The Petitioners originally filed this action on October 29, 2013, alleging violations of the Massachusetts Sanitary Code, 105 CMR 410 et seq., and requesting that the court appoint a receiver for the vacant property located at 88-90 Saunders Street, North Andover, Massachusetts (the "Property"). I let the receiver know that the numerous departments gather for the meeting and although not scheduled, if he were to come in prior to 10 that we would make every effort to give them the information that the receiver needs to get the project started. Both building and conservation staff need to speak with him prior to beginning any work such as demolition. The receiver let me know that they need to begin construction a few days later than anticipated; possibly Monday. They have decided to make a television episode out of the Saunders Street project. Dave, from City Light Homes, told me that the Town would have input as to the format. Whether it is a house renovation project without the N. Andover name attached to it or whether it highlights N. Andover. He said they will be sensitive to the Town's position. The receiver's budget was approved by the court. Dave Seymour, our receiver, was there with his GC for the project, Todd Donaldson. I talked to Todd and Dave. They plan on beginning cleanout/demo tomorrow, and they hope to be completely done with the project in three months, which is great news. Todd mentioned that he would like to introduce himself to some of the town folks, so I suggested he stop by to see Susan and Curt (in addition to stopping by the building department for the necessary permitting, of course). Todd is also a Lowell Police Officer in addition to having a home remodeling/repair/construction business. I know the town is anxious to get this moving, so I think you will be glad to hear that work will begin so quickly and hopefully remain on a fast timetable. As such, I have personal knowledge of the facts recited in this affidavit and have been closely monitoring the various investigations and town involvement at the Property. • On June 12, 2013, I issued an Order Letter to Mr. Peter Moses notifying him that the exterior of the Property was found to be in violation of 105 CMR 410.602 because garbage was strewn about. Similarly, I informed Mr. Moses that the accumulation of garbage on the interior of the Property was a violation of 105 CMR 410.602. Additionally, the letter cited violations of 105 CMR 410.500, 410.503, and 410.551 in the interior of the Property. A copy of this letter is attached as Exhibit A. • Town officials discovered that the premise was vacant and there were broken windows that allowed illegal entry by persons using the location for drug activity and shelter. The openings also allowed entry of animals and pests. These factors indicated that the dwelling was not secure and weathertight, in violation of 105 CMR 410.500. • Town officials reported general filth and piles of trash throughout, including hypodermic needles. The premise had a strong odor of cat urine and fecal matter. These conditions constituted a violation of 105 CMR 410.602. • The condition of the Property was found to be so dangerous that the Inspector of Buildings, along with the North Andover Fire Department, determined it was necessary to board up the property to protect the public. The Order Letter notified Mr. Moses that he had forty eight (48) hours to clean the Property, or to submit proof of the engagement of a licensed contractor to correct the violations of the Sanitary Code. • As of today's date, no efforts have been made to bring the Property into compliance with the Code and the Property remains in violation of the Code and a severe threat to the health and safety of the community.
