If the Bylaw were to be enforced literally, the setback of the sign to 10 feet from the property line, in an area of steep topography (which has resulted in the need to construct the retaining wall as shown on the plan), would result in a sign which would be significantly taller than what is proposed in order to be seen by traffic traveling on Route 114, Turnpike St. A sign of this height would require the construction of a concrete pad encroaching on the wetlands to support it. The hardship is economic in that the cost to construct a sign of such a size in this location with the required support pad is excessive. This variance petition is a classic example of applying both the topographic and soils tests to the request for relief.
