RE: VIOLATION of the Massachusetts Wetland Protection Act (M.G. L. C. 131§ 40) and The
North Andover Wetland Bylaw (C. 178 of the Code of North Andover).
Dear Ms. Rokous:
On July 17'h this Department visually observed a violation of the Massachusetts Wetland Protection Act
(M.G.L. C.131 § 40) and the North Andover Wetlands Bylaw (Chapter 178 of the Code. of North Andover)
while performing a routine building inspection for your neighbor at 96 Chestnut Street. The violation was
observed within a protected wetland resource area and within the 25' no -disturbance area of this resource
area. The said violation consists of the dumping of yard waste, particularly significant brush debris piles.
This Department has the jurisdiction to require such materials to be removed from these protected resource
areas as it is considered an "alteration". An "alteration" includes, but is not limited to, the placement of
fill, excavation, regrading, and deposition of yard waste and debris (Section H. (b) of the North Andover
Wetland Regulations). Wetlands and their buffer zones are not an appropriate location to deposit yard
waste and debris or any other material.
Please remove all materials from the aforementioned location by hand no later than August 4, 2003.
Please contact this office following the debris removal so that another site inspection can be performed.
Failure to comply with this deadline will require your attendance at a public meeting before the NACC,
and/or additional penalties and/or fines.
Thank you for your anticipated cooperation.
