen. During the time such order is in effect, it shall be unlawful to use or occupy such structure or any portion thereof for any purpose. 124.3 Remedy of person ordered to remove a dangerous structure or make It safe: -7--An owner, aggrieved by such order may have the remedy prescribed by Section 2 of Chapter 139 of- the Massachusetts General Laws Annotated as amended; provided that -any provision of said Section 2 shall not be construed so -as to hinder, delay or prevent the building official from acting and proceeding under Section 124.2; and=provided, further, that this section shall not prevent the city or town from recovering the forfeiture provided in said Section 124.2 from the date of the service .of the original notice, unless the order is annulled by the jury., 125.0 RESERVED SECTION 126.0 BOARD OF APPEALS 126.1 State Building Code Appealst' Board: Whoever is aggrieved by an interpretation, order, requirement, direction or failure to act under this code by any agency or official of the city, town or region, or agency or official of the State charged, with the administration or enforcement of this code or any of its rules or regulatins, excepting any specialized codes, may appeal directly to the State Building Code Appeals Board as provided in Section 126.0. Whoever is aggrieved by an interpretation, order, requirement, direction or failure to act under this code by any agency or official of a city, town or region charged with the administration or enforcement of this code or any of its rules and 1-26 780 (:MR - Fifth Edition THE MASSACHUSETTS STATE BUILDING CODE the building official may institute the appropriate proceedings at law or in equity in a court of competent jurisdiction to restrain, correct or abate such violation or to require the removal or termination. of the unlawful use of the building or structure in violation of the provisions of this code or of the order or direction made pursuant thereto. 121.4 Violation penalties: Anyone who shall violate a provision of this code shall be punishable by a fine of not more than one thousand dollars ($1,000) or by imprisonment for not more than one year, or both, for each violation. Each day during which any portion of a violation continues shall constitute a separate offense. 121.5 Abatement of violation: The imposition of the penalties herein prescribed shall not preclude the building official from instituting appropriate action to prevent unlawful construction or to restrain, correct or abate a violation, or to prevent illegal occupancy of a building, structure or premises or to stop an illegal act, conduct, business or use of a building or structure in or about any premises. SECTION 122.0 STOP -WORK ORDER 122.1 Notice to owner; Upon notice from the building official that any work is being prosecuted contrary to the provisions of this code or in an unsafe or dangerous manner, such work shall., be. immediately stopped. The stop -work order shall be in writing and shall be served on the owner or on the person doing the work, and shall state the conditions under which work maybe resumed; provided, however, that in instances where immediate action is deemed necessary for public safety or in the public interest, the building official may require that work be stopped upon verbal order, provided that said verbal order be confirmed in writing within forty-eight (48) hours. 122.1.1 Posting: A stop -work notice shall be posted in a conspicuous place on the job site and can only be removed by the building official. 122.2 Unlawful continuance: Anyone"who shall continue any work in or about the job site after having been served within stop -work order, except such work as he is directed by the building official to perform to remove a violation of unsafe conditions, shall be liable to prosecution as provided in Section 121.0. 1-24 780 CMR - Fifth Edition. ADMINISTRATION AND ENFORCEMENT 120.4 Periodic Inspection for posting: The building official may periodically inspect all existing buildings and structures except one and two family dwellings for compliance with this code in respect to posting; or he may accept the report of such inspections from a qualified registered engineer or architect or others certified by the BBRS; and such inspections and reports shall specify any violation of the requirements of this code in respect to the posting of floor load, fire grading, occupancy load and use group of the building or structure. I viewed the existing conditions on Friday, November 8, 1996 and carefully evaluated both the exterior and interior of the structure. The building is in dire structural condition in that potential collapse of the barn due to heavy snows and wind is quite conceivable. Much of the existing wooden framing is severely deteriorated due to insect infestation and weather deterioration. The interior of the structure is easily accessible, and poses as both an attraction and threat to neighborhood children. I strongly advise that this structure be razed as soon as possible. H. that the roof and supporting sidewalls of the: barn and the roof of the five stall garage at the above location are in an unsafe condition and subject to collapse. He was requested to remove the unsafe portion, but did not. Copy enclosed for your review. Pursuant to Section 124,1 of the Massachusetts Building Code - 780 CMR, I then convened a Boaro car 6urvey made up of the North Andover Fire Chief, a Building Contractor and a Professional Engineer. After review of the building in question, it was the duty of the Board of Survey to submit a report on the integrity of the structure. It is the opinion of the "Board" that the structure is in a state of potential collapse and should be razed immediately. I would request leniency, however, on the 30 day notice you have given us to remove the rotted wooden portion of the barn. We do intend to start work on the barn soon. I have been prioritizing and doing some of the prep work before the contractors work begins. Our focus, once we start work, is to prepare the tenants side first so we can rent it out and reduce the burden of carrying the whole mortgage. Our urgency to move in is secondary. However, we are hoping to move in by March or April. We are hoping to rent out the tenants side by March, but we will see how the project progresses. We are very happy to have purchased this property. It is a nice piece of property in a nice neighborhood. When the project is complete, I am sure the house will enhance the neighborhood and the town much more than it has in the recent years.
