The Board of Appeals held a public . hearing.:6n .Decefnber 9 , .1986 upon
the application of Jefferson Office Park Limited Partnership request-
ina a variance from the requirements of Section 7, Paragarph 7.3 and
Table 2 of the Zoning ByLaws so as to permit relief of zoning set-
back requirements on a pre-existing non -conforming structure(paving).
The following members were present and voting: Frank.Serio, Jr.,
Chairman, Alfred Frizelle, Vice-chairman, Augustine Nickerson, Clerk,
Walter Soule and William Sullivan.
The hearing was advertised in the North Andover.Citi.zen on November 20
and 26, 1986 and all abutters.were notified by regular mail.
Upon a motion made by Alfred Frizelle and seconded by Walter Soule,
the Board voted, four in favor and one opposed to.GRANT the variance
as requested subject to the following conditions -
1. Barn as shown on plan be razed before any further occupancy
permits be issued.
2. Landscaping(shrubs and trees) be put along Chestnut Street
boundary.
3. Entrance/exits blocked and green areas put in as shown on
plans submitted to the Planning Board.
The Board finds that the granting of this variance will not derogate
from the intent and purposes of the Zoning ByLaws nor adversely affect
the neighborhood.

DECISION
The Board of Appeals held a public hearing on May 12, 1987 on the application
of Jefferson's Children's Center, Inc. requesting a Special Permit from the
requirements of Section 4, Paragraph 4.129(17) and Table 1 of the 'Zoning By -
Laws so as to permit operation'of a non-profit "Day Care Center" on the ground
floor of an existing building located at 790 Turnpike Street. The following
members were present and voting: Frank Serio, Jr., Chairman, Alfred Frizelle,
Vice-chairman, Augustine Nickerson, Clerk, Walter Soule and Anna O'Connor.
The hearing was advertised in the North Andover Citizen on April 23 and
April 30, 1987 and all abutters were notified by regular mail.
Richard F. Kaminski of Kaminski Associates spoke for the petitioner stressing
the urgent need for child care in the local area and that this location is
a central and convenient one for most local businesses in need of child care
for their employees.
Upon a motion made by Mr. Frizelle and seconded by Mr. Soule, the Board VOTED
to GRANT the Special Permit as requested. The vote was as follows; Mr. Serio,
Mr. Frizelle, Mr. Soule and Ms. O'Connor in favor. Mr. Nickerson was opposed.
The Board finds that the petitioner has satisfied the provision of Section 10,
Paragraph 10.3 of the Zoning ByLaws and the granting of this variance will not
"derogate from the intent and purpose of the Zoning ByLaws nor will it adversely
affect the neighborhood.
