The Health Department has been supplied with a list of all residences, currently on septic,
which have access to the municipal sewer system As previously published at a Public
Hearing on March 17, 1994, the Board of Health has adopted regulations concerning the
required sewer tie-in. The following timetable concerning your property status was
adopted:
4.1 All establishments that currently do not have municipal sewer available
to them must connect to the sewer as soon as it becomes available, with a
maximum time limit of six months.
The purpose of these regulations is to safeguard North Andover's drinking water, surface
waters, groundwater and surrounding environment. Sanitary sewer is believed to be the
most effective form of wastewater treatment. A copy of the entire regulation can be
obtained at our office.
Your property is in violation of this Board of Health regulation. Please contact the Health
Department regarding this matter immediately. If we do not hear from you by May 10,
2000 your name will be placed on the regularly scheduled Board of Health meeting agenda
and placed on public notice. The meeting will be held on May 25, 2000 for discussion of
legal action including court hearings.

Dear Mr. & Mrs. Tombarelli:
I brought your recent letter to the attention of the Board of
Health at their last meeting. Although no action was taken, the
Board wished me to inform you that they could not simply grant you
a waiver not to tie in to the municipal sewer system. The most
they could do would be to grant you a specific time waiver, with a
maximum time limit before you had to hook up. Any waiver of this
sort would be predicated on a passing Title 5 septic inspection
done by an approved and certified system inspector.
In addition, there are several issues of which you should be
aware:
1 - "Rejuvination" of septic lines is not an approved course
of action in North Andover.
2 - Currier Septic is licensed only to pump septic systems in
North Andover. One must be licensed to do septic repairs
in any town and no one from that company is licensed to
do any septic repairs in North Andover. Consequently any
repairs to your system were done without the necesary
permits being applied for or issued by the Board of
Health. This is a violation of both state and local
regulations.
3 - It is a violation of state and local septic regulations
to put any chemicals, enzymes, etc. into any septic
system without specific approval from the State
Department of Environmental Protection. This practice
must cease immediately.
4 - It is not unusual for a system as old as yours to fail;
it was installed in 1979. A system replacement, which
will certainly be needed at some point will no doubt cost
you significantly more than the amount you quoted in your
letter for sewer tie-in. It is to your benefit to tie-in
to sewer, although I understand that it doesn't seem that
way at this point.

My name is Stephen Tombarelli. My wife, Donna, and I live at 874 Salem St. (purchased
9/93) and we would like to petition the board to grant us a variance from tying into the
municipal sewer system.
There are two reasons why we are requesting this variance:
1.) Our home sits 319 feet from the road. While we like being that far back for
privacy and the safety it provides my children, it is not where you want to live if
you need to run a sewer line. We received an estimate from Currier Septic from
Middleton, (see attached), showing a cost of $8,000 - $7,000 paid to them and
$1,000 paid to the town. The hefty price tag for this project will either force us
to refinance our home or take a second mortgage. Either of these options are not
comfortable ones. A second mortgage would be a burden put on my family's
extra income which is mostly earmarked to finance the education of our three
children. Even if there is enough equity to refinance the house, it could cost us
between $2,000 and $4,000 in closing costs.
2.) When purchasing the home, we had the system inspected by Currier and to
our surprise the 15 year old system failed. The reason it failed was that it was
clogged and needed to be rejuvinated. It was unknown when the last ime the
system had been pumped or inspected. The previous owner contracted Currier
to remedy the situation and this was completed before we passed papers. The
cost of the repairs were to emphasize that the system is in proper working order.
We faithfully put a liquid into the system weekly. In addition after this first year
(Fall 1994), we had the system pumped and visually inspected and everything was
in order.
We hope that the board will review our request. Again, we feel that the system is in proper working
order. We are available to explain anything that is not clear and provide any additional information
that may be needed to help the board make its decision.

The following items resulted from a Home Inspection on the
property at 874 Salem Street, North Andover; Mass.
The Buyers have a verbal agreement from the Seller to have
the repairs listed below remedied by the Seller.

as in properly working order and condition. The Buyer requests
that the Seller be responsible for any necessary work deemed
necessary so that the existing Septic System meets certification
reoui.rements. This certification to be done before closing on
August 31, 1993.
