AFFIDAVIT
I, Michael McGuire am the Building Inspector for the Town of North Andover.
2. I have been provided with copies of a Certificate of Use and Occupancy which
references a Building Permit issued on August 31, 1993 and a copy of a Plot Plan
dated August 26, 1993 that shows a deck on site at 76 Meadowood Road, North
Andover, MA 01845 recorded at Book , Page
3. Based on the information provided, the deck was constructed when the Certificate
of Use and Occupancy was issued. See attached Exhibits "A" and Exhibit `B".
4. Pursuant to Mass. General Laws Chapter 40A, Section 7, it is my belief that no
action, criminal or civil, shall be maintained against such property as the six (6)
year statute of limitation has expired on said property.

ENFORCEMENT OF ZONING REQUIREMENTS § 13.05
The second, or "reactive," role of the zoning enforcement officer requires the
offices to respond to requests for enforcement of the zoning ordinance by third
parties. That role is assigned to the zoning enforcement officer by the second
sentence of Section 7 of the Zoning Act, which states that
If the officer or board charged with enforcement of zoning ordi-
nances or by-laws is requested in writing to enforce such ordi-
nances or by-laws against any person allegedly in violation of the
same and such officer or board declines to act, he shall notify, in
writing, the party requesting such enforcement of any action or
refusal to act, and the reasons therefor, within fourteen days of
receipt of such request.
Section 8 of the Zoning Act provides an appeal mechanism for certain persons
who disagree with the zoning enforcement officer's interpretation as to whether
a particular use or structure is in compliance with the requirements of the local
zoning regulations. That appeal procedure will be discussed in greater detail
below.
§ 13.05 Six -Year and Ten -Year Statutes of Limitations
on Enforcement Actions
isThe second sentence of the second paragraph of Section 7 of the Zoning Act
provides in pertinent part that
if real property has been improved and used in accordance with

effect or purpose of which is to compel the abandonment, limita-
tion or modification of the use allowed by said permit or the
removal, alteration or relocation of any structure erected in reli-
ance upon said permit by reason of any alleged violation of the
provisions of this chapter, or of any ordinance or by-law adopted
