LaGrasse, Richard J. Byers, Albert P. Manzi, III, and Richard M. Vaillancourt. The following non-voting members were present: David R Webster, Thomas D. Ippolito, and Daniel S. Braese. Upon a motion by Richard J. Byers and 2°d by Richard M Vaillancourt, the Board voted to the DENY the Special Permit from 4.122.14.1. In malting its decision, the Zoning Board has considered the following criteria of Section 4.122.1: "1. Consistency with the North Andover Master Plan's section titled "Housing and Residential Development" .... "#2. Maintain the character of existing neighborhoods by preserving landscape features, development patterns, density and scale in new growth." .... 3. The degree to which the application addresses the following design standards: i.) Achieve compatibility with the established pattern of uses in the district. The Residential 4 District consists primarily of single-family dwellings near the Stevens Memorial Library Area and off of Massachusetts Avenue.... New construction or substantial alteration of buildings must compliment and reinforce the design features of these neighborhoods. ii.) Achieve design compatibility with architectural features and exterior materials of surrounding structures." The Board finds that the proposed two two-family dwellings, averaging 30' in height, are not consistent with the existing neighborhood of one-story ranch style single-family dwellings, averaging 17' in height, between Mifflin Drive and Greene Street on Pembrook Road. Specifically, i am concerned that if a permit is granted for 80 Pembrook Road, and the condo structure is permitted to be built, the quality of life in the beautiful library and 'Memorial Park area will be threatened. Because there are 765 homes in this arca that zoned for R4, there are numerous lot sizes large enough to put up condo units. If the permit is granted for 80 Pennbrook Road, this will set the precedence for other R4 lots to be rebuilt into condo structures. If this happens, quality of life issues in the library, Memorial Park area will be severely threatened. I am especially concerned about: • Neighborhood access to playing fields. Condos mean more people. The current people to open space ratio in this arca is just right. • Increased traffic — there are MANY children in this area who enjoy playing hockey and ball in the street. Increased traffic means that children can not participate in shared activities with their neighborhood friends. Building strong friendships early in life help to make healthy adults. We want our children to be healthy adults! More condos mean more traffic and means our kids can't play with their neighborhood 8fiends easily outside the safety of their homes. • Access to the Stevens Memorial Library and its services. So many of us enjoy the library. More people due to the pending condo structures mean more usage of the library, With the recent cuts to funding of library services and staff- this means the very real potential of an overburdened and over -used library. • More people means the potential for more crime. Like many families in the library, Memorial Park area, I moved to this neighborhood because it has everything Y was looking for but couldn't find elsewhere: quiet and safe side streets, easy access to the library, use of beautiful fields and parks, modest single home structures, Neighborhoods like ours are hard to find. Granting a permit to make a condo unit on 80 Pembrook threatens our neighborhood and our quality of life here. Many of the families here are hard-working and moved here to make a better life for ourselves and our families. I beg you not to threaten our quality of life here by granting a permit for a condo structure on 80 Pembrook Road. It is my understanding that the original building permit was issued in error because the bylaw change was in effect when Mr. Paul St. Hilliare applied for the permit. I am asking the Zoning Board to deny the continuation of these projects based upon the zoning laws. Our town's zoning laws are made to protect home owners and neighborhoods from builders with a different vision. As a resident of the Library neighborhood for 11 years, I have grown to appreciate the family oriented and uniqueness of this single home family area. The Library neighborhood has a history to preserve when considering Tavern Acres, Memorial Park and our town's beautiful Library. The surrounding single family homes compliment this historic area and preserve the quaintness of:the neighborhood. It is my opinion that Mr. Paul St. Hillaire's condominium project would change the appearance of the Library neighborhood and most likely will set precedence for future condominium projects. Because there are 765 homes in this area that zoned for R4, there are numerous lot sizes large enough to put up condo units. if the permit is granted for 80 Pembrook Road, this will set the precedence for other R4 lots to be rebuilt into condo structures. If this happens, quality of life issues in the library, Memorial Park arca will be severely threatened. I am especially concerned about: • Neighborhood access to playing fields. Condos mean more people. The current people to open space ratio in this area is just right. • Increased traffic — there arc MANY children in this area who enjoy playing hockey and ball in the street, Increased traffic means that children can not participate in shared activities with their neighborhood friends_ Building strong friendships early in life help to make healthy adults. We want our children to be healthy adults! More condos mean more traffic and means our kids can't play with their neighborhood friends easily outside the safety of their homes. • Access to the Stevens Memorial Library and its services. So many of us enjoy the library. More people due to the pending condo structures mean more usage of the library. With the recent cuts to funding of library services and staff— this means the very real potential of an overburdened and over -used library. • More people means the potential for more crime. Like many families in the library, Memorial Park area, I moved to this neighborhood because it has everything I was looking for but couldn't find elsewhere: quiet and safe side streets, easy access to the library, use of beautiful fields and parks, modest single home structures. Neighborhoods like ours are hard to find. Granting a permit to make a condo unit on 80 Pembrook threatens our neighborhood and our quality of life here. We are new residents to North Andover. In November of 2004, we purchased our home on West Woodbridge Road. Prior to the move, we lived in both Milton and South Boston. We decided to buy on this street and in this particular community for several reasons. During our six month research process, we looked at many homes in both Andover and North Andover. Through this extensive process, we narrowed our search to the Library community. The realtor we used from Coldwell Banker educated us about the desirability of this particular neighborhood, especially for a young couple starting a family and looking to put down roots. There is a mix of younger families but also a sense of community developed by families who have lived in this neighborhood for 30+ years. We feel that we paid top dollar in a hot real estate market and based the decision to buy on the fact that in this community there are several different styles of homes but they are all single family homes and predominantly owner -occupied. Another consideration was the spacious yards. Now, we have a major concern that the integrity and character of our neighborhood may change dramatically. With the possibility of duplexes being added on an abutting property, we fear that our major investment's future value may be significantly impacted. We have seen the construction currently underway firsthand in the adjacent lot and are fearful that 80 Pembroke Road will resemble that project. Our home sits directly behind this proposed project. These proposed residences will significantly change the character of this neighborhood. Duplex homes are not part of the current landscape. We are also concerned about the views from our back windows and deck. Currently, we have several large trees on our property that provide a large amount of shade. In addition, there are two old, large trees on the property we are discussing that also provide shade. We never anticipated that these trees would be removed and that a taller home would be built on that property. If this project is approved, we feel that the tress will be removed and our landscape will change drastically and we will also lose our privacy. We are also concerned that if there are four families living in an area where one had lived, that there will also be excess noise. We appreciate the time you have given us to bring these concerns to your attention. We hope this letter weighs heavily in your decision regarding this matter. We hope that we continue to see strong appreciation in the value our home and our neighborhood and also hope that you choose to protect the integrity of the current landscape.
