No insurer shall pay any claims (1) covering the loss, damage or destruction to a building or other structure, amounting to one thousand dollars or more, or (2) covering any loss, damage or destruction of any amount, which causes the condition of a building or other structure to render section six of chapter one hundred and forty-three applicable, without having at least ten days previously given written notice to the building commissioner or inspector of buildings appointed pursuant to the state building code, to the fire department or arson squad of the city of town and to the board of health or board of selectmen of the city or town in which the same is located. If at any time prior to payment the said city or town notifies the insurer by certified mail of its intent to initiate proceedings designed to perfect a lien pursuant to section three A, or to section nine of chapter one hundred and forty-three, or section one hundred and twenty-seven B of chapter one hundred and eleven, the said payment shall not be made while the said proceedings are pending; provided, however, that said proceedings are initiated within thirty days of receipt of such notification. April 22, 1985 R&_)ert Meikle 8 i L Salem Street Pe:ition No. 15-185 The Board of Appeals held a public hearing on Monday evening, March 11, 1985 upon the petition of Robert Meikle. The hearing was advertised in the North Andover Citizen or February 21 and 281 19.85 and all abutters were notified by regular mail. The following members were present and voting: Frank Serio, Jr., Chairman; Alfred E. Frizelle, Esq:, Vice Chairman; William J.' Sullivan; and Walter F. Soule. The petitioner seeks a variance from the provisions of Section 7, Paragraph 7.3 and Table 2 of the Zoning By Law to permit relief from the side setback requirement to allow the construction of a garage and a Special Permit under Section 4, Paragraph 4.121 (17) of the Zoning By Law to allow an in-law apartment, or "family. suite" on premises located at 871 Salem Street. Testimony revealed that the in-law apartment, consisting of a bed- room, living room, kitchen and bath, is needeI for Mr. Meikle's mother. The apartment will be located in the existing garage and the variance is needed to construct a new garage on the parcel. Following opposition from two.abutters, the x-ariance request was withdrawn by the applicant. The Board, upon a motion made by Mr. Frizele and seconded by Mr. Sullivan, voted unanimously to take the petit>>n under advisement and rendered a decision at a regular meeting held on Monday evening, April 8, 1985, with Members Serio, Frizelle,Eallivan and Soule again present and voting. The front entrance shall be in the presently existing breeze- way. 2. There shall be no other entrance to the family suite in the front of the building. 3. Prior to the issuance'of a building permit, the Special Permit shall be recorded at the Registry of Deec's by the Board of Appeals. 4. That the use as developed will not adverr.ely affect the neigh- borhood, since the use when completed wi...l not change the single family appearance of the premises. 3.
