I. 02914 TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS Petition #23-89 DECISION , Ah n % oto t C� r he 01 •r,,, k jCL t f Qr a n The Board of Appeals held a public hearing on Tuesday evening, December 13, 1988 upon the application of Getty Petroleum Corp. requesting a Special Permit from the requirements of Section 6, Paragraph 5.F of the Zoning Bylaw so as to permit* the erection of an identification sign, with price sign incorporated within the same face, in compliance with bylaw and per plans submitted to Building Inspector. The petitioner has 90 days to complete this, before March 31, 1989. The follow- ing members were present and voting: Frank Serio, Jr., Chairman, William Sullivan, Walter Soule and Louis Rissin. The hearing was advertised in the North Andover Citizen on October 13, 1988 and October 20, 1988 and all abutters were notified by regular mail. Upon a motion made by Mr. Sullivan and seconded by Mr. Soule, the Board voted, unanimously, to GRANT the Special Permit as requested subject to the condition that the erection of the identification sign, with price sign incorporated within the same face, is in with bylaw and per plans submitted to Building Inspector. The petitioner has 90 days to complete this, prior to March 31, 1989. The Board finds that the petitioner has satisfied the provisions of Section 10, Paragraph 10.3 of the Zoning Bylaw and that the granting of this Special Permit will not derogate from the intent and purposes of the Zoning ByLaw nor will it adversely affect the neighborhood. Peter J. McQuillan this morning to review the proposed work at the Getty Station located at 785 Turnpike Street. The owners of the station plan to install a canopy over the gas tanks and to remove two tanks. In my opinion, these changes do not require site plan review under Section 8.3 of the Zoning Bylaw as there will not be any new construction which either creates a new building or adds to an existing building. Furthermore, the addition of a canopy and the removal of tanks do not constitute a "site improvement" which would contain new processes, create a nuisance, change traffic circulation or affect storm water management.
