Nor Andover.. The lots have been identified as Lot A and Lot C on certain recorded Plans. The Lot A'and Lot C designations will.be used in this letter for identification of those lots. Lot A Lot A is shown on a Plan of Land dated February, 1972, and recorded with the Essex North District Registry of Deeds as Plan No. 6757. This lot contains 44,250 square feet according to said Plan. This lot is currently owned by.Linda M. Emro, Trustee of Pine Hollow Trust by virtue of a Deed from Anna M. Gilbert dated February 5, 1993, and recorded at Book 3657, Page 232. Lot C Lot C is shown on a Plan of Land dated May 5, 1997 and recorded as Plan No. 7809. Lot C contains 45,110 square feet according to said Plan. Lot C is currently owned by Anna M. Gilbert by virtue of a Deed dated August 13; 1953 and recorded at Book 779, Page 303. Both Lots A and C were the subject of a Variance dated February 15, 1990, and recorded at Book 3092, Page 316. By that decision, the North Andover'lBoard of Appeals granted a, Variance for these Lots from the area and frontage requirements of the North Andover Zoning � I Robert Nicetta, Building Inspector. July 8, 1999 �. Page 2 By -Law. This allowed the lots, along with surrounding land owned by Anna M. Gilbert, to be subdivided into separate building lots. The subdivision of the property neighboring the lots is shown on a Plan of Land dated April, 1990, and revised August, 1990, and recorded as Plan No. 11810. Lots A and C are both shown as.:,`..N/F Anna M. Gilbert" on that Plan. The lot abutting r `the rear of Lots A and C, shown, as Lot 6on. Subdivision Plan No. 11810, was conveyed by Ms. -� -3, Gilbert to Mary Elizabeth Koontz by Deed recorded on April 30, 1991 at Book 3247, Page 137. Building Permits are newought for Lot A and Lot C, although the current dimensional :: W' iequirements for these parcels requires a two acre minimum lot area. However, because of the 'Variance affecting these lots, the current dimensional requirements as to lot area and frontage are not applicable. It should be noted that the.Massachusetts Zoning Act, G.L. c.40A, § 10, requires the exercise of any Variance•within one year ofthe date of issue. However, even though . 'Building Permits have not previously been requested for these lots, the Variance at issue was properly "exercised'.' within a year! of its issuance. This exercise was accomplished by the conveyance of the above -referenced Lot 6 separately from Lots A and C. The Massachusetts Appeals Court has held that where! a Variance has been issued allowing the division of a lot, that - Variance is sufficiently and irrevocably exercised by the partition of the property according to the -Variance. The conveyance of Lot 6, if not the mere endorsement and recording of Plan No. 11810, sufficiently and irrevocably exercised -,the Variance within one year of its issuance, thus, maintaining the effectiveness of the Variance as to Lots A and C currently. See Hogan v.
