On behalf of the Massachusetts Electric Company (MECO), a National Grid company, Ransom
Environmental Consultants, Inc. (Ransom) is providing you this letter which summarizes the activities
completed to date in association with conducting Utility -Related Abatement Measures (DRAM) at the
Town Commons Utility Replacement Project located at 800 Massachusetts Avenue, North Andover,
Massachusetts (the Site). Furthermore, it is the intent of this letter to provide a summary of understanding
of the potential requirements of the Town of North Andover due to the discovery of petroleum -impacted
soil within the public right-of-way. The Town Commons Utility Replacement Project includes the
construction of manholes and duct. banks to carry electricity, cable television, and telephone utilities in the
Town Commons portion of North Andover.
BACKGROUND AND RELEASE DISCOVERY
During the course of excavation activities on November 14, 2005, MECo's construction contractor,
Midway Utilities (Midway) discovered what they thought was petroleum -impacted soil at the Site. As a
result, Midway transported the suspect material (approximately 30 tons) to MECo's Lawrence No. 1
Substation for temporary storage. On November 15, 2005, Ransom collected a composite soil sample
from the stockpile for waste characterization. The results of the waste characterization analyses were
received by Ransom on November 28, 2005, and petroleum hydrocarbons (identified by the laboratory as
an "unknown hydrocarbon") were detected at a concentration of 580 milligrams per kilogram (mg/kg).
The concentration of petroleum hydrocarbons detected in the excavated soil exceeds the RCS -1 reportable
concentration of 200 mg/kg, as outlined in the Massachusetts Contingency Plan (MCP) (3 10 CMR
40.1600). Based on this discovery, on December 9, 2005 MECo provided verbal notification to the
Massachusetts Department of Environmental Protection (MADEP). At that time MECO indicated that
they would be conducting URAM activities.

NATURE AND EXTENT OF CONTAMINATION
Based on the limited data gathered by Ransom, it appears that the presence of "unknown" hydrocarbons
in the soil excavated from the Site is related to an historic release of petroleum or the placement of
petroleum -impacted urban fill. Other contaminants, including metals, volatile organic compounds, and
polychlorinated biphenyls, were either not detected in the soil sample, or were detected at concentrations
below their corresponding RCS -1 reportable concentrations. A copy of the laboratory analytical data
report is provided as Attachment A.
The extent of contamination is not known, since the area from which the petroleum -impacted soil was
discovered is not identified as a "disposal site" as defined by the MCP (3 10 CMR 40.0006). Furthermore,
it is not the intent or the function of the URAM to define the nature and extent of the release.
SUMMARY OF COMPLETED AND PROPOSED DRAM ACTIVITIES
At this time MECo has completed the installation of the manholes associated with the proposed work.
Approximately 70 manholes have been installed, with a planned conduit length of 13,000 feet along the
project route. Each of the manholes is approximately 10 feet deep and is constructed of pre -fabricated
concrete.
The remaining work includes the installation of approximately 7,800 feet of duct work to carry the
electricity, cable television, and telephone utilities. The duct lines are made of concrete encased PVC
pipe and are installed within a 5 foot deep trench. The bottom of the trench is lined with compacted
gravel and the duct lines are placed onto the bedding material, then concrete is poured to surround the
ducts. After the concrete has cured, processed gravel is used to backfill the remainder of the trench. The
surface grade will be restored to match the existing surface material. Petroleum -impacted soil which may
be encountered during this project will be temporarily stored at MECo's Lawrence No. 1 substation,
pending appropriate off-site transport and disposal. MECo will take responsibility for off-site transport
and disposal of the petroleum -impacted soil.
POTENTIAL RESPONSIBLE PARTY
Based on the location from which the petroleum -impacted soil was removed (i.e., a public roadway), the
Town of North Andover is the most appropriate responsible party as defined in Massachusetts General
Law (M.G.L.) c. 21E. As such the following language is provided for informational purposes only.
M.G.L. c. 21E, Section 5 makes the following parties liable to the Commonwealth of Massachusetts for
response action costs: current owners or operators of a site from or at which there is or has been a
release/threat of release of oil or hazardous material; any person who owned or operated a site at the time
hazardous material was stored or disposed of; any person who arranged for the transport, disposal, storage
or treatment of hazardous material to or at a site; any person who transported hazardous material to a
transport, disposal, storage or treatment site from which there is or has been a release/threat of release of

such material; and any person who otherwise caused or is legally responsible for a release/threat of
release of oil or hazardous material at a site.
This liability is "strict", meaning it is not based on fault, but solely on a party's status as an owner,
operator, generator, transporter or disposer. It is also joint and several, meaning that a party may be liable
for all response action costs incurred at the site, regardless of the existence of any other liable parties.
The MCP requires Responsible Parties to take necessary response actions at properties where there is or
has been a release or threat of release of oil and/or hazardous material. If Responsible Parties do not take
the necessary response actions, or fail to perform them in an appropriate and timely manner, the MA DEP
is authorized by M.G.L. c. 21E to have the work performed by its contractors. By taking such actions, a
Responsible Party can avoid liability for response action costs incurred by MA DEP and its contractors in
performing these actions, and any sanctions which may be imposed for failure to perform response
actions under the MCP. Refer to M.G.L. c. 21E for further information regarding liabilities.
The site shall not be deemed to have had all the necessary and required response actions taken unless and
until all substantial hazards presented by the site have been eliminated and a level of No Significant Risk
exists or has been achieved in compliance with M.G.L. c. 21 E and the MCP.
