Daniel Long, Town Clerk 74 Innis St. Town Office Building Petition #86-86 North Andover, MA 01845 Dear Mr. Long: The Board of Appeals held a public hearing on May 13, 1986 upon the application of Peter & Louise L. Aziz who requested a variance from the requirements of Section 7, Paragraph 7.1, 7.2 and Table 2 of the Zoning ByLaws so as to permit reducing the land area from 23,405 sq. ft. to 20,192 sq. ft. by conveying 30' wide strip of land to the abutting land and reducing the required 30' rear offset from the exist- ing wood deck to the rear property line to 22' at 74 Innis Street. The following members were present and voting: Frank Serio, Jr., Chairman, Alfred Frizelle, Vice-chairman, Augustine Nickerson, Clerk, William Sullivan .and Walter Soule. The hearing was advertised in the North Andover Citizen on April 24 and May 1, 1986 and all abutters were notified by regular mail. The Board feels that the granting of this variance would in no way deter from the neighborhood. Motion made by Mr. Frizelle and seconded by Mr. Soule to GRANT this variance as reguested. These forms shall be furnished by the Clerk upon request. Any communication purporting to be an application shall be treated as mere notice of intention to seek relief until such time as it is made on the off iciaL application form. Any topographical feature of the parcel of land'relied upon for a variance, such as ledge, rock peat, or natural condition of water, brook, or river, shall .be- shown on the engineering plan. Please consider these reasons voting on the subject: 1). The Petitioner is taking away land which he has no extra to take away. 2). Hardship, financial or otherwise, can hardly be factual as Petitioner's son purchased the abutting land three (3) month ago (ref. ZBL 10.4), sold 1/31/86 (public record N.E.R.Dc 3). Varying one (1) violation of a zone is one thing, but asking to vary 4 violations SHOULD NOT BE CONSIDERED DESIRABLE BY THIS BOARD (Ref. 7:1, 7.2, 7.3, & Table 2). 4).
