Andover, MA 01845 *. * TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS Petition: #128-90 DECISION Ja, ILI I0 u2Il—!'A The Board of Appeals held a public hearing on Tuesday evening, January 8, 1991, continued from the October, November and December meetings, upon the application of Merrimack Valley Gymnastics requesting a Special Permit from the requirements of Section 4.131, Paragraph 9 and Section 4.11.1 and as a Party Aggreived from the Zoning Bylaw so as to permit operation of a gymnastic facility in an I-1 zoning district on the premises located at 85 Flagship Drive. The following members were present and voting: Frank Serio, Jr., Chairman, Walter Soule, Clerk, Anna O'Connor and Louis Rissin. The hearing was advertised in the North Andover Citizen on September 26, 1990 and October 3, 1990 and all abutters were notified by regular mail. Upon a motion made by Mr. Soule and seconded by Mr. Rissin, the Board voted, unanimously, to DENY the Special Permit and Party Aggreived as requested. The Board finds that this is not a proper location for a children's gymnastic school because of the many industries using chemicals in this area. (508) 686-3812 In response to your letter of October 15, 1990 regarding the review of the building inspector's decision and the Special Permit of Merrimack Valley Gymnastics, I totally support the decision of the building inspector. The Fire Department is concerned with the safety of all the users of the industrial area. The mixing of the occupancies as proposed increases the life safety hazard. The department has been consistently opposed to such proposals since the operation conducted in such areas deal with a variety of chemidals on a regular basis. Any fire or emergency involving those occupancies, or any emergency occuring for a transportation accident, increases the exposure problem to the area. Persons who work with or in this environment should be knowledgeable and indeed have a "right to know" about these hazards. The trans- itory nature of the proposed project does not provide each future user with such knowledge. In order to provide for the safety of the users I would recommend the decision of the building official not be reversed nor a special permit granted. These matters have been brought up in thpast and I have proposed a strong occupancy permit system be imp l&ented with appropriate penalties for non-compliance. "SMOKE DETECTORS SAVE LIVES" 2. I ask your understanding for our needs in serving the public particularly when first arriving units pull up to an emergent scene at an industrial building and suddenly find the building also includes a variety of processes including a gymnastic school, some or none of which may have notified us of their presence. STANLEY CHIEF November 6, 1990 Mr. Frank Serio, Jr., Board of Appeals Town of North Andover Dear Mr. Serio: Nvr� A011% Office of (POLICE CHIEF OF POLICE NORTH ANDOVER, MASSACHUSETTS PHONE: 683-3168 Chairman The Police Department has looked closely at the Merrimack valley Gymnastics location at 85 Flagship Drive. Police personnel did evaluate traffic flow, ease of egress and ingress and the types of motorized and pedestrian traffic that would frequent the area. It was found that the only area of possible concern would be the mix of tractor trailer trucks that are loading and unloading at the same building, with other vehicles and possible pedestrian traffic generated by individuals entering and leaving the gymnastics center. Unfortunately there is no hard evidence that would indicate a problem would materialize. They apply some chemicals for the control of ants, termites, mice, etc. at the locations of their customers. Waltham stores all materials in their original containers and performs no mixing, blending or other activity that could cause any type of chemical spill. American Micro-Tronix (Amitron) manufactures thick film microelectronic substrates. They use very small amounts of chemical compounds in the manufacture of their products, but they do not mix, blend or otherwise handle quantities of chemicals that would result in any type of chemical spill.
