The Board of Appeals held a public hearing on Tuesday evening, June 13, 1989 upon
the application of Bessie A. Daher requesting a Special Permit from the requirements
of Section 4, Paragraph 4.121(17) of the Zoning Bylaw so as to permit construction
of a family suite on the premises located at 841 Chickering Road. The following
members were present and voting: Frank Serio, Jr., Chairman, Raymond Vivenzio, Acting
Clerk, Walter Soule, Anna O'Connor and Louis Rissin.
The hearing was advertised in the North Andover Citizen on May 25, 1989 and June 1,
1989 and all abutters were notified by regular mail.
Upon a motion made by Mr. Vivenzio and seconded by Mr. Soule, the Board voted,
unanimously, to GRANT the Special Permit as requested, subject to the following
conditions:
1. Plans be modified to the satisfaction of the Building Inspector
to qualify for the 257 bylaw.
2. The premises be occupied by Bessie A. Daher.
3. The Special Permit shall expire at the time Bessie A. Daher
ceases to occupy the family suite.
4. The Special Permit shall expire at the time the premises are
conveyed to any person, partnership or corporation.
5. The applicant, by acceptance of the Certificate of Occupancy issued
pursuant to the Special Permit, grants to the Building Inspector or
his lawful designee the right to inspect the premises annually.
The Board finds that the petitioner has satisfied the provisions of Section 10,
Paragraph 10.31 of the Zoning Bylaw and the granting of this Special Permit in
particular will not derogate from the intent and purpose of the Zoning Bylaw nor
will it adversely affect the neighborhood.

Every application for action by the Board shall be made on a form
approved by the Board. -These-forms.shall be furnished by the clerk
upon request. Any communication purporting to be an'application
shall be treated as mere notice of intention to seek relief until
such time as it is made on the official application form. All in-
formation called for by the form shall be. furnished by the applicant
in the manner therein prescribed.
Every application shall be submitted. with a list of "Parties in
Interest" which list shall include .the petitioner, abutters, owners
of land directly opposite on any public or private street or way,
and abutters to the abutters within three hundred feet of the property
