Claims has been made involving loss, damage or destruction of the above captioned property, which
may either exceed $1,000.00 or cause MASSACHUSETTS GENERAL LAWS, CHAPTER 143, SECTION 6, to
be applicable. If any notice under MASSACHUSETTS GENERAL LAWS, CHAPTER 139, SECTION 313 is
appropriate, please direct it to the attention of the writer and include a reference to the captioned
insured, location, police number, date of loss and claim or file number.
Section 313. No insurer shall pay any claims (1) covering the loss, damage or destruction to a building or
other structure, amounting to one thousand dollars or more, or (2) covering any loss, damage or
destruction of any amount, which causes the condition of a building or other structure to render section
six of chapter one hundred and forty-three applicable, without having at least ten days previously given
written notice to the building commissioner or inspector of buildings appointed pursuant to the state
building code, to the fire department or arson squad of the city of town and to the board of health or
board of selectmen of the city or town in which the same is located. If at any time prior to payment the
said city or town notifies the insurer by certified mail of its intent to initiate proceedings designed to
perfect a lien pursuant to section three A, or to section nine of chapter one hundred and forty-three, or
section one hundred and twenty-seven B of chapter one hundred and eleven, the said payment shall not
be made while the said proceedings are pending; provided, however, that said proceedings are initiated
within thirty days of receipt of such notification.
Any lien perfected pursuant to section three A, or to section nine of chapter one hundred and forty-
three or section one hundred and twenty seven B of chapter one hundred and eleven, shall extend to
and may be enforced by the city or town against any casualty insurance policy or policies covering any
loss, damage or destruction pursuant to which the proceeds to perfect the lien were initiated.
~� No insurer shall be liable to any insured owner, mortgagee, assignee, city or town, or other interested
party for amounts disbursed to a city or town under the provisions of this section, or for amounts not
disbursed to a city or town under the provisions of this section.

the front of the building.
3. Prior to the issuance of a building permit, the Special
Permit shall be recorded at the Registry of Deeds by the
Board of Appeals.
4. The family suite is solely for occupancy by Irene Meikle,
mother of Robert Meikle.
5. The Special Permit shall expire at the time Irene Meikle
ceases to occupy the family suite.
6. The Special Permit shall expire at the t.me the premises are

The Board of Appeals held a public hearing on Monday evening,
March 11, 1985 upon the petition of Robert Meikle. The hearing
was advertised in the North Andover Citizen or February 21 and
281 19.85 and all abutters were notified by regular mail. The
following members were present and voting: Frank Serio, Jr.,
Chairman; Alfred E. Frizelle, Esq:, Vice Chairman; William J.'
Sullivan; and Walter F. Soule.
The petitioner seeks a variance from the provisions of Section 7,
Paragraph 7.3 and Table 2 of the Zoning By Law to permit relief
from the side setback requirement to allow the construction of a
garage and a Special Permit under Section 4, Paragraph 4.121 (17)
of the Zoning By Law to allow an in-law apartment, or "family.
suite" on premises located at 871 Salem Street.
Testimony revealed that the in-law apartment, consisting of a bed-
room, living room, kitchen and bath, is needeI for Mr. Meikle's
mother. The apartment will be located in the existing garage and
the variance is needed to construct a new garage on the parcel.
Following opposition from two.abutters, the x-ariance request was
withdrawn by the applicant.
The Board, upon a motion made by Mr. Frizele and seconded by Mr.
Sullivan, voted unanimously to take the petit>>n under advisement
and rendered a decision at a regular meeting held on Monday evening,
April 8, 1985, with Members Serio, Frizelle,Eallivan and Soule
again present and voting.

Upon a motion made by Mr. Frizelle and seconded.by Mr. Soule, the
Board voted unanimously to grant the Special Permit for the in-
law apartment for the existing dwelling and garage only with no
additions under the provisions of the Special Permit subject to
the following conditions:
1. The front entrance shall be in the presently existing breeze-
way.
2. There shall be no other entrance to the family suite in the
front of the building.
3. Prior to the issuance'of a building permit, the Special Permit
shall be recorded at the Registry of Deec's by the Board of
Appeals.
4. The family suite is solely for occupancy by Irene Meikle,
mother of Robert Meikle.
5 . ' The Special Permit shall expire at the tl,ne Irene Meikle ceases
to occupy the family suite.
6. The Special Permit shall expire at the time the premises are
conveyed to any person, partnership, trust or corporation.
7. The applicant, by acceptance of the Certificate of Occupancy
issued pursuant to the Special Permit, grants to the Building
Inspector or his lawful designee the right to inspect the
premises.
In granting the Special Permit,.the Board finds that all the con-
ditions set forth in Section 10.31 of the Zoning By Law have been
satisfied. Specifically, the Board finds:
1. That the specific site, 871 Salem Street, is an appropriate
location for an in-law apartment since t, --,e proposed apartment
will be located ,in an existing garage wi,-,.h no substantial
exterior change to the existing dwelling.
2. That the use as developed will not adverr.ely affect the neigh-
borhood, since the use when completed wi...l not change the
single family appearance of the premises.
3. There will be no nuisance or serious haza-d to vehicles or
pedestrians since ,there will be only one oQcupant of the in-
law apartment.
