MA Petitioner is requesting a variance from the requirements of Section 6, paragraph 6.61) & 6.6D2, in order to allow a front setback for an existing real estate sign and to allow a front setback for an existing gasoline sign. Petitioner is requesting a Special Permit from the requirements of Section 9, Paragraph 9.1 in order to extend the non -conforming existing signs. The following members were present: Walter F. Soule, Raymond Vivenzio, Robert Ford Scott Karpinski and George Earley. Upon a motion made by Walter F. Soule and tad by Scott Karpinski the Board voted to GRANT a dimensional variance of a front setback for an existing real estate sign of 5.5' on Chickering Road and a dimensional variance of a front setback for an existing gasoline sign of 4.0' on Chickering Road and 7.5' on Dufton Court. The variances are granted on the basis that the petitioner has satisfied the provisions of Section 10, paragraph 10.4 of the Zoning Bylaw and that the granting of these variances will not adversely affect the neighborhood orderogate from the intent and purpose of the Zoning Bylaw. The Board voted to GRANT a Special Permit for the existing real estate sign and existing gasoline sign on the condition that no change be made to the size or location of the sign. However, if necessary a change may be made in the wording of the gasoline sign, however, the sign may only be used for purposes to advertise as a gasoline sign. The Board finds that the applicant has satisfied the provision of Section 9, paragraph 9.1 of the Zoning Bylaw and that such change, extension or alteration shall not be substantially more detrimental than the existing non -conforming use to the neighborhood In accordance with the Plan of Land by: James Curren, P.L.S. #33495, 234 Essex Street, Lawrence, MA, dated 2/23/2000. Furthermore, if the rights authorized by the variance are not exercised within one (1) year of the date of the grant, they shall lapse, and may be re-established only after notice, and a new hearing. Furthermore, if a Special Permit granted under the provisions contained herein shall be deemed to have lapsed after a two (2) year period from the date on which the Special Permit was granted unless substantial use or construction has commenced, they shad lapse and may be re-established only alter notice, and a new hearing. A Professional Engineer must produce a plan for the proposed connection. 2. The plan will be reviewed by this office. Changes to the plan may be necessary. 3. The Conservation Agent must sign the plan. 4. Any work in a town roadway requires a street opening permit. 5. After plan approval, a sewer connection permit can be obtained from this office.
