The legal notice was properly advertised in the North Andover Citizen on December 14 and December 21, 1994 and all parties of interest were duly notified. The following members were present: Richard Nardella, Chairman, Joseph Mahoney, Vice Chairman, Richard Rowen, Alison Lescarbeau and John Simons. The petitioner was requesting a special permit for the construction of a common driveway to be used by Lot 3AA and Lot 4A Winter Street. Mr. Rowen read the legal notice to open public hearing for access other than over legal frontage and for a common driveway Ms. Colwell questioned the ability of the applicant to create a Form A lot because of the lack of practical access. Mr. Simons agreed with Ms. Colwell on interpretation of Form A. Suggested that the Board look at cul-de-sac plan. May want to review the site as a small subdivision. Ms. Colwell stated that she would rather treat it as a common driveway with revised lot lines. Richard Rowen: could not support Form A plan before the Planning Board currently, but could support it with a revised lot line and treat it as a common driveway. Richard Nardella: wants to limit common drive for two homes only. Richard Rowen: with revised lot line may be able to get a permit to.cross the wetland. Joseph Mahoney: wants to have a site visit, no access to lot 4A, need to look at it as a subdivision. Richard Nardella: Recommends that Planning Board wait until TRC has reviewed the project. Mr. Rosati has designed driveway with retaining walls and 81/2% and 12% grades/ Susan Parker 464 Foster Street, concern about drainage and the disrupting of the road. Kathleen Bradley Colwell: Ask TRC to review drainage calculations on this site. Mr. Rosati has the drainage calculations for this site -- water goes under Winter Street behind the homes and down to Mosquito Brook. Motion to continue made by John Simons, seconded by Richard Rowen. Mr. Rosati agree to withdraw Form A plan. The Planning Board held a regular meeting on January 17, 1995. The following members were present: Richard Nardella, Chairman, Joseph Mahoney, Vice Chairman, Alison Lescarbeau, Richard Rowen, John Simons. Mike Rosati from Marchionda Associates spoke to the Board. Three requirements in construction sequence: 1. Tree clearing must be kept to a minimum 2. Stumps are not to be buried on site (maybe chipped on site for temporary erosion control purposes). 3. Use of soil erosion control product Richard Rowen read letter from Bill Dolan regarding Special Permit. Mike Rosati willing to get a letter to the Planning Office to grant the Board an extension to draft a decision until February 23. No abutters were present. Richard Rowen made a motion to close hearing re: common driveway and direct staff to draft decision. Mr. Mahoney seconded the motion, unanimous vote. Richard Rowen made a motion to close public hearing re: access over legal frontage and directed staff to draft decision. Mr. Mahoney seconded motion. Unanimous vote. John Simons made a motion to accept a written extension, seconded by Alison Lescarbeau. Unanimous decision. On February 21, 1995 the Planning Board held a regular meeting. The following members were present: Richard Nardella, Chairman, Joseph Mahoney, Vice Chairman, Richard Rowen, Alison Lescarbeau. Mr. Mahoney made a motion to approve lot 3AA and 4A Winter Street common drive, seconded by Richard Rowen. The vote was as follows: 3 yes - Mr. Rowen, Mr. Nardella, Mr. Mahoney 1 no - Ms. Lescarbeau, she does not think the driveway is safe for vehicles -too steep. Concern that person would not be able to see other car where driveways merge. Where the two driveways meet there is an expanded turnaround area. Ms. Lescarbeau suggested that the applicant put a turnout in so that a car can get out of the way of the intersection of driveway to lot 4A. Richard Rowen made a motion to revote, seconded by Mr. Mahoney. Unanimous vote. Motion made by Mr. Mahoney, seconded by Mr. Rowen, to approve common driveway decision as amended with a turnout at the access to lot 4A. Unanimous vote. Motion to approve access other than over the legal frontage for lot"4A Winter Street as stated in the draft decisions made by Mr. Rowen, seconded by Mr. Mahoney. Unanimous vote. FINDINGS OF FACT: 1. The application adheres to the bylaw restriction that no more than two (2) lots be serviced by this common drive. 2. The specific location of the common driveway is appropriate due the presence of wetlands between the street frontage and the buildable portion of the lot. 3. The design and location will not adversely affect the neighborhood. 4. There will be no nuisance or serious hazard to vehicles or pedestrians. 5. Adequate standards have been placed on the design which will meet public health and safety concerns. 6. The purpose and intent of the regulations contained in the Zoning Bylaw are met with the Special Permit Application before us. Upon reaching the above findings, the Planning Board approves this Special Permit based upon the following conditions: SPECIAL CONDITIONS: 1. All work associated with the common driveway construction, except for maintaining erosion control devices, shall only occur between May 1st and October 31st of any year. Work beyond October 31st allowed subject to Planning Board approval. 2. The Construction Sequencing as shown on the approved plan must be followed. 3. Prior to any site disturbance: a. The location of the driveway and the limits of clearing as shown on the plan must be marked in the field and reviewed by the Town Planner. 1 b. All erosion control. devices must be in place as shown on the plan and the site disturbance must follow the construction sequence as outlined on the approved plan. C. The decision of the Planning Board must be recorded at the Registry of Deeds and a copy of the recorded decision filed with the Planning Office. d. Tree clearing must be kept to a minimum as shown on the approved plan. e. The applicant shall post (per agreement with the North Andover Planning Board) a Site Work and Erosion Control Bond in the amount of five thousand dollars ($5,000) to be held by the Town of North Andover. The bond shall be in the form of a check made payable to the Town of North Andover to be placed in an interest bearing escrow account. This amount will be held by the Town of North Andover for the duration of the project, until the site is stable. 4. Prior to FORM U verification for the proposed dwellings, a. Easements pertaining to the rights of access for and maintenance of driveways between the lots involved shall be filed with the Registry of Deeds Office and a copy of the recorded document filed with the Planning Office. b. This site shall have received all necessary permits and approvals from the North Andover Board of Health, Conservation Commission, and the Department of Public Works. C. All work in Phases I and II must be complete and stabilized as set forth in the Construction sequence outline on the approved plans. All appropriate erosion control measures for the lot must be in place. Stabilization will be determined by the Town Planner. 5. Prior to a Certificate of Occupancy being issued for either dwelling, a. The Applicant shall place a stone bollard at the entry to the common drive off of Winter Street. This stone bollard shall have the street numbers of all houses engraved on all four sides of the stone. The dimensions of the stone shall be as follows: 8" x 8" x 72". The stone shall have 48" exposed and 24" buried, and all numbering on the stone shall be 4" in height. This condition is placed upon the applicant for the 2 purpose of public safety. b. The proposed dwellings shall have a residential fire sprinkler system installed as required by the North Andover Fire Department. 6. Side slopes shall be stabilized with 4" of loam and seed and an application of soil erosion fiber or similar product. 7. Tree stumps and brush shall be chipped and the mulch used on site to temporarily reduce erosion. No tree stumps will be buried on site. 8. The contractor shall contact Dig Safe at least 72 hours prior to commencing any excavation. 9. Gas, Telephone, Cable and Electric util-ities shall be installed as specified by the respective utility companies. 10. All catch basins shall be protected and maintained with hay bales to prevent siltation into the drain lines during construction. 11. No open burning shall be done except as is permitted during burning season under the Fire Department regulations. 12. No underground fuel storage shall be installed except as may be allowed by Town Regulations. 13. The provisions of this conditional approval shall apply to and be binding upon the applicant, it's employees and all successors and assigns in interest or control. 14. This permit shall be deemed to have lapsed after a two ( 2 ) year period from the date on which the Special Permit was granted unless substantial use or construction has commenced. Therefore the permit will lapse on March 7, 1997. 15.
