On April 1, 2015, Brian Leathe visited your establishment and counted the number of vehicles located at your business. The number of vehicles counted was forty five (45). Your establishment is zoned GB (General Business). According to the Town of North Andover Zoning Bylaw, General Business District, Section 4.131, Number 4, states "automobile sales agencies for new and used cars, provided there be not displayed or stored outdoors on such premises more than twenty five (25) automobiles or other vehicles." You have thirty (30) days to remove the excess vehicles from your business. We are available to answer questions and concerns at 978-688-9545 between 8:00 am to 10:00 am Monday through Friday and 1:00 pm to 2:00 pm Monday through Thursday. Specifically, he had concerns about the number of cars on the lot right in front of Stop N' Shop (785 Turnpike Street). I told him the parcel is in the General Business Zone and that it appears to me, but that you should confirm, that there is a permitted use for, Automobile service and filling stations, automobile storage and repair garages, including automobile body repairs and painting, and automobile sales agencies for new and used cars, provided there be not displayed or stored outdoors on such premises more than twenty-five (25) automobiles or other vehicles. He subsequently counted the cars stored outdoors and there were 45 in the lot. He would like them to conform to our Bylaw. I told him I would pass his concern on to you. I included his email above if you would like to get in touch with him. I believe Paul was a past member of the Planning Board, but I do not know when or for how long. This writer toured the site, this afternoon, and found that the crew had previously over excavated the eastern end of the southern trench, and placed up to 2' of crushed stone (to create a firm base). The western section was exposed at footing level. The northern trench had also reportedly been over cut about 2' and backfilled with stone, but, due to its proximity to the adjoining stream, the water level was about V above the footing. The undersigned monitored the excavation of one (1) test pit adjacent to the previously excavated canopy footing trenches. The approximate location, and general site layout, are shown on the attached field sketch. The test pit showed a surficial 2'to 3' layer of sand/gravel (fill) overlying a 2 foot thick strata of black, organics ("peat"), which appeared to be the original ground. Underlying these layers was a gray silty sand, with little gravel, which continued through the designed bottom of footing elevation. About 2' below footing level the material changed to a reddish silty sand which extended to the termination depth of 9'. Judging from the excavation effort, trench face stability, and soil consistency, the soils, below footing level, were at least medium dense. Based on today's observations, it is our opinion that the gray soil at footing elevation (Class 8), in accordance with section 1804.3 of the State Code, possesses a maximum allowable net bearing capacity of 3 TSF. As the footings were designed based on 3000 psf (1.5 tsf), it is our professional opinion that the design value does not exceed the maximum allowable. Also, as the soil contained significant fines it is not considered susceptible to liquefaction. Further, the limited use of crushed stone, when working near the water table, is a standard construction procedure in accordance with proper engineering practice. In summary, the conditions were satisfactory for support of the proposed canopy footings on either the existing gray soil or the crushed stone. I. 02914 * DECISION The Board of Appeals held a public hearing on Tuesday evening, December 13, 1988 upon the application of Getty Petroleum Corp. requesting a Special Permit from the requirements of Section 6, Paragraph 5.F of the Zoning Bylaw so as to permft the erection of an identification sign, with price sign incorporated within the same face, in compliance with bylaw and per plans submitted to Building Inspector. The petitioner has 90 days to complete this, before March 31, 1989. The follow- ing members were present and voting: Frank Serio, Jr., Chairman, William Sullivan, Walter Soule and Louis Rissin. The hearing was advertised in the North Andover Citizen on October 13, 1988 -and October 20, 1988 and all abutters were notified by regular mail. Upon a motion made by Mr. Sullivan and seconded by Mr. Soule, the Board voted, unanimously, to GRANT the Special Permit as requested subject to the condition that the erection of the identification sign, with price sign incorporated within the same face, is in with bylaw and per plans submitted to Building Inspector. The petitioner has 90 days to complete this, prior to March 31, 1989.
