The legal notices were published in the Eagle Tribune on September 27 & October 4, 2004 and all abutters were notified by mail. The following voting members were present: Ellen P. McIntyre, Richard J. Byers, Thomas D. Ippolito, and Richard M. Vaillancourt. The following non-voting member was present: Joseph D. LaGrasse. Upon a motion by Richard J. Byers and 2°a by Richard M. Vaillancourt, the Board voted to DENY the Special Permit to extend a pre-existing, non -conforming structure on a non -conforming lot. The Board finds that the applicant's plan is not able to provide sufficient driveway width as requited by 8.1.7 (Off -Street Parking) of the North Andover Zoning Bylaw for emergency vehicles to -respond to the proposed handicap - accessible third story dwelling unit. Food Day: All food shall be protected from customer handling, coughing, or sneezing by wrapping, sneeze guards or other effective barriers. Food Preparation: All cooking and serving areas shall be protected fiom contamination. BBQ areas shall be roped offor eammise segregated from the public. PERSONNEL. Hand washing: A minimum of a two gallon insulated container with a spigot and a basin, soap and dispensed paper towels shall be provided for hand washing. The miner shall be filled with hot water. The particular use proposed for the land or structure: I wish to add a third floor handicap access apartment I wish to ask a variance on the side lot set back to accommodate a shed building that will provide space for heating, hot water and machinery systems to serve the new apartment. In the old central business district the buildings are very close together and most are three stories. This update to 85 Main St. will be attractive and allow this location to blend in with the neighbor hood. In regard to the side set back I only need a five foot extension to the sixty feet or so of the pre existing building on the lot line. This should not impose on our neighbor. 6. I currently have a serious problem with water damage to the interior from leaks through the flat built up roof These leaks have been repaired many times but in too short a time the leaks start again. On the front portion of the building there is a very old very steep shingle roof This roof also leaks and damage is spreading below. It is my hope to get a new roof in place before the wet snow and rains of winter. Both of the steps and porch entrance do not meet code requirements.
