November 15 1983 Mr. Daniel Long, Town Clerk David and Marie Law Town Office Building 82 Mifflin Drive North Andover, Mass. 01845 Petition No. 64-'83 Dear Mr. Long: The Board of Appeals held a public hearing on Monday evening, November 14, 1983 upon the application of David and Marie Law. The hearing was advertised in the North Andover Citizen on October 27 and November 3, 1983 and all abutters were notified by regular mail. The following members were present and voting: Frank Serio, Jr., Chairman; Richard J. Trepanier, Esq., Clerk; William J. Sullivan; and Associate Members Walter F. Soule and Raymond A._Vivenzio. The petitioner seeks -a variance'from the provisions of Section 7, Paragraph 7.3 and Table 2 of the Zoning By Law so as to permit relief from the side setback requirement to allow the continued existence of a dwelling which does not meet the side setback requirement on premises located at 82 Mifflin Drive. The petitioners testified through counsel that the dwelling was constructed in 1959 and when a plot plan was recently required by the bank for mortgage purposes, the violation was discovered. Upon a motion made by Mr. Vivenzio and seconded by Mr. Trepanier, the Board voted unanimously to grant the variance as requested. The Board finds that Section 10.4 of the Zoning By Law has been satisfied. Specifically, the Board finds that the location of the dwelling on the lot for several years with its slight devia- tion from the existing requirements constitutes a hardship to the petitioner. Said variance may be granted without nullifying or substantially derogating from the intent and purpose of the Zoning By Law.
