The Trustees of JeffersonTrust thank you for the consideration
and extension of the variance for our sewer project. These projects
seem to be constantly beset with details that cause delay:however,
we feel now that construction will start within a few days.
If construction moves ahead without a snag, we could be on line
by July 30. Frankly, I've never seen a 2-3 week sewer project
take 3 weeks. I feel confidant however, that we will be on line
sometime in August.
With the reality of the situation in mind, we request that the
Board "hang in" with us until we get hooked up. The Board
should be aware that we need to start construction of our
second building, ASAP, in order to get our new tennant in
place by January 1st. We know that a building permit will not
be forthcoming until we are on line with the sewer, so the
hookup is priority -one with us.

Route 114, North Andover, MA
Dear Mr. Eidleman:
On behalf of my client, Jefferson Realty Trust, through the
North Andover Board of Public Works, I am requesting the
reinstatement of a permit to install a sewer line on the
easterly side of Route 114 between stations 60 + 0 and 72 + 0.
The original permit for this work was submitted on October 27,
1982 and was voided on December 30, 1982.
Jefferson Realty Trust is developing a parcel of land at the
intersection of Route 114 and Mill Road on which they have
constructed an office building. The construction of the
office building was contingent upon its being tied into
municipal sewerage. The installation of the sewer line has
not been accomplished because the sewer pump station has not
been completely constructed. However, its completion is
imminent. As soon as the permit is reinstated, my client
intends to construct the sewer line and tie into the pump station.
I have enclosed a copy of the original permit application, a
copy of the letter from the North Andover Board of Health
authorizing use of a sewer holding tank until construction of
the sewer pump station, correspondence from the Department of
Environmental Quality Engineering authorizing utilization of
a sewer holding tank until construction of the sewer pump
station, and the Orders of Conditions issued by the North
Andover Conservation Commission for the installation of the
sewer line.

It has not been possible to complete the work proposed because

Dear Mr. Galvagna:
I have requested that the construction lender for Jefferson Park,
Rhode Is_and Hospital Trust National Bank, provide you with a
letter indicating a withhold -..-,g of $10,000 ($5,000.00) each, for
the two orders of conditions relative to our project.
For your files, I have included a copy of the agreement we have
with the North Andover Board of Health, which essentially operates
to assure the town that they have protective control of their
interests regarding our connection to an approved sewer. I believe
the letter from the bank will provide the same type of
protection nor your interests.
WP expect to start construction in the area subject to the orders

condition in mid July, contingent on your approval of the
bond arrangement, as we'll as an on-site inspection of wetland
protective measures.
We are looking forward to finally getting underway with the
construction of a project which, I believe, will be noteworthy
in terms of quality and design as well as proceeding in a
spirit of co-operation and teamwork with State and Municipal
officials. To this end, my phone number (401-245-6404) has
a 24 hour answering service available -,hould questions or
problems arise during construction.
To date, the Town Of North Andover has been extremely helpful
and responsibly flexible in assisting us overcome some
potentially difficult problems. We appreciate the effort and

Dear Mr. Kay:
The Metropolitan Boston/Northeast Regional Office of the Department of
Environmental Quality Engineering is in receipt of your letter, dated
December 23, 1982, notifying the Department that the North Andover Board of
Health had granted a variance to the provisions of 310 CMR 15.18(Miscellaneous
Disposal) of Title 5 of the State Environmental Code for the installation of a
"temporary holding tank" to service a new office building at the subject site.
The Department is also in receipt of a submittal dated January 5, 1983 from
T&M Engineering Associates, Salem, Massachusetts, representing Jefferson Trust,
requesting approval for a "holding tank" installation. Accompanying the submittal
is a plan consisting of one sheet which is titled:
Temporary Septic/Holding Tank Sewerage

The plan proposes to dispose of 600 gallons per day of sanitary waste by
means of a 1500 gallon concrete septic tank which discharges to a 5000 gallon
concrete holding tank with off-site disposal at the Greater Lawrence Sanitary
District wastewater treatment facility in North Andover. The "holding tank"
will be equipped with both audio and visual alarms set at the 2/3 elevation
level.
A private sewer line and pumping station, that will service the office
building, is under construction but work has been currently suspended due to
weather conditions and will be resumed in the spring. Additionally, the
applicant, Jefferson Trust has posted a bond in the amount of $55,000 with the
Town of North Andover to assure that a sewer connection is effected not later
than June, 1983.

An engineer of the Department has reviewed the plan and makes the following
comments:
The 1500.gallon septic tank located prior to the 5000 gallon
"holding tank" will serve no useful purpose, will only
accumulate solid buildup and is not readily accessible
(no manhole to grade) for cleanout.
It is the opinion of the Department that the .plan has been prepared in accordance
with standard engineering practice. It is the further opinion of the Department
that strict enforcement of Title 5 of the State Environmental Code would cause
manifest injustice to the applicant and the applicant has proved that the same
degree of environmental protection required under Title 5 can be achieved with-
out strict application of the provisions of Title 5.
The Department hereby approves the installation of a "holding tank" to service
the subject site with the following conditions:
1. No septic tank shall be installed prior to the holding tank.
2. A dry sewer line, from the facility to the property line
be installed concurrently with the "holding tank" in order
to facilitate the proposed sewer connection.
3. A sewer connection will be effected within thirty (30) days
of Completion of the municipal sewer extension but in no
case later than June 30, 1983 without prior written approval
of both the Department and the North Andover Board of Health.

At our regular meeting held on
June 6, 1983, this Board voted to grant a one-month
extension for the 5000 gallon holding tank located
at the corner of Mill Road and Route 114 -,,,Jefferson
Realty Trust. This extension is granted because of
the delay,in construction of the sewer pump station
on Route 114. This extension will terminate on
August 1, 1983.

hereinafter referred to as the "Lender"; and'the Town of North
Andover, acting through its Board of Health, hereinafter
referred to as the "Board", viz:
WHEREAS, pursuant to an agreement between the Board, and the
Applicant, the Board has approved the installation of a
temporary holding tank for the purposes of providing sewerage
disposal to a development owned by and being constructed by the
Applicant located on Route #114 in the Town of North Andover.
The Applicant and the Board have agreed that the conditions
of approval of sand installation of a holding tank are as
follows:
1. That the owners of the development aforesaid will provide
security in a sufficient amount to guarantee the installation
of underground sewerage to.,service the building now being
serviced by the holding tank, the construction of which has
hereinbefore been allowed.
2. The installation of said underground sewerage shall meet
all of the design standards and requirements of the rules and
regulations of said Board with respect to the subsurface dis-
posal of sewerage.

WHEREAS, the Applicant has given to the Lender, a mortgage
dated / � ` f4 y , recorded in the North Essex
Registry of Deeds in Book/Page /`� , covering the land
upon which the buildings are constructed on said Route #114 in
said North Andover, to be serviced by said holding tank which
mortgage is to secure the payment of a certain note given by
the Applicant to the Lender.

mortgage to be disbursed to the Applicant as and when the
sewerage disposal system to be approved by the Board and con -

NOW, THEREFORE, it is understood and agreed that the Lender
shall retain the sum of $ SS;000.o v , deemed by the Board
to be sufficient, releasing only such funds as approved by a
vote of the Board as the sewerage system approved by said Board
has been completed in accordance with its applicable rules and
regulations.
It is also understood that funds for the installation of the
above sewerage service are to be advanced by the
_only through written authorization of
the North Andover Board of Health.
It is further understood and agreed that all of the sewerage
services as aforei)entioned shall be completed no later than
ul'� 30 5:3 , unless the date be extended
by written amendment by mutual agreement of the parties hereto.
In the event the work is not completed within the time set
forth oras extended, said funds as retained by the Lender
shall be made available to the NOrth Andover Board df Health
for the completion of the work, and the Applicant shall be
deemed to have 'authorized the release of said funds for said
purpose, and to have relinquished all claim to said funds.
Executed as a sealed agreement on the date first above

TO WHOM IT MAY CONCERN:
In reference to a temporary holding tank to
service a single office building with approxii-nately eight to ten plumbing
fixtures, this Board of Health will allow the function of said holding
tank through June 30, 1983. At that time the holding tank will cease
to exist unless work has been started and completed by July 1, 1983 on
either tieing in to underground permanent sewer lines or aseptic field
has been established.
To assure fulfillment of the above, a bond

of $ is to•:be prepared by North Andover Town Counsel,
at which time this variance of Title V will be formally presented to
Dept of Environmental Quality Engineering, Comm of Mass,as required
by Title V. DEQE has thirty days to approve or disapprove of this -'
variance.

have not received same.
12/9/82 Borgesils staff engineer quotes $55,000 for Fennell to install
pump and another $55000 to complete his line
12/1+ Fennell has not contacted us since 12/8 regarding this bond or varianc
Fennell's lawyer talked with B1dg.Insp about an occupancy permit and
I gave B1dg.Insp a copy of the above explaining that the variance has
not yet been filed with DEQE and is not yet in effect.
