RE: VIOLATION of the Massachusetts Wetland Protection Act (M.G.L. C.131
S. 40) and The North Andover Wetlands Protection Bylaw (C. 178 of the
Code of North Andover).
Dear George:
This Department visually observed an "alteration" located adjacent to the Osgood Hill
Trail entrance. The term "alteration" includes but is not limited to, the placement of fill,
excavation or regrading (Section II (2)(b); the destruction of plant life (Section II (2)(c),
and any activities or work which cause alteration of wildlife habitat (Section II (2)(f) of
The North Andover Wetland Regulations). The subject violation consists of yard waste
(brush, trees, leaves, grass clippings, etc.) within the wetland resource area on Town
property. This "fill" is being inappropriately deposited and needs to be removed.
Wetlands and their Buffer Zones are not a desirable location to deposit such material.
Staff from this Department have contacted you on several occasions dating back to
November 10, 1999 in an attempt to have the yard waste removed. It was visually
observed on the date of this letter that the debris pile has not been completely removed.
Please be aware that according to the North Andover Wetlands Protection Bylaw, Section
178.10 (A)(Page 8) "Alteration of any wetland resource area identified in Section 178.2
of this Bylaw" is punishable by $100 per day, "Depositing any refuse, debris, yard waste
or construction material in a wetland or water body" is punishable by $100 per day, and
"Any violation of any section of this Bylaw that occurs in the Lake Cochichewick
Watershed" is punishable by $100 per day, potentially totaling $300 per day. Each day
or portion thereof during which a violation continues shall constitute a separate offense.
Attempts have been made and some of the debris has been removed, but it is the opinion
of this Department that not enough of the debris pile has been removed. This Department
mandates that you remove the entire debris pile to the satisfaction of the North Andover
Conservation Commission (NACC) or Agent thereof by no later than February 14•
2000. Failure to comply with the above mentioned deadline will result in additional
penalties and/or fines.
