There is no correspondence from the owner to the Building. Department in regards to the alleged work or lack thereof. There is no permit application on file for any type of work be it electrical, plumbing, gas or building. The Building Department does have a copy of Mr. Graves construction supervisors license on file although it has expired in April of 2004,it will have his last known address to this departments knowledge, a copy of which is attached with this letter.. Accordance with MGL Chanter 142A I feel that Mr. Graves violated the laws under MGL Chanter 142A and "abandoned and failed to perform ... the project undertaken by a registered contractor... and the deposit exceeded the greater of one-third of the total contract price and/or the actual cost of any materials advance of the commencement of work..." To Whom It May Concern: The following is a chronological sequence of events in my dealings with Mr. Steven Graves (contractor from Wakefield, MA): At the end of October 2004 I talked with my sister Carol Grace with reference to work that she and her husband were having done on their home in Wakefield, MA. by Mr.Graves, a former neighbor and friend. Because she knew I also needed some work done on my home, she asked me if I was interested in talking with Mr. Graves with reference to my home repairs. I agreed to talk with him. • Mr. Graves called, set up an appointment to meet at my home, and we discussed a list of the following home repairs: - the purchase and installation of two new storm doors - the purchase and installation of a new Anderson kitchen window - the purchase and installation of 13 floor -to -ceiling screens on a back porch - the repair of two window sashes, and a few other small repairs on my home • Two days later, November 2, 2004, Mr. Graves returned to my home with a "rough" estimate as to the price of the jobs. He did NOT have anything to hand me in writing. He did, however, have in his words "a rough estimate that would be typed up by his wife this evening." Because he wanted to start the job as soon as possible, he suggested that I give him a check for ordering the doors and windows that evening. According to Mr. Graves, he could order the doors, window and screens the next day. At this point I gave him a check for $600.00 (Please see copy of check # 4281 attached) -2 - Because of his long-standing relationship (20 years) and prior work done by Mr. Graves for my sister and brother-in-law, I felt comfortable that he was trustworthy. I would have no reason to think otherwise. At this point I hired him to do my house repairs on my home at 83 Penni Lane, North Andover, MA. Because six evenings earlier he mentioned that he needed the money to start the job, he suggested that cash would also work for him. The faster I got the money to him, the faster he could start the job. He returned to my home stating that he had priced out the screens and doors and if I could do cash, he would order all the doors, windows, and screens. On November 8th, 2004 I handed him, at his request, $3,000 in cash. (Please see receipt of cash payment attached) • Four weeks later, (December 8th) I still had not heard from Mr. Graves. I called his home and left several messages on his answering machine. I still had NOT RECEIVED a call from Mr. Graves. However, I received a call from his nephew who stated that he would remove the old screens. At this point, I anticipated the installation of new screens before the snow began to fly. This was not the case. Another call went onto to Mr. Grave's answering machine with my concerns of the impending snowstorm. Prior to Christmas the "quick fig" was to wrap the porch in plastic. To date, this is the last work that has been done by Mr. Graves. • Several more calls have gone unanswered! I believed Mr. Graves to be trustworthy and honest. However, it would appear I made a huge mistake!! This was MY first attempt at hiring out a job. Because I am a recent widow, (but after 28 years I believed I learned from my very astute and wise husband) I thought I proceeded with this transaction cautiously! I specifically told Mr. Graves I was nervous and asked him "should I trust you?" He stated that "I have known your sister for the last 20 years and that should speak for itself." I unfortunately was way too trusting! In the future, I will be hard pressed to trust other contractors who request cash in advance without a detailed contract. This was MY mistake and I will NEVER be taken for a fool again. • During this time I contacted the North Andover police of my problem. They suggested I take it to. small claims court. After contacting small claims court, they stated they only handle up to $2000 in damages. • On April 19, 2005, I sent Mr. Graves a certified letter (Please see letter attached) • On April 29, 2005 I received a certified letter from Mr. Graves. (Please see letter attached). (I should add that he NEVER "left a message" at my home as he indicates in his letter) • On the evening of May 2, 2005, I called Mr. Graves' home and without reaching him personally, I left a message acknowledging his letter and I requested that he "please get back to me." To date, May 31, 2005 there has been NO further response from Mr. Graves. I -3 - find it hard to believe that Mr. Graves' "schedule has been change many times over to accommodate that needs of customers that have had emergencies." Isn't it a common courtesy to return a phone call? I feel that Mr. Graves violated the laws under MGL Chapter 142A and "abandoned and failed to perform ... the project undertaken by a registered contractor... and the deposit exceeded the greater of one-third of the total contract price and/or the actual cost of any materials advance of the commencement of work..." The fact that Mr. Graves supposedly had schedule changes was unbeknownst to me. He NEVER called to let me know. I would appreciate your assistance in resolving my difficult, costly, and emotionally upsetting situation. I thank you in advance for your help. (P.S. Mr. Graves has still not contacted or started work for my sister.) After several calls to you, I finally ended up getting a return call from Kevin, your nephew. He came to the house a removed the screens and wrapped the porch in plastic. Well. as you know the rest is history. I still have not heard from you. I am terribly upset and disappointed in you. I unfortunately was way too trusting and believed you! Therefore, if I don't hear from you by May 1St with a payment schedule, I will be turning this matter over to my lawyer (whom of which suggested that I file this legal complaint against you a long time ago). I was quite surprised to receive it since based on your conversation with Keith and my message left at your home, we are scheduled to work at your home next week. I am sympathetic with your concern over the schedule changes. However, due to the extreme weather we have had this winter, my schedule has been changed many times over to accommodate the needs of customers that have had emergencies. I would have done the same for you if you were in an emergency situation. I have not had any other complaints regarding my schedule. I take extreme exception to your insinuation of dishonesty on my part. I feel that my only mistake was bein, trusting and not asking you to sign a contract because of your relationship to Carol V I also feel that I have legal recourse since you "hired out the job" that we had agreed I would do. I do not choose to go that route, as I do not like to have bad feelings with any customers. I am sorry that you are disappointed and would have liked to have done your work for you and avoided all of these bad feelings.
