Dear Mr. Grasso;
Upon information .received by the. Architectural Access Board, the facility referenced.above has been reported to
.violate M.G.L., c. 22, § 13A and the Rules and Regulations (CMR 521) promulgated thereunder. Reported violations,
include the following items, are referenced to the 20 96 Rules and Regulations:
Section: Reported violation:
23.2.2 One in every eight accessible spaces, but not less than one, shall be van accessible, See 521 CMR 23.4.7.
23.4.1 Width: Accessible parking spaces shall be at least eight feet (2438mm) wide, plus the access aisle.
23.4.4 Surface: Spaces shall have a uniform, paved or hard packed smooth surface.
23.4.5 Delineation: Accessible spaces shall be marked by high contrast painted lines or other high contrast
delineation.
23.4.6b Access aisles adjacent to accessible spaces shall be five feet (5'= 1524mm) wide minimum, except
adjacent to van accessible spaces the access aisle shall be a minimum of eight feet (.8'= 2438mm) :aide.
23.4.6d Access aisles shall be level with surface slopes not exceeding 1:50 (2%) in all directions.
23.6.4 Such signs shall be permanently located at a height of not less than five feet (1524mm), nor more than eight
feet (2438mm) to the top of the sign.
23.7.1 Wherever a passenger loading zone or parking area is provided, an accessible route to an
accessible entrance is required.
Under Massachusetts law, the Board is authorized to take legal action against violators .of its regulations, including but
not limited to, an application for a court order preventing the further use of an offending facility. The Board also has the
authority to impose fines of up to $1,000.00 per day, per violation, for willful noncompliance with its regulations..

regulations. Please note the current sections may be different from the sections that are cited above. Unless the Board

The Board of Appeals held a regular meeting on Tuesday, April 14
continued to May 12 and June 9, 1992 upon the application of
Parthenon Development Group/Elm Service Corp. requesting a
variation of Section 8.3 and 8.5 of the Zoning Bylaw so as to
permit relief of a 50 foot perimeter no build zone, and frontage,
dimensional and set back requirements on the premises located at
Chestnut Street. The following members were present and voting:
Frank Serio, Jr., Chairman, Walter Soule, Clerk, Anna O'Connor
and John Pallone.
The hearing was advertised in the North Andover Citizen on April
1 and 8, 1992 and all abutters were notified by regular mail.
Upon a motion made by Mrs. O'Connor and seconded by Mr. Soule the
Board voted unanimously to GRANT the variances as per plan of
North Andover Estates dated April 21, 1992 as revised May 12,
1992 by Thomas E. Neve Associates, Inc.
The Board finds that the granting of these variances is in
harmony with the general purpose of Section 10.4 of the North
Andover Zoning Bylaw and will not adversely affect the
neighborhood or derogate from the intent of the Bylaw. The Board
finds that owing to slope and the topography of this parcel of
land, but not affecting the zoning district in general, a literal
enforcement of the provisions will involve substantial hardship
to the petitioner. Relief can be granted without derogating from
the public good. The petitioner will be required to adhere to
the erosion control requirements of the North Andover
Conservation Commission, Planning Board and Zoning Enforcement
Officer. In addition, the phased development of this proposal
will minimize the adverse affects of hillside development.

Thank you for taking the time to speak with me today about the plan review and renovation
of the Dunkin Donuts at 744 Turnpike Street. This correspondence is a follow-up to the items
that were discussed.
1) The three bay sink identified on the plan will be as indicated. The present three bay
sink will be replaced with a new three bay sink with drain boards on both sides.
2) The hand sink near the sandwich making area will be identified as a hand wash only.
equipped with a towel and a soap dispenser.
3) The small sink on the opposite end will not be equipped with the soap and towels and
will be identified for other uses, as there is a hand sink with a reasonable distance for
hand washing
4) Coving will be installed on all 90' floor edges where possible, not only on outside
walls
5) A unit for the storing of personal employee items will be incorporated into the plan
6) An existing screen door will be repaired
