closer to the street line than the existing building. The side yard set
.back along the Easterly property line allows ample entrance to the park—

ing areas. The application of 1960 requesting relief, which was granted,
appears to have cited incorrect zoning by—law sections. The denial of
this Petition would cause hardship, comports with the spirit of the
ordinance, and would improve the area.

extended to 100 by 50 feet;
2. That a 15 foot grassed buffer..zone on.the.,Nrr,theast side of
the lot be maintained from the street all the way back.
3. That the plan be revised to show the,correct-zoning designation
and the changes outlined above;

The Board of Appeals held a public hearing on Monday evening,
November 19, 1984 upon the application of William,Boddy. The
hearing was advertised in the North Andover Citizen'.on November 1
and 8, 1984 and .al.l abutters were notif. ied, by ,, egular mail The
following members were present and voting: Frank Serio, Jr.,
Chairman; William J. Sullivan; Augustine 'W. Nickerson; and
Associate Members Walter F. Soule and Maurice S',Foulds.
The petitioner seeks a variance from the provisions of Section 7,
Paragraphs 7.1, 7.2, 7.3 and. Table 2 of the.Zon..ng By Law so as to
permit relief from the required lot area, fi _-Dntage;,. and setbacks
to allow athe construction of an addition or& pi:r�mises located at
87 Belmont Street in the Indiis.trial.-S (I -S)' zoning district.
Counsel for the petitioner testified that a variance granted in
1960 to a previous owner contained faulty information regarding
the sections of the Zoning By Law -and that this petitio.n'seeks to
correct that error as well as seek relief to allow the con-
struction of an addition to an existing building which will not
meet tine setback r.equi.rements on a parcel,of, land: which does not
meet the area orfrontage requirements'of the Zoning By Law. The
petitioner proposes to construct a 24 by 30 foot. addition to the
front of the building and a 50 by 80 foot extension to the rear.

as well as a front setback variar ice for, 'the existing building are

Upon a motion made by Mr.' Foulds and seconded by., yr. Nickerson,
the Board.-
oard voted unanimously to grant 'the 'variance as .requested
s,+ith the following conditions:
'.1. That t}ze proposed addition of ..24 by .30- feet' be eliminated
and that the second proposed addition of 80 .by 50 feet he
extended to 100 by 50 feet.
2. That a 15 foot grassed buffer zone on ,the Northeast side of
the lot be maintained from the street all-Ahe way back.
3. That tYhe plan be revised to show the correct zoning designa-
tion and the charnges outlined above.
4. That the uses under Section 4.132, Paragraphs 8, 10'6and 11
are prohibited.
In granting the variance, the Board finds that S`ction 10'.4 of the
Zoning By Law has been satisfied: In particular., the Board finds
that owing. to circumstances relating to the shape of the land, a
literal enforcement of the provisions of the Zoning By Law would
create a hardship to the petitioner and render a large portion of
the parcel unuseable.
Further, the Board finds that said, relief may be, granted without
creating a substantial detriment to the public -good, since the
parcel' is abutted by other industrial .land and by an R-5 parcel
which will be 'suffered .as conditioned in the Board's decision.
Said variance, in the opinion of the Board, will not nullify or
substantially degogate from the intent and purpose of the Zoning
By Law.
