The following members were present and voting: Frank Serio, Jr., Chairman, Walter Soule, Clerk, Anna O'Connor and John Pallone. The hearing was advertised in the North Andover Citizen on April 1 and 8, 1992 and all abutters were notified by regular mail. Upon a motion made by Mrs. O'Connor and seconded by Mr. Soule the Board voted unanimously to GRANT the variances as per plan of North Andover Estates dated April 21, 1992 as revised May 12, 1992 by Thomas E. Neve Associates, Inc. The Board finds that the granting of these variances is in harmony with the general purpose of Section 10.4 of the North Andover Zoning Bylaw and will not adversely affect the neighborhood or derogate from the intent of the Bylaw. The Board finds that owing to slope and the topography of this parcel of land, but not affecting the zoning district in general, a literal enforcement of the provisions will involve substantial hardship to the petitioner. Relief can be granted without derogating from the public good. The petitioner will be required to adhere to the erosion control requirements of the North Andover Conservation Commission, Planning Board and Zoning Enforcement Officer. In addition, the phased development of this proposal will minimize the adverse affects of hillside development. r ► This decision hereby includes the Planning Board Orders of.. Conditions: * Special Permit dated, June 4, 1992, issued by the Planning Board. * Definitive Subdivision dated June 5, 1992, issued by the Planning Board.
