Stephen & Kathleen A. Borys* 76 Boxford Street * * * * * * * * * * * * * Petition: #71-87 DECISION The Board of Appeals held a public hearing on June 9, 1987.on the application of W. Stephen & Kathleen A. Borys requesting a Special Permit from the requirements of Section 4,_ Paragraph 4.121(17) of the Zoning ByLaws so as to permit construction of a family suite for use by Mrs. Bory's parents, Eugene & Anne McCarthy, on the premises located at 76 Boxford Street. The following members were present and voting: Frank Serio, Jr., Chairman, Alfred Frizelle, Vice-chairman, Augustine Nickerson, Clerk, Walter Soule and Raymond Vivenzio. The hearing was advertised in the North Andover Citizen on May 21 and May 28, 1987 and all abutters were notified by regular mail. Upon,a motion by Mr. Soule and seconded by Mr. Frizelle, the Board VOTED, unanimously, to GRANT the Special Permit as requested, subject to the following conditions: 1. The premises be occupied by Eugene & Anne McCarthy. 2. The Special Permit shall expire at the time Eugene & Anne McCarthy cease to occupy the family suite. 3. The Special Permit shall expire at the time the premises are con- veyed to any person, partnership or corporation. 4. The applicant, by acceptance of the Certificate of Occupancy issued pursuant to the Special Permit, grants to the Building Inspector or his lawful designee, the right to inspect the premises annually. The Board finds that the petitioner has satisfied the provisions of Section 10, Paragraph 10.31 of the Zoning ByLaw and the granting of this Special Permit in particular will not derogate from the intent and purpose of the Zoning ByLaw nor will it adversely affect the neighborhood.
