RE: Tree cutting within a protected wetland resource area
This is a follow up letter pertaining to your request and our subsequent site inspection to cut 1 rotting tree in
close proximity of your home at the above referenced location. Normally, the Conservation Commission does
not allow any cutting or alteration within a wetland resource area under the state Wetlands Protection Act
(M.G;Ll C-1.345 ) or within 25 feet of a Netland source area under the North Andover#etlands
Protection Bylaw (C. 178 of the Code of North Andover). However, the Conservation Department will allow
the cutting of this 1 -rotting tree due to safety concerns under the following conditions:
• The number of trees to be cut shall be limited to the 1 rotting tree as discussed.
• No further hutting or alteration shall occur wit the wetland resource area or mvithinthe 25-feot-no-
disturbance' area.
• Access for the cutting shall be at a location upgradient to the resource area (equipment for the cutting
shall not be used within the resource area).
• A crane or qimilar type of equipment shall -be zsed.
• The tree shall not be cut below the existing rotted cavity. This will ensure that the rotted cavity remains
to provide and/or sustain wildlife habitat. Under no circumstances shall the tree be stumped.
• Thp cut tree and associated limbs/debris shall be removed from the site and disposed of properly.
• The Conservation Department shall'be not AV=zompletion of the cutting -activities.
• Upon this notification, the department may require an inspection to ensure that the cutting activities were
performed in compliance with the above conditions.
Please assure that your contracted tree service performing the work is fully aware of and will comply with the
conditions as noted above. Your anticipated .cooperation is appreciated.
