Andover 770 Boxford Road NON -NE -08-6W001 NOTICE OF NONCOMPLIANCE THIS IS AN EWORTANT NOTICE. FAILURE TO TAKE ADEQUATE ACTION IN RESPONSE TO THIS NOTICE COULD RESULT IN SERIOUS LEGAL CONSEQUENCES. Department of Environmental Protection (MassDEP) personnel have observed that your site/facility is in noncompliance with the Wetlands Protection Act, M.G.L. c.131, § 40 and theWetlands Regulations of Massachusetts, 310 CMR 10.00. Attached hereto is a written description of (1) each activity referred to above, (2) the requirements violated, (3) the action MassDEP now wants you to take and (4) the deadline for taking such action. If you fail to take any action MassDEP now wants you to take by the prescribed deadline, or if you otherwise fail to remain in compliance in the future with requirements applicable to you, you could be subject to legal action, including, but not limited to, criminal prosecution, court -imposed civil penalties, or civil administrative penalties assessed by MassDEP. A civil administrative penalty may be assessed for every day from now on that you are in noncompliance with the requirements referred to above in a cooperative and timely manner. The activity has been performed without filing a Request for Determination of Applicability ("RDA") or Notice of Intent ("NOP') as required by the Regulations. DESCRIPTION OF REQUIREMENTS NOT COMPLIED WITH: By failing to file a WPA Notice of Intent or Request for Determination of Applicability for the activity performed, the Property Owner violated the WPA and Regulations at 310 CMR 10.02(2)(a) and 310 CMR 10.02(2)(b). ACTION TO BE TAKEN, AND THE DEADLINE FOR TAKING SUCH ACTION: 1) Within 60 days of this Notice, perform a delineation of all wetland resource areas and limits of WPA jurisdiction on the Site surrounding the area of activity, and remove/pull back all bark mulch and any other fill material to (at a minimum) 25 feet from the edge of any wetland resource area. Once removed/moved, immediately install erosion controls at the edge of disturbed area. 2) Within 90 days of this Notice, submit to MassDEP for its approval a site plan depicting all wetland resource areas on the Site, including a jurisdictional delineation, along with a proposal for final Site restoration, including re -vegetation and final stabilization to be completed no later than May 31, 2008. Upon approval of said plan, implement the plan as approved by MassDEP. 3) No later than October 31, 2008, submit a final report and as -built Site plan demonstrating successful completion of the MassDEP approved restoration and stabilization plan. P 4) A wetland scientist shall perform all WPA delineation and preparation of the restoration proposal. Either a Registered Professional Land Surveyor or Engineer shall prepare the delineation Site plan and the as -built Site plan.
