The Board of Appeals held a regular meeting on Tuesday evening, April 11, 2000 at 7:30 PM upon the
application of Schruender Realty Inc., 73-77 Chickering Road, North Andover. MA Petitioner is
requesting a variance from the requirements of Section 6, paragraph 6.61) & 6.6D2, in order to allow a
front setback for an existing real estate sign and to allow a front setback for an existing gasoline sign.
Petitioner is requesting a Special Permit from the requirements of Section 9, Paragraph 9.1 in order to
extend the non -conforming existing signs.
The following members were present: Walter F. Soule, Raymond Vivenzio, Robert Ford Scott Karpinski
and George Earley.
Upon a motion made by Walter F. Soule and tad by Scott Karpinski the Board voted to GRANT a
dimensional variance of a front setback for an existing real estate sign of 5.5' on Chickering Road and a
dimensional variance of a front setback for an existing gasoline sign of 4.0' on Chickering Road and 7.5'
on Dufton Court. The variances are granted on the basis that the petitioner has satisfied the provisions of
Section 10, paragraph 10.4 of the Zoning Bylaw and that the granting of these variances will not adversely
affect the neighborhood orderogate from the intent and purpose of the Zoning Bylaw. The Board voted to
GRANT a Special Permit for the existing real estate sign and existing gasoline sign on the condition that
no change be made to the size or location of the sign. However, if necessary a change may be made in the
wording of the gasoline sign, however, the sign may only be used for purposes to advertise as a gasoline
sign. The Board finds that the applicant has satisfied the provision of Section 9, paragraph 9.1 of the
Zoning Bylaw and that such change, extension or alteration shall not be substantially more detrimental than
the existing non -conforming use to the neighborhood In accordance with the Plan of Land by: James
Curren, P.L.S. #33495, 234 Essex Street, Lawrence, MA, dated 2/23/2000. Voting in favor: Walter F.
Soule, Raymond Vivenzio, Robert Ford, George Earley and Scott Karpinski.
Furthermore, if the rights authorized by the variance are not exercised within one (1) year of the date of the grant, they shall lapse, and
may be re-established only after notice, and a new hearing. Furthermore, if a Special Permit granted under the provisions contained
herein shall be deemed to have lapsed after a two (2) year period from the date on which the Special Permit was granted unless
substantial use or construction has commenced, they shad lapse and may be re-established only alter notice, and a new hearing.

Notice is hereby given that the Board of Appeals will hold a public hearing at the Senior
Center, 120R Main St., North Andover, MA., on Tuesday the 11'hday of April, 2000 at
7:30 PM to all parties interested in the appeal of Schruender Realty Inc., for premises at:
73-77 Chickering Road, North Andover. Petitioner is requesting a Variance from the
requirements of Section 6, Paragraph 6.61) & 6.6 D2 in order to allow a front setback for
a existing real estate sign and to allow a front setback for an existing gasoline sign.
Petitioner is requesting a Special Permit from the requirements of Section 9, Paragraph
9.1 in order to extend the non -conforming existing signs for face replacement.
Said premises affected is property with frontage on the East side of Chickering Road
within the G -B Zoning District.
Plans are available for review at the office of the Building Dept., 27 Charles Street, North
Andover, MA Monday through Thursday from the hours of 9:00 AM to 1:00 PM.

The sign allows traffic to go behind the building and having it between the
white ball protects it from being hit by cars. The sign has been there
since I built the building in 1980.

Notice is hereby given that the Board of Appeals will hold a public hearing at the Senior
Center, 120R Main St., North Andover, MA., on Tuesday the 11`s day of April, 2000 at
7:30 PM to all parties interested in the appeal of Schruender Realty Inc., for premises at:
73-77 Chickering Road, North Andover. Petitioner is requesting a Variance from the
requirements of Section 6, Paragraph 6.61) & 6.6 D2 in order to allow a front setback for
a existing real estate sign and to allow a front setback for an existing gasoline sign.
Petitioner is requesting a•Special Permit from the requirements of Section 9, Paragraph
9.1 in order to extend the non -conforming existing signs for face replacement.
Said premises affected is property with frontage on the East side of Chickering Road
within the G -B Zoning District.
Plans are available for review at the office of the Building Dept., 27 Charles Street, North
Andover, MA Monday through Thursday from the hours of 9:00 AM to 1:00 PM.

As we discussed, in order to connect 201 Dale Street to town sewer, we require the following.
1. A Professional Engineer must produce a plan for the proposed connection.
2. The plan will be reviewed by this office. Changes to the plan may be necessary.
3. The Conservation Agent must sign the plan.
4. Any work in a town roadway requires a street opening permit.
5. After plan approval, a sewer connection permit can be obtained from this office. The fee for the
permit is $1,000.00
6. A private contractor must be hired for all work.
