The Board.of.Appeals held a public hearing on Monday evening,
August 8, 1983 upon the application.of Alan and Bonnie Ethun.
The hearing was advertis.ed in the Lawrence Eagle Tribune on
July 23 and 30, 1983 and all abutters were notified by regular
mail. The following members were present and.voting: Frank
Serio, Jr., Chairman;.Alfred E. Frizelle, Esq., Vice Chairman;
Richard J. Trepanier, Esq., Clerk; William J."Sullivan; and
Augustine W. Nickerson.
The petitioner seeks a variance from the provisions of Section 7,
Paragraph 7.3 and Table 2 of the Zoning By Law so as to permit
relief from the rear setback requirement to allow the continued
existence of a deck on premises located at 8 Rock Road.
The petitioner's counsel testified that a recent plot plan was
required for -the conveyance of -the premises which revealed the
violation. There is a- deck (porch) which, in the opinion of
the surveyor, is 23 feet `from the rear(•property Trine.
Further testimony from the Building Inspector revealed that, in
his opinion, the deck is not in violation of"the Zoning By Law
since the lot in question is triangular in shape and he deter-
mined that the 30 foot rear lot line setback does not apply, since
his.interpretation of a rear lot line is the line opposite the
front line. He did, therefore, determine that the line of the
lot.on which the deck is placed -is a side line, which requires
only a 15 foot setback.
Upon a motion made by Mr. Fri zelle and seconded by Mr. Trepani.er,
the Board voted "unanimously that no variance is necessary since
the deck is not within 30 feet of the rear lot.line as interpreted
by the Building Inspector. "

Sec. 1 APPLICATION FORM
Every application for action by the Board shall be made on a form
approved by the Board. These forms shall be furnished by the clerk
upon request. Any communication purporting to be an application
shall be treated as mere notice of intention to seek relief until
such time as it is made on the official application form. All in-
formation called for by the form shall be furnished by the applicant
in the manner therein prescribed.
Every application shall be submitted with a list of "Parties in
Interest" which list shall include the petitioner, abutters, owners
of land directly opposite on any public or private street or way,
and abutters to the abutters within, three hundred feet of the property
line of.the petitioner as they appear on the most recent applicable -
tax list, notwithstanding that the land of any such owner is located
in another city or town, the Planning Board of the city or town, and
the Planning Board of every abutting city or town.
* Every application shall be submitted with an application charge cost
in the amount of $25.00. In addition, the petitioner shall be respon-
sible 'for any and all costs involved in bringing the petition before
the Board. Such costs shall include mailing and publication, but
are not necessarily limited to these.

application does not :«eet the requirements of the Board of
Appeals, which I Piave enclosed for your review.
A1; you can see, a plot plan is only acceptable if the dwelling
was constructed prior to March 14, 1977.
Since the Ethun's dwelling was constructed after this date, a
more detailed plan is required.
