described in the ORDER LETTER have been corrected and that there

following issue.
The Board of Health remains concerned over the lack of
ventilation in the Century 21 offices. The Dept. of Occupational
Health requires adequate ventilation for all employees. To avoid
future problems we feel it necessary for you to address this
issue with a qualified HVAC technician. We expect a response, and
recommendation from a qualified person within thirty(30) days
from receipt of this letter.
A copy of this letter is being sent to the person(s) who
made the complaint. If the complainants have any questions
concerning the Health Departments determination of partial
compliance, they are advised to call or write the Board of Health
within ten (10) days from the date of this letter.

On Wednesday, September 14, 1994, a site inspection was
conducted of your property at 85 Main Street, North Andover, MA.
The inspection revealed violations under the authority of MGL 111
& 122 as follows:
Broken sewer line in rear basement - leaking
liquid on debris.
Excess rubbish, including flammables stored.
Broken window to open door allowing access to
animals.
You are hereby ORDERED to correct the above noted conditions
within seven (7) to ten (10) working days from the date of this
letter.
Please notify the Board of Health Office if you need
additional time and/or what your arrangements will be with
contracted persons, i.e. plumber.
Thank you for your cooperation in this matter.

I. TIE; PAR'T'IES
1. The Department of Environmental Quality Engineering [the "Department"] is
a duly- constituted agency of the Commonwealth of Massachusetts. Its
principal office is located at One Winter Street, Boston, Massachusetts
and it operates a regional office at 5 Commonwealth Avenue, Woburn,
Massachusetts.
2. Mrs. Nancy Killehea is the owner of the property located at 15 Beech
Street in North Andover, Massachusetts.
3. Hanson Heating Service, Inc. is a Massachusetts corporation with a place
of business at 85 Main Street in North Andover which has engaged in
demolition, renovation, and/or asbestos removal in the basement of 15
Beech Street in North Andover, Massachusetts. Hanson Heating Service,
Inc., is not currently a licensed asbestos abatement company.
II. S'T'ATEMENT OF FACTS AND LAW
4. The Department implements and enforces the Massachusetts Clean Air Act
Statute relative to asbestos, G.L. c. 111, Section 142 A -J G.L. c. 21E,
and the regulations promulgated pursuant to the statute (310 CMZ 7.00).
5. During April of 1988 Hanson Heating Service, Inc. commenced the removal of
radiators and asbestos insulated pipes from 15 Beech Street in North
Andover without notifying the Department in writing. This constitutes a
condition of noncompliance with 310 CMR 7.15(1)b (Notification).
6. On July 12, 1988 Department personnel responded to a complaint at 15 Beech
Street in North Andover.
7. On July 12, 1988 and July 29, 1988 Department personnel observed dry,
visible, asbestos -containing material in piles on the floor, on a window
pot, and on rafters in the basement of 15 Beech Street in North Andover.
In addition, Department personnel observed approximately 30 feet of pipe
insulal:ed with asbestos outside the building at 15 Beech Street in North
Andover.. Mrs. Hillehea informed Department personnel that employees of
Hanson Heating Service, Inc. had removed these pipes from the basement of
15 Beech Street and placed them outside the building. This constitutes a
condition of noncompliance with 310 (QTR 7.15(1)(C) and 310 CMR 7.15(1)(e)
- Failure to containerize while wet.

8. Uncontained, damaged, asbestos -containing material outside the building at
15 Beech Street in North Andover constitutes a release or threat of release
of a hazardous substance (asbestos) to the ambient air that could cause or
contribute to a possible imminent health problem in the surrounding
neighborhood. Failure to report the release or threat of release of a
hazardous substance to the Department constitutes noncompliance with
Chapter 21E Section 7 - Release of a Hazardous Substance.
I:II.DISPOSITION AND ORDER
For the reasons stated above the Department hereby ORDERS the following. 'Phis
ORDER shall be binding on Hanson Heating Service, Inc. or on its successors, heirs
and assigns. Hanson Heating Service, Inc. shall not violate this ORDER and shall
not allow or surfer its employees, agents, or contractors to violate this ORDER.
Vursuant to General Laws, Chapter 21A, Section 16 and 310 CM 5.00 the Department
hereby determines that the deadlines set forth below constitute reasonable time for
coming into compliance with the provisions cited above.
9. Hanson Heating Service, Inc. or its responsible designee shall, immediately
upon receipt of this Order, cover and label the asbestos -containing
material on pipes outside 15 Beech Street in North Andover.
10. Hanson heating Service, Inc. or its responsible designee shall submit a
written proposal for removal and clean-up of the asbestos -containing
material in the basement of 15 Beech Street in North Andover, Massachusetts
to the Department within five (5) days of receipt of this Order. Hanson
Heating Service, Inc. shall not commence any asbestos removal or clean-up
activities until the Department has reviewed and approved said proposal in
writing.
11. Hanson Heating Service, Inc..or its responsible designee shall not commence
asbestos removal and clean-up activities at 15 Beech Street in North
Andover, Massachusetts prior to a Department inspection which will confirm
compliance with the proposal, if approved by the Department. During the
inspection the Department reserves the right to approve or disapprove of
the commencement of asbestos removal activities in the buildings or
sections of the buildings located at 15 Beech Street in North Andover,
Massachusetts.
12. Hanson Heating Service, Inc. or its responsible designee shall submit
copies of landfill charges for disposal of all asbestos waste material
removed from 15 Beech Street in North Andover, Massachusetts along with the
dates and number of loads, to the Department within 15 days from the date
when the asbestos leaves the site.
13. Hanson Heating Service, Inc. shall notify the Department in writing of all
work which it is currently, performing in the Commonwealth within five (5)
days of receipt of this Order.
14. Hanson Heating Service, Inc. shall properly notify the Department of any
future asbestos removal work it performs in the Commonwealth of
Massachusetts via an appropriate notification form (one copy enclosed).

15r'Iianson Heating Service, Inc. shall comply with all applicable Department
Regulations on all future demolition, renovation, and/or asbestos removal
sites.
Questions regarding the contents of this ORDER shall be directed to Mr. Weiscopf
S. Felly, Metropolitan Boston/Northeast Region, 5 Commonwealth Avenue, Woburn,
Massachusetts 01801.
Hanson Ideating Service, Inc. is advised that if it fails to comply with this
ORDER, G.L. c. 111, Section 142a & B provides for penalties of up to $5,000.00 for
each "first" offerise and not more than $10,000.00 for each day during which each
violation covered by this ORDER continues or is repeated. Hanson Heating Service,
Inc. is advised that violations of G.L. c. 21E, Section 7 provides for penalties of
tip to $100,000.00 or imprisonment for up to 20 years or both, for each day during
which each violation covered by this ORDER continues or is repeated.
Hanson Heating Service, Inc. is further advised that if it fails to comply with
the ORDER G.L. c. 21A, Section 16 provides for civil administrative.penalties of up
to $25,000.00 for each day after the issuance of this ORDER during which each
violation covered by this ORDER continues or is repeated.
Hanson Heating Service, Inc. is hereby notified that it may request an
adjudicatory hearing on this ORDER. The request must be made in writing within 10
days from the date (postmarked) of the ORDER. The request must clearly and
concisely state every point of fact and law Hanson Heating Service, Inc. intends to
raise in the adjudicatory proceeding. The request must be addressed to: Docket
Clerk, Office of General Counsel, Department of Environmental Quality Engineering,
One Winter Street - 3rd Floor, Boston, Massachusetts 02108. A copy of the request
should be sent to DEQE, Division of Air Quality Control, 5 Commonwealth Avenue,
Woburn, Massachusetts 01801.

9. Hanson Heating Service, Inc. or its responsible designee shall, immediately
upon receipt of this Order, cover and label the asbestos -containing
material on pipes outside 15 Beech Street in North Andover.
10. Manson Beating Service, Inc. or its responsible designee shall submit a
written proposal for removal and clean-up of the asbestos -containing
material in the basement of 15 Beech Street in North Andover, Massachusetts
to the Department within five (5) days of receipt of this Order. Hanson
IIeating Service, Inc. shall not commence any asbestos removal or clean-up
activities until the Department has reviewed and approved said proposal in
11. Manson Ideating Service, Inc. or its responsible designee shall not commence
asbestos removal and clears -up activities at 15 Beech Street in North
Andover, Massachusetts prior to a Department inspection which will confirm
compliance with the proposal, if approved by the Department. During the
inspection the Department reserves the right to approve or disapprove of
Lhe commencement of asbestos removal activities in the buildings or
sections of the buildings located at 15 Beech Street in North Andover,
Massachusetts.
12. Manson Heating Service, Inc. or its responsible designee shall submit
copies of landfill charges for disposal of all asbestos waste material
removed from 15 Beech Street in North Andover, Massachusetts along with the
dates and number of loads, to the Department within 15 days from the date
when the asbestos leaves the site.
13. Hanson Heating Service, Inc. shall notify the Department in writing of all
work which it is currently. performing in the Commonwealth within five (5)
days of receipt of this Order.
14. Hanson Heating Service, Inc. shall properly notify the Department of any
future asbestos removal work it performs in the Commonwealth of
Massachusetts via an appropriate notification form (one copy enclosed).

15. Hanson [leafing Service, Inc. shall comply with all applicable Department
Regulations on all future demolition, renovation, and/or asbestos removal
sites.

Hanson Ileating Service, Inc. is advised that if it fails to comply with this
ORDFR, G.L. c. 11.1, Section 142a & B provides for penalties of up to $5,000.00 for
each "f'irst" offense and not more than $10,000.00 for each day during which each
violation covered by this ORDER continues or is repeated. Hanson Heating Service,
Inc-,. is advised that violations of G.L. c. 21Ef Section 7 provides for penalties of
up to $100,000.00 or imprisonment for up to 20 years or both, for each day during
which each violation covered by this ORDER continues or is repeated.
Hanson heating Service, Inc. is further advised that if it fails to comply with
the ORDER G.L. c. 21A, Section 16 provides for civil administrative penalties of up
Lo $25,000.00 for each day after the issuance of this ORDER during which each
violation covered by this ORDER continues or is repeated.
Hanson Ileating Service, Inc. is hereby notified that it may request an
adjudicatory hearing on this ORDER. The request must be made in writing within 10
clays from the (late (postmarked) of the ORDER. The request must clearly and
concisely state every point of fact and law Hanson Heating Service, Inc. intends to
raise in the adjudicatory proceeding. The request must be addressed to: Docket
Clerk, Office of General Counsel, Department of Environmental Quality Engineering,
One Winter Street - 3rd Floor, Boston, Massachusetts 02108. A copy of the request
should be sent to DEQE, Division of Air Quality Control, 5 Commonwealth Avenue,
Woburn, Massachusetts 01801.
