Dear Mr. Long:
The Board of Appeals held a public hearing on Monday evening,
June 8, 1981 upon the application of Richard M. Nathanson, trustee
of Marc Realty Trust. The hearing was duly advertised in the North
Andover- Citizen on May 21 and 28, 1981, and all abutters were
notified by regular mail. The following members were present and
voting: Frank Serio, Jr., Chairman; Alfred E. Frizelle, Esq.,
Vice Chairman; Richard J. Trepanier, Esq., Clerk; Augustine W.
Nickerson; and Maurice S. Foul ds
The petitioner seeks a Special Permit under Section 9, Par. 9.1
of the Zoning By Law to enable the expansion of a lawful non-
conforming use and structure on the premises located at 82-88 Main
Street.
Attorney John J. Willis, Jr., on behalf of the petitioner, intro-
duced evidence showing that he proposed to add two apartments to
the four existing units. Parking for the units would be located
in the rear, with nine parking places. No exterior changes would
be made to the property.
An abutter testified that the existing driveway is extremely narrow
and that additional vehicles would aggrevate the existing vehicle
problem on the premises.

Upon a motion made by Mr. Frizelle and seconded by Mr. Nickerson,
it was voted unanimously to deny the request for a Special Permit.
The Board finds that the petitioner failed to meet the requirements
set forth in Section 10.31 of the Zoning By Law.
Specifically, the Board finds that the use as proposed will be a
serious hazard to vehicles and pedestrians on Main Street. Further,
that the site with limited parking facilities is not an appropriate
location for such use.

Dear Mr. Serio:
It is my understanding the Mr. Richard Nathanson wishes to add two
apartments to his building at 86 Main Street and to also make some
improvements to the exterior of the building. Providing that the
additional apartments meet the requirements of the Massachusetts
Building Code, the addition of these units is not in conflict with
our plans for the downtown area. As I am sure you know, there is a
critical shortage of affordable rental housing in North Andover.
I hope that Mr. Nathanson will contact me before he starts any
exterior renovations so that our Program Architect can review his
plans. We do not wish to place any unnecessary restrictions on
what Mr. Nathanson does, but we would like to provide him with
Whatever assistance we can with his renovation plans.

follows: (must be stated in detail)
The over -all -use of -the building will not be changed. The exterior structure
and appearance will remain essentially the same. Off-street parking will be
provided for the proposed tenants, therefore there will not be an adverse
effect on the neighborhood nor will there be created -any nuisance or serious
hazard to vehicles or pedestrian s,. the use of the building is within the uses
allowed in a general -business zone and therefore will be substantial harmony
with the general purpose and intent of the by-law, and is an,appropriate
location for such uses; and will not be more detrimental than the presently
g use.
