This meeting was attended by you Shari McMains, Ms. Michele Grant, and me. The meeting was held in response to conditions noted in the restaurant during routine inspections. The Administrative Hearing process is an informal meeting where we sit down and discuss the problems identified during an inspection, and work together to come up with a solution to them. The hearing is held when conditions are such that the health and safety of the public are endangered, or when violations are of a repeated nature; this hearing is the result of both reasons. This hearing is the last stop before future violations are brought directly to the Board of Health. Items noted below are from the November 9, 2009 Health Dept. letter. 1. General cleanliness and condition of structural elements. a. Full scrub down has been needed on more than one occasion b. Dirty walls, dirty floors, food build-up on equipment c. On Sunday 1-12-2014, a customer witnessed a kid behind the counter Sweeping and picking dirt up with a dust pan, handling trash, touching his hair and face. Then put his hand on top of his French fries and placed them in the bag. Then ... One worker walked behind him Telling him "I'm going to kick your As.......". The staff was all kids. The customer did not feel comfortable speaking to any of the kids about this matter. 1-13-2014 — I spoke to Michael McMains regarding the complaint. NELSON, DIRECTOR April 24 1987 re- Sanitary violations Harrisons Roast Beef 120 Main Street North Andover, Massachusetts O 1845 (617) 685-4775 In response to complaints received from abuttors to.your establishment I visited the site on April 17 1987, I found a stream of greasy water running directly from the employee entrance of the kitchen down across the parking lot of the apartments behind the building. I spoke to the manager who denied any violations until repeatedquestioning brought out the fact that the employees are accustomed to dump buckets of dirty mopwater out behind the kitchen so the water drains away to the apartments. He admitted that laziness was the justification for this practise. This is a direct violation of Commonwealth of Massachusetts regulation 590=016 which states that, sewage and liquid waste shall be disposed of by a public seweragesystem. This means the used mop rinse waterihs to,be disposed of through the buildings sanitary sewer, if you have to install a mop sink to deal with this waste water, do it. A subsequent inspection on April 23, 1987 revealed that my previousconversation with the manager had little or no effect and the greasy water was still being poured out behind the kitchen.where it runs down towards the. Apartments. Please be aware that we have no intention of letting this problem continue. As I pointed out we do not believe laziness is a satisfactory excuse for this problem. While inspecting the grease problem I Notised that the embankment around your parking lot was covered by trash and litter in various states of decay. Sincerely Health SanatoriVan B i of Health t�d Aid •i € CONDOMINIUM TRUST April 15, 1987 Board of Health Town of North Andover North Andover, Ma. 01845 Gentlemen: On April 23, 1986, Village Green Condominium Trust registered a complaint (see attached) regarding some sort of runoff of stagnating water/grease from Harrison's Restaurant being dumped on a sloping piece of property owned by Village Green Conominium Trust thus causing a 3 foot wide greasy path the length of this piece of property. This slope was heavily landscaped to afford privacy to Village Green unit owners and also act as a sound barrier from restaurant noise and patrons for the sixteen families whose homes are in close proximity. To our knowledge, nothing has been done todate regarding this health hazard. I am sure we are all aware the restaurant should have and use a grease valve or holding tank for cleaning their fryolators and filtering waste water before introduction into the sewer system. However, judging from the defacement and grayness of the surviving foliage as well as the 3 foot wide grease path running down this slope which is now commencing to erode our newly paved parking area, it would appear that waste is being dumped on our property rather than into the restaurant's tank or sewer valve. We are receiving complaints from our unit owners regarding the odor emanating from this grease path which has become a breeding ground for maggots, black flies, etc. We feel this condition is detrimental to the health and well-being of Village Green Condominium unit owners. These owners pay over $115,000 annually in taxes and we would appreciate some type of action being instituted against Harrison's Restaurant in order to eradicate this situation as quickly as possible, and before the warm summer months. We arrived just as the workers arrived and remained until the busy lunch period ended. Although they are doing a good job maintaining compliance to critical food safety issues, we did noted the following deficiencies during this audit: • Dirty cloth inside the 5 -gallon sanitizer bucket in kitchen. All wiping cloths stored in sanitizing solution must be free of debris and soil. We recommend rinsing the cloth of excess debris before placing back into the solution. • The sanitizer inside the 3 -bay sink was noted weak at 100 ppm. The sanitizer compartment was drained and refilled. Sanitizer was tested at proper strength. We discussed the need to ensure that the sanitizer is "going the distance " by checking it during a peak period and setting that as the time to change the sanitizer. We further recommended that, if necessary, they purchase a timer to remind people to change the sanitizer at a frequency based on peak work load. • Numerous wet, dirty wiping cloths noted all around the 3 -bay sink area. These cloths were not in use. So that there would be no confusion about whether these cloths are used for food or non-food contact surfaces, we recommended that they provide a covered bucket upstairs for storing dirty cloths until they can be taken downstairs. Label the bucket. 'dirty linens ". • The sanitizer inside the wiping cloth bucket out front was noted at less than 100 ppm. As stated with the three compartment sink, sanitizer must be at 200 ppms at all times. They may need to change the bucket more frequently, based on peak demand. Once they determine this time frame, they could set a time to go off, reminding everyone to change the bucket in a timely manner. • Heavy dust build-up on top of the small retail cooler holding cole slaw, potato salad, etc. • Noted a piece of wood inside the walk-in cooler downstairs. Within 14 days consultant: a. must perform initial assessment of establishment b. must determine gaps in training, equipment needs and premises condition. c. must determine a plan of action to fully comply with the Food Code d. determine a training plan, including oversight of the employees post training. (Details of hours needed to be recommended by consultant) e. submit plan of action for Health Department review f. consultant must visit the following at least once a week for the first 2 months 3. Within 30 days consultant must visit the establishment at conduct training and implement plan 4. Consultant must submit a summary finding in writing to the Health Department following each visit. Did not keep the shot. Dental bill submitted from visit after the incident. Inspection Date 12/5/97 - Susan Ford, Inspector, and Sandra Starr, Agent, went to Harrison's. Spoke with owner, David McMains about the incident. He stated that this was a rare event, but beef does come with buckshot unknowingly.
