I was concerned about fire hazard. He states, "if used, the FRP should be rated if within 36" of the stove top/heat source". It is unfortunate that the stainless steel has been abandoned. As this is a town building, I want it on record that the Health Department highly recommends the use of stainless steel around the stove area. I cannot recommend any product that protects the surface any better or is easer to clean and has the longest durability. This office is aware that both the Fire and Building Departments have approved both FRP and/ or paint and will accept there expertise in this area. Whatever the decision, please let this office know. All wall imperfections must be sealed and made smooth. There should be no pockets or imperfections which would make cleaning difficult. Especially as stoves are difficult pieces of equipment to move. I don't think a simple paint can achieve this outcome, however I do not have any other suggestions of products that can achieve this type of surface. Smooth, easily cleanable, non- porous. All joints with the floor must have a curved coved base. Both said that since we have an electic stove (vs Gas) there are no fire or building code requirements that we need to meet and from their perspective painting the cement bricks or putting up FRP board is fine. From the health departments perspective; please let me know which of these options would be acceptable. Have a good holiday, Kevin NORTH q �tLEO 16 �� O e to * ti 9 PUBLIC HEALTH DEPARTMENT (ommunity Development Division July 7, 2009 Laura Gifford, Director Steven's Estate at Osgood Hill 723 Osgood Street North Andover, MA 01845 Re: Steven's Estate Food Establishment Dear Ms. Gifford, In August of 2007, the North Andover Health Department documented numerous issues of concern relating to the Food Establishment Permit to Operate at the Steven's Estate at Osgood Hill. The violations ranged in levels of risk and the Board of Health allowed a phased schedule of correction. This letter is a follow-up to those events almost two years ago. For reference I have attached a few of the file documents; the February 21, 2008 letter from the Chairman of the Steven's Estate Board of Trustees, the minutes from a Board of Health meeting held on February 28, 2008 and the working document that was initially issued dated August 1, 2007. Since the onset of the problems at the Steven's Estate many improvements and changes have occurred. The management personnel have changed, there is no full time chef on staff, private caterers have been utilizing the kitchen as needed for events, multiple pieces of kitchen equipment have been purchased, a continuous cleaning program has been implemented and numerous structural defects have been addressed. The Health Inspector, Michele Grant, and I have inspected the establishment at various stages of the project and have continued to communicate with you, Board Chairman Kevin Willoe and Division Head Ray Santilli over these many months. The spreadsheet column "date verified" notes the improvements observed and the results are as follows. The Board of Health (BOH) motion made on February 28, 2009, limited use of the old walk-in refrigerator as its wooden interior could no longer meet the minimum standards of the food code. This unit is being maintained in a clean condition and should continue to be utilized for beer storage only. This motion stands as written. Secondly, the BOH's motion in 2009 also had limited the use of the kitchen due to its condition. As for this restriction, the kitchen now meets the minimum standards of the state and federal codes; therefore increased use of the kitchen is allowed. If the current arrangement of using outside caterers is going to be reconsidered by the Estate, we would appreciate that you discuss this with the Health Department prior to doing so. A third item is pest control. The Steven's Estate continues to have a professional integrated pest manager monitor the building for pest infestation. Integrated pest management takes many factors into consideration while trying to prevent infestation; building conditions, exterior entry points, plumbing observation of leaks etc., before making pesticide application recommendations. Taking into consideration the age of the building, we believe it is important to continue monitoring the situation on a minimum of a monthly basis, or more, at the recommendation of the professional. The last item to mention is likely the most important. The food code requires that persons in charge be food safety certified and be able to demonstrate the principles of food safety to the Health Inspectors. The lack of knowledge of staff can directly relate to the proper execution of safe practices. Although past inspections had noted the need for structural repairs, the issues that place the public most at risk back in 2007 was the lack of knowledge by the professional staff. The current staff now meets the standard. Please be advised that if the certified person changes at a later date, the establishment must notify the Health Department with the name of the new person within 30 days. The Health Department acknowledges the cooperation received by the current administration at the Steven's Estate. Going forward, regular inspections will be conducted two times each year to ensure compliance to the food codes. As this is an old building it is expected that additional improvements will be identified and made as needed. Please note that the Health staff is always available for consult. McCarthy stated that if there are concerns, then there are tests that will need to be conducted. Dr. Trowbridge stated that we are looking for a permit to construct and operate, but the permit can be suspended if a nuisance concern arises. This hearing is continued to the March BOH meeting to vote on an ordinance. B. Tobacco Hearing - SJ Enterprises (Sam's Mobil) — 2"a Violation within a two year period. — Cancelled. Ms. Sawyer granted a continuance until March. Sam's Mobil appealed to court to overturn their tobacco violation penalty fee. However, the Board of Health still has jurisdiction over their permit. III APPROVAL OF MINUTES A. The minutes from January will be approved at the March. 27a' meeting. IV OLD BUSINESS A. Update on the TBI Process Per Dr. Trowbridge, the Town is close to putting together contract with TBI. There was some back and forth with Attorney Klavens about creating hardship on TBI. There were certain conditions beyond site assignment. Some imposed beyond. One item that was discussed was about moving into single stream recycling. The contract would supply to all homes in Town and have trucks to pick up that sort of container. That would create more efficiency. Everything would go into one can. That sort of detail was not listed in the site assignment, and it is a financial cost, for which TBI is not willing to go to that extent. We are close to protecting the Town of North Andover and working closely to procuring a site assignment which is being taken care of by Attorney Klavens. It is really a recycling process, but that is where we are. A second revised contract version should be ready by next week. The Board of Health just participated in negotiation. The agreement needs to be finalized by TBI, the Town Manager and the Board of Selectmen. Dr. Trowbridge is confident that it will be a good program. Ms. Sawyer stated that TBI has applied to begin site construction, and the DEP has allowed them to do items that are incidental such as underground construction and retaining walls. Conservation required some pre and post water sampling from monitoring wells and the test results will come next week. They have not gotten approval for an actual facility: The building permit condition is that the light must be approved. The blinking light is in process, but not approved yet. Progress is being made, but we are awaiting further approval. Tentative approval by the state may happen in the fall. The first application was denied, and the state has 180 days to review. V NEW BUSINESS B. Stevens Estate — Modification to the letter dated January 17, 2008 to the Stevens Estate Kevin Willoe presented for the Stevens Estate. He passed out a packet of information to the Board of Health members. Out of the 40 initial issues, 28 have been addressed, and 12 are still open. There was a contractor in today to go through the bidding process. There is painter starting on March 106'. The Estate now has funding of S30k to bring the kitchen up to date. They want to continue to operate as a catering model, with outside caterers coming in. These issues will be done before the summer time, when most of their large functions take place. MacMillan, Jr., M.D., Health Department Staff: Susan Sawyer, Health Director; Debra Rillahan, Public Health Nurse; Michele Grant, Public Health Inspector; Pamela DelleChiaie, Health Department Assistant Ms. Grant viewed the site today. She had concerns about the walk-in refrigeration prior to having a catering company in there. There is nothing scheduled until May, and it is a smaller party, such as a fundraiser. It will be catered. There is no food storage on premises, and no usage of the walk-in. Ms. Sawyer stated that the Estate has eliminated a lot of storage areas not considered to be adequate. The wooden walk-in needs extreme work — it needs to be covered with steel, or pulled out and replaced altogether. There is not enough money set aside right now to fix this large problem. The Stevens Estate is going to cost it out to see what the price will be. Mr. Willoe would like to use the dishwashing area; however; no clean dishes would not be placed on the counter, which was a main area of concern. Mr. Willoe stated that one issue is the hood above the stove. They are waiting to hear feedback from the Fire Department. He expects that all of the other issues will be addressed. The storage walk in needs to be clearly marked to store beer, beverages, etc., but NOT food. Management needs to be clear.on this — no food storage. \ Ware washing area — this dishwasher should be used properly, and the temperature should be upwards of o 180 degrees. _ A lot of the prep work will be done by caterers elsewhere, so that it reduces the risk of using the counters that are not in acceptable condition. There is an area referred to as the "pass through." No food prep should take place in this area at all. Dr. Trowbridge asked how large the walk-in is. It isnot very large. Ms. Grant stated that the Stevens Estate may want to seriously consider taking out the whole thing, and putting in an updated, new one. Mr. Willoe stated that the walk in is cold all the time, as they order products ahead. It is now a matter of getting contractors to get in and complete the work. Ms. Sawyer stated that the Health Department appreciates use of the catering model for now during the work that needs to be done. Painting, sink repairs, etc. will be done soon. The other, larger issues will run into a Town process. Dr. Trowbridge asked if the $1 Ok will take care of the hood and walk in issues. Mr. Willoe stated that he is buying a new stove to update the kitchen. Members of the Board at the Stevens Estate are undertaking the process to help get the work done if there is a lag with the contractor. Ms. Sawyer stated that all of these items were originally to be completed by tomorrow, Friday, February 29", 2008. Motion The Board grants an alleviation of the requirement to have all items corrected by Feb. 291h a"d grants and extension to partial use of the kitchen. The walk in shall be storage for alcohol and beverages only. The dishwashing area is for washing dishes, but not for food preparation or food storage. Also, the Board will reassess the situation in two months to know the status of the walk in, and other items. Mr. Fixler made a motion to approve the kitchen for limited use, and the walk-in for only alcoholic and beverage storage. The ware washing area can only be used as specified by the Health Department. This is a limited model using outside catering companies. Executive Session The Board of Health excused themselves for Executive Session at 9:05 p.m. Regular Session was re -opened at: 9:45 p.m. VI COMMUNICATIONS, ANNOUNCEMENTS, AND DISCUSSION A. Fiscal Year 2009 - Ms. Sawyer reviewed the information with the Board of Health members. Mr. McCarthy asked the members to look at page 95 at an addition error. The error was noted and will be brought to the attention of the accounting department. B. JRM — Mr. Motzkin, the President of JRM was present. Mr. Motzkin is making an appeal to the Board of Health regarding the January meeting. He would like the Board of Health to reverse the decision made at that time. There is a hardship on the customers that they service, and perhaps there could be some type of monthly report submitted so that the Board is able to see how everything is being followed. He would like to have the placards restored and the right to serve their customers in the Town of North Andover. Mr. McCarthy brought up the falsification of placards. He asked if it was a deliberate and willful intent on part of company to defraud the Town of North Andover. Mr. Motzkin stated that the person involved in the deception did not understand the gravity of the situation. Was the attorney representing JRM familiar with the incident of falsifying placards? Mr. Fixler asked about what level of involvement was there by employees, and how high did it go, in order for someone to re-create the Town Seal? Mr. Motzkin wants to let the Board of Health know that in the future, he will be the contact for all issues regarding waste hauling. Mr. Motzkin gave Mr. Peter Gamarche full management authority in the past, and did not review his actions until this incident came up. Mr. Gamache had previously stated that he was at a low level of management, and then it was discovered that he was actually the General Manager. Mr. Motzkin spoke with Ms. Sawyer, and guaranteed her, that what transpired in the past, and that the Town would not have a problem with JRM. Perhaps there could be a probationary period to operate within the guidelines setup. Mr. Fixler noted that at the last meeting, it was stated that 5-8 placards were duplicated. Mr. Motzkin stated that they were destroyed by Gamache so no evidence would be found. Mr. Motzkin has a contract with Wheelabrator that calls for a certain amount of tonnage to be delivered. Without being allowed to go through North Andover, it will be nearly impossible to provide the tonnage required. He would either need additional trucks to accomplish that, or seek alternative sites. That would probably not benefit anybody, and would be a financial hardship for everybody. He proposes a penalty to impose, which would allow JRM to provide the tonnage, and in that period of time to operate in the way that they should. There were originally 10 placards, and they now have 3. JRM had a request for many more than they received. JRM has not provided sufficient documentation to show that additional placards are necessary. If they had something between 3-5 they could still accomplish their goal. During the Health Departments inspection this morning we confirmed that 28 out of the 40 stated issues had been resolved. The remaining (12) issues will be addressed as follows: • We are currently working with a restaurant design company who will be submitting a bit to address the following issues (7) - Replace the floor in the main kitchen area, dish washing area, dry storage area and under the stove. - Replace all drop ceiling tiles with new washable ceiling tiles. - Replace counters in dishwashing area and wait station pass through. - Remove tiered shelf above 3 bay sink. • We have contracted with a paint contractor to paint all of the sprinkler pipes as well as patch and paint the kitchen walls. This work will begin on or about March 10th (2) • The Assistant Town Manger is contacting the fire department to discuss the requirements for the range hood. (1) • We have contracted with a plumbing company to install a slop sink in the broom closet. (1) • We are looking at the options in regards to replacing or relining the walk-in refrigerator. (1) We currently have $20,000 allocated and an additional $10,000 pending reallocation .at May town meeting, to be used to address the issues listed above. We expect a bid from the restaurant design company next week, at which time we will then move forward into the town bid/procurement process. The final paragraph requested that the Health Department advise in regards to structural issues with "actual timelines in terms of days/weeks/months and the actual priority of each item." The following is our correspondence over the past six months. The Health Department originally documented violations to the MA Food Code and the Federal Food Code during a health inspection conducted on August 1, 2007. The seriousness and critical nature of the violations caused this office to order immediate action or face shutting the kitchen down until corrections were made. Most of the immediate critical violations were corrected that month and since that time the Health Department has been communicating and meeting with you in regards to the outstanding violations of this facility. On August 30, your letter stated, "I will work with the Board Member, Ray Santilli and The Stevens Estate staff to more forward in addressing the remaining violations". A month later a letter from the Health Director dated October 10, 2007, noted that Steven's Estate must "identify a date that the board will review the structural issues. Submit a time line for proposed correction of structural issues?" An example of an excel spreadsheet plan of action was provided to you as guidance at that time. Pest End Exterminating will continue to maintain the Estate on a bimonthly basis. Potential foundational entries are being, checked on a routine basis by the Estate's maintenance person. 2) Knowledge and commitment to food safety — The head chef is signed up for a class scheduled for January 24th, 2008. Proof of admission will be forwarded once received. The Estate Director is signed up for the same training. 3) Cleaning Schedule — With the assistance of a new board member, who's expertise is in the restaurant and hospitality industry, a daily, weekly and monthly cleaning schedule is in the process of being created and will be forwarded to your offices immediately upon receipt. As requested, this schedule will be posted in the kitchen facility. 4)Structural issues reviewed by board — Please see closing paragraph below. 5) Identify new and safe locations for storage of catering equipment — The old unused freezer is scheduled for removal on Friday, January 11th. All equipment has been removed. Room is not being used. 6) Repairs — Gas stove leak has been repaired. Below, please find the following comments and recommendations. If not already done so, there are some issues that should take priority. Although steady progress is being made, in addition I would still recommend that an action plan be written to keep tract of the progress. (see attached sample template). In many cases a third part is hired, whose specialty is food safety, which can assist an establishment in bringing up the facility to meet code standards. The hiring of a third party is optional at this time, but if you would like some suggestions we would be happy to provide you a list. The following is a list of priorities as the Health Office views them. 1) Pest Control - Pest End has made recommendations to eliminate entry to the building to the mice. The recommendation was given August e. Their report of August 28, 2007 notes that there has been no action taken to seal the foundation openings, cracks etc. Please continue updating the Health office with progress in this area. 2) Knowledge and commitment to food safety — This is a priority due to the condition of the kitchen in regards to cleanliness as listed in the inspection documentation, as well as to the concern over the ineffective response to the hazardous situation. Upon inspection of this property I found the following problems which are a contributing factor to the high number of rodents in the building. e The basement floor has decayed and. lifted in some areas allowing rodents to gain access. The basement walls have holes in there where the mortar has given way allowing access for rodents. There are openings in the sill area around the foundation allowing access for rodents. My recommendation is to have these points of entry repaired ASAP. The foundation can be pointed using hydraulic cement to prevent entry and the openings along the sill can be stuffed closed using expanding foam. The floor can have the buckled areas filled with cement as well. would also recommend the service to this facility be increased to every other week until this problem is resolved. The walk-through was conducted with George Peters, a trustee of the estate. Conditions that were found are as followed. Old rodent droppings on several of the shelves above the ice machine Rodent droppings on the counter in the dish room. Rodent droppings throughout the basement. Opened contaminated linens in the basement. Floors under all equipment and shelving units throughout the facility have not been vacuumed and cleaned/sanitized thoroughly. Initially, we stated we would be back to see the corrections on Friday, August 3rd. Unfortunately, Friday afternoon no one was at the establishment to allow entry. Since Friday, we have attempted to contact you on various occasions, but have been unsuccessful until reaching you by cell phone today in response to an email forwarded to us by Ray Santilli. This afternoon, a request was made by the Health Department to allow a reinspection and it was denied due to your unavailability, as you were to attend to a personal matter. A second request was then made to inspect the premises tomorrow, Thursday, August 9th. It too was denied, but for reasons unknown. At that time, the inspector offered to be flexible and asked if anyone else could handle this for you. I believe you noted that no one could be there. You requested of the inspector that we wait until Friday. The inspection we are trying to conduct is for 2 items. To confirm that the areas with rodent droppings have been cleaned up and that the clutter of boxes, returnable bottles etc, have been removed so that further insect and rodent problems could be avoided. We are already aware that Pest End has been contracted which successfully completes the third item. These items were required to be addressed before last weekends events, therefore we assume the inspection will be a short one. Now we are close to the next event scheduled. We believe that Friday is one day before your next event. This office needs to verify that conditions are safe for the public before this event. As this is a conference/event facility it is not running on a daily basis and is not in operation each day. For this reason, and due to your varied hours, this office is leaving the reinspection request and permit to operate in your hands. The seriousness of the violations, if not corrected, warrant a suspension of your permit. In actuality, be advised that the act of denying entry could in itself can lead to suspension. The permit to operate a food establishment requires an operator to allow the Board of Health to enter the premises to investigate any sources of concern, per 105 CMR 590. Our office would prefer sooner rather than later as it is in the best interest of the town and public health. If we do not hear from you and we are unable to conduct our compliance inspection, we may assume you are unable to complete the 2 tasks and that you are voluntarily closing for a period of time. At that meeting we reviewed the lists previously written regarding the issues at the Steven's Estate at Osgood Hill. We also discussed the progress that you have made at the Estate and agreed to some further actions needed by both arties. You indicated that to date, other than the pest control company, no outside professionals have been hired to assist in the difficult task of bringing this establishment into compliance. Subsequently, the current staff is fully responsible for needed improvements. As there are many tasks to keep track of, the Health Department continues to recommend the hiring an outside consultant to ensure compliance. The list below is taken from the October 10, 2007 letter to you. The comments in red found below, signify the current status of the issue, the blue comments indicate compliance. 1) Pest Control - Pest End has made recommendations to eliminate entry to the building to the mice. The recommendation was given August 6th. Their report of August 28, 2007 notes that there has been no action taken to seal the foundation openings, cracks etc. Please continue updating the Health office with progress in this area. The rodent issue is showing significant improvements, however Integrated Pest Management will be maintained as a priority to prevent future problems. 2) Knowledge and commitment to food safety — This is a priority due to the condition of the kitchen in regards to cleanliness as listed in the inspection documentation, as well as to the concern over the ineffective response to the hazardous situation. It is recommended that the people in charge immediately sign up for a food safety course and submit proof of enrollment. No compliance to date. The head chef must be signed up in a Servsafe class scheduled no later than Feb. 1, 2008. Please forward the proof of admission immediately. The Manager must sign up for a course as well. No compliance to date. A daily, weekly, monthly cleaning schedule must be submitted. 4) Identify a date that the board will review the structural issues. Submit a timeline for proposed correction of structural issues. No timeline received. S. Sawyer will provide additional priority list to assist the Steven's Estate board and management see below. 5) Identify new/ safe and acceptable location for storage of catering equipment and set time for corrective action. In compliance. Items in this room have been relocated. Future room use is being evaluated. Old unused freezer should be removed 6) Repair mechanical items causing hazards; gas stove, ice machine leak, sink drain etc. Ongoing repairs being made. Not complete 7) Identify location for slop sink. Mop water cannot go into 3 -bay as noted. No compliance to date. Recommended inquiring assistance from a plumber as to the most plausible location. For example; possibly in the closet next to the ladies bathroom or in dish room. 8) Address the problem with walk in refrigerator. Relocate a new one or refurbish. Consider the actual needs of the establishment. Is a full size walk in necessary? No action taken to date All of the above outstanding items must be addressed; however, of the structural items noted in #4, as found in the Inspection Report dated August 1, 2007, the Health Department identifies some priorities as listed below. These items do not have to be completed in order, rather a plan, as previously requested, must be submitted to the Health Office as soon as possible, but no later than 30 days from receipt of this correspondence. 1) Replace floors and install curved coving throughout kitchen, under stove area, in dish room and out is wait staff area. 2) Walls in disrepair. Recommend covering kitchen and dish room walls to a minimum of 8 feet in height with non -porous surface such as FRP (fiberglass reinforced panels). They come in sheets and can be installed easily. 3) Dish room countertops in disrepair. Cabinets and countertops are old and should be looked at as to their purpose. Most of the shelving is either unpainted wood or painted and in disrepair. Consider all options. 4) Hand sink in wait staff area does not work for unknown reasons. Leaving this dry is not a good option. Should be removed or repaired. There should be hand sinks in all areas to ensure good hand washing practices. BOH recommends 1 hand sink every 20 feet. The Steven's Estate only has one centrally located. Consider installing one in the dishwashing area and also fixing the wait staff sink. 5) Walk in refrigerator 6) Ceiling tiles missing 7) Remove wood shelving in storage room outside the walk in and replace with washable non -porous materials. (This is dependent on the outcome of #1) 8) Remove metal shelf over 3 -bay if not already completed (in conjunction with # ) Please note that the cleaning has been maintained and the pest issue is primarily under control. The violations ranged in levels of risk and the Board of Health allowed a phased schedule of correction. This letter is a follow-up to those events almost two years ago. For reference I have attached a few of the file documents; the February 21, 2008 letter from the Chairman of the Steven's Estate Board of Trustees, the minutes from a Board of Health meeting held on February 28, 2008 and the working document that was initially issued dated August 1, 2007. Since the onset of the problems at the Steven's Estate many improvements and changes have occurred. The management personnel have changed, there is no full time chef on staff, private caterers have been utilizing the kitchen as needed for events, multiple pieces of kitchen equipment have been purchased, a continuous cleaning program has been implemented and numerous structural defects have been addressed. The Health Inspector, Michele Grant, and I have inspected the establishment at various stages of the project and have continued to communicate with you, Board Chairman Kevin Willoe and Division Head Ray Santilli over these many months. The spreadsheet column "date verified" notes the improvements observed and the results are as follows. The Board of Health (BOH) motion made on February 28, 2009, limited use of the old walk-in refrigerator as its wooden interior could no longer meet the minimum standards of the food code. This unit is being maintained in a clean condition and should continue to be utilized for beer storage only. This motion stands as written. Secondly, the BOH's motion in 2009 also had limited the use of the kitchen due to its condition. As for this restriction, the kitchen now meets the minimum standards of the state and federal codes; therefore increased use of the kitchen is allowed. If the current arrangement of using outside caterers is going to be reconsidered by the Estate, we would appreciate that you discuss this with the Health Department prior to doing so. A third item is pest control. The Steven's Estate continues to have a professional integrated pest manager monitor the building for pest infestation. Integrated pest management takes many factors into consideration while trying to prevent infestation; building conditions, exterior entry points, plumbing observation of leaks etc., before making pesticide application recommendations. Taking into consideration the age of the building, we believe it is important to continue monitoring the situation on a minimum of a monthly basis, or more, at the recommendation of the professional. The last item to mention is likely the most important. The food code requires that persons in charge be food safety certified and be able to demonstrate the principles of food safety to the Health Inspectors. The lack of knowledge of staff can directly relate to the proper execution of safe practices. Although past inspections had noted the need for structural repairs, the issues that place the public most at risk back in 2007 was the lack of knowledge by the professional staff. The current staff now meets the standard. Please be advised that if the certified person changes at a later date, the establishment must notify the Health Department with the name of the new person within 30 days. The Health Department acknowledges the cooperation received by the current administration at the Steven's Estate. Going forward, regular inspections will be conducted two times each year to ensure compliance to the food codes. As this is an old building it is expected that additional improvements will be identified and made as needed. Please note that the Health staff is always available for consult. Rather than introducing a new surface to the kitchen area (the tiles mentioned by Susan), I would focus on the original options of re -painting the brick or installing FRP board. The Health Department originally documented violations to the MA Food Code and the Federal Food Code during a health inspection conducted on August 1, 2007. In addition, the observations of unclean conditions and the indicators of the same, by the fruit flies that have developed, are of concern. (The majority of the fruit flies were around the retumables on the lower level.) The following items must be addressed by Friday. 1) Call your pest control company. Have them come to the sight (today or tomorrow if possible so they can see the severe problems we all saw) and do an evaluation. Kim was told that we would like to see that evaluation and their recommendations by Friday of this week. The company should have no problem with this kind of request. If they do, I would be happy to call them for you. We often do that for establishments. 2) We recommend that you get as many people as possible to help with the cleaning or if you choose you may hire a professional cleaning company. We suggested that possibly each area could be designated to various staff. There is the dish area, the walk-in/ storage area, the main kitchen, the wait staff area, the lower level storage area and the laundry room (the equipment storage area will be discussed at a later time) - Each room must cleared out of unnecessary items; recyelables, boxes, unused equipment, contaminated linens, furniture etc. (there is presently too much clutter to clean properly) - All areas must be vacuumed and/ or swept. Then floors must be cleaned thoroughly All counters, shelves, equipment must be scrubbed down and sanitized. - All dishes and glassware must be run through the dish machine at the end of the process . My primary objective is to make certain I meet the goals and expectations of our customers and clients, and therefore contribute to the overall financial goals of the Estate. Certainly, I am not avoiding required business by the Health Department, but clarifying the times that I am available to assist in the follow through necessary at the Estate. As I stated in my email, I understand that this is not the typical food establishment that is staffed full time, however, in a serious case such as infestation, the Health Department looks to the operator and managers to shift gears to address the issues. We in he Health Office must prioritize minute by minute. We also have experience in the food business as well, and aware of the fast pace. We were clear about our concerns last Wed. and the expectations that would allow you to continue serving food out of your kitchen. The need for good communication between our offices was stressed. My expectation that you should contact us when you completed the tasks may have been lost in the fact that I was to reinspect last Friday afternoon. Without that inspection I had to rely on your honor that those tasks were completed prior to your Sat. event as was requested. To be clear now as we move forward, please understand that you must receive approval from my office before you may prepare food for another event from your kitchen. This is a standard request and will assist us in doing our best to protect the public and our town. Protecting the public health is not only our business, but our responsibility. The correction of the imminent hazards included in last weeks communication need to be documented. We will deal with the other problems in time. Grant Public Health Inspector On August 10, 2007 the Health Department personnel conducted a re -inspection at the request of the operator/manager, Kim Willey. The walk-through was conducted with George Peters, a trustee of the estate. Conditions that were found are as followed. Old rodent droppings on several of the shelves above the ice machine - Rodent droppings on the counter in the dish room. - Rodent droppings throughout the basement. Opened contaminated linens in the basement. - Floors under all equipment and shelving units throughout the facility have not been vacuumed and cleaned/sanitized thoroughly. Old equipment is still in place. Mr. Peters has offered to voluntarily shut down the Stevens Estate for the next several hours. Mr. Peters has enlisted a professional cleaning company to come in and clean/sanitize the kitchen, dish room and the service area, floors walls and equipment. In the interest of public health and safety, a re -inspection of the facility will be conducted at the end of the day, August 10, 2007, to ensure that the proper cleaning procedures have been completed. Have them come to the sight (today or tomorrow if possible so they can see the severe problems we all saw) and do an evaluation. Kim was told that we would like to see that evaluation and their recommendations by Friday of this week. The company should have no problem with this kind of request. If they do, I would be happy to call them for you. We often do that for establishments. 2) We recommend that you get as many people as possible to help with the cleaning or if you choose you may hire a professional cleaning company. We suggested that possibly each area could be designated to various staff. There is the dish area, the walk-in/ storage area, the main kitchen, the wait staff area, the lower level storage area and the laundry room (the equipment storage area will be discussed at a later time) - Each room must cleared out of unnecessary items; recyclables, boxes, unused equipment, contaminated linens, furniture etc. (there is presently too much clutter to clean property) - All areas must be vacuumed and/ or swept. Then floors must be cleaned thoroughly - All counters, shelves, equipment must be scrubbed down and sanitized. - Clean or remove any easily moved accessory equipment such as dirty fans or old items not needed - All dishes and glassware must be run through the dish machine at the end of the process Since condition found cannot assure the Health Department that safe food can be served out of the Steven's estate kitchen. M. Grant went back to Steven's Estate and at @ 4:30 was satisfied with Service Master's progress and gave the ok for using the kitchen for the next day's event.
